Existing problems at present
At present, Changzhou Border Inspection Station actively adapts to the needs of port control informationization, gives full play to the effectiveness of the three-level integrated command platform, and comprehensively implements the four-in-one port control mode of "bayonet monitoring, patrol inspection, closed-circuit monitoring and police-enterprise linkage". This service mode provides a more relaxed environment for economic construction and reform and opening up, facilitates the entry and exit of vehicles and their employees, and improves the efficiency of police use in this station. Due to the short service mode, there are still several problems in practical work:
First, the unclear understanding of the region restricts the depth of management. Some people often ignore the warning signs of border inspection and enter the port restricted area through the gate of the port area. According to the investigation, most people are not very clear about the concept of the port restricted area, and only think that they can enter the port restricted area by boarding an ocean-going ship. In view of this situation, our officers and men on duty mainly focus on education, helping them to clarify the concept of port restricted areas and strengthen their legal awareness. However, some people with illegal intentions are mixed in the crowd, which is easy to cause misjudgment of duty personnel and bring confusion and hidden dangers to our inspection management.
Second, the overlapping management functions restrict the status of law enforcement. At present, border inspection, customs, inspection and quarantine, maritime affairs and other port inspection units, according to their respective responsibilities and regulations, carry out inspection, supervision and management of the port restricted area, entry-exit personnel, means of transport, goods, luggage and other items, which objectively leads to problems such as compartmentalization, overlapping business, unclear responsibilities, many management links and complicated procedures. Border inspection stations are not prominent in the management of port restricted areas, which affects the improvement of customs clearance efficiency and service level to some extent.
Third, the management of bayonet is loose, which restricts management. At present, Changzhou General Wharf, Lu 'anzhou Wharf and Taojian Shihua Wharf have all divided the restricted areas of border inspection ports, and set up relevant warning signs in prominent positions in the port areas. However, due to the lag of border inspection, most of the personnel and vehicles in the restricted area of the import and export shore are managed by the security department of the terminal company at the entrance of the terminal. As the doorman of the terminal building is not directly managed by the border inspection organ and has no subordinate relationship, the supervision and management of the security personnel by the border inspection organ cannot be directly and effectively carried out, and there are loopholes in poor management to a great extent.
Fourth, the punishment is not enough, which weakens the purpose of deterrence. The current Regulations on Exit and Entry Frontier Inspection of People's Republic of China (PRC) came into effect on September 1995, and the penalty amount set according to the economic development at that time was obviously too low. The amount of penalty for violating the rules or boarding regulations in the port restricted area is basically within the scope of 500 yuan. Generally, it only involves 50 yuan. According to Changzhou's current economic development and personal income level, the cost of violation is too low and the punishment is obviously insufficient. For some people who board the ship without a license, the fine below 500 yuan will not play a role of punishment and warning compared with the value return they can get after boarding the ship without a license.
Solution to the problem
It is of great significance to strengthen the management of port restricted areas and further revitalize the port management situation for creating a good entry and exit environment.
First, it is necessary to strengthen the propaganda depth of the port restricted area and raise the awareness of personnel as "masters". On the one hand, we should intensify the "hard" propaganda work, and set up a series of publicity and notification facilities such as police bulletin boards and bulletin boards at the entrance of the wharf to inform the qualifications for entering the restricted area and the legal consequences that should be borne by violating the regulations, so that some excuses of "not knowing that it is a restricted area" or "not knowing that foreign ships can't board the ship" cannot be established. On the other hand, do a good job in "soft" publicity and education, and if necessary, conduct centralized education and publicity for companies and units that often have employees entering and leaving the restricted area, so that employees can consciously abide by the law, better cooperate with the border inspection work, and report suspicious situations to the border inspection authorities in time. At the same time, it is necessary to strengthen social propaganda, strengthen the publicity of border inspection laws and regulations and port management regulations at the social level through radio, television, newspapers and other media, and further win the cooperation, understanding and support of the masses for border inspection work.
Second, we should innovate the management mode of port restricted areas and build a strong port security barrier. At present, the police force is quite tight, so we imagine that we can hire the coordinator of the port restricted area as the guard of the bayonet to help carry out the security and channel management around the port restricted area, and better cooperate with the monitoring and patrol police work. Border inspection stations are responsible for the appointment and removal of coordinators, direct supervision, unified management and division of labor, and separating security personnel from the establishment of factories and port companies, which is conducive to their full-time border inspection work, strict law enforcement and improvement of their ability to prevent and crack down on illegal entry and exit activities.
Third, strengthen the punishment of the port restricted area and ensure the combination of punishment and education. Under the premise of clarifying the basis of law enforcement, standardizing law enforcement procedures, and unifying the criteria for determining and punishing illegal acts, we should increase the punishment for illegal acts. It is reported that the "People's Republic of China (PRC) Exit and Entry Administration Law (Draft for Review)" has greatly increased the amount of punishment and introduced the provision of paying equal attention to fines and detention. This law has more explicit and clear requirements for the management of the port restricted area, especially the main position of border inspection law enforcement, regional delineation and the cooperation of local port management departments. At the same time, give administrative punishment to those who violate the border inspection laws, pay attention to education, improve the legal concept of border inspection, make the citizens consciously abide by and safeguard the border inspection laws, and form a good atmosphere of law-abiding, mutual supervision, harmony, security and stability.
Fourth, we should find a balance between management and service and establish a new image of border inspection in limited areas. It is necessary to closely combine the management of the port restricted area with the improvement of service level and the construction of "big customs clearance" and "demonstration wharf", continuously improve the management and control efficiency, customs clearance efficiency and service capacity, and continuously improve the status of law enforcement and the image of the window. First, we should be good at summing up, publicizing and popularizing the successful practices and achievements of strengthening the management of port restricted areas, so that local party committees and governments can fully realize the necessity of strengthening the management of port restricted areas; Second, we should be good at grasping the key points of customs clearance efficiency and order, find the right combination point when applying for support and strengthening border inspection services in limited areas of ports, and make a fuss about the construction of "big customs clearance" and "model wharf" to reflect our actions; The third is to give full play to the advantages of strict management, strict discipline and quick action of the troops, and play an important role in port emergencies, riot prevention, customs clearance, service, etc., reflecting advantages, demonstrating actions and winning positions.
