Regulations of Jiangsu Province on Marine Environmental Protection
Chapter I General Provisions Article 1 In order to protect and improve the marine environment, protect marine resources, prevent pollution damage, maintain ecological balance, safeguard human health, and promote sustainable economic and social development, these Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of Marine Environment and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 Units and individuals engaged in navigation, exploration, development, production, tourism, scientific research and other activities within the sea area under the jurisdiction of this province, or engaged in activities affecting the marine environment within the coastal land area of this province, shall abide by these regulations.

Those who engage in activities that affect the marine environment outside the waters under the jurisdiction of this province and cause pollution damage to the waters under the jurisdiction of this province shall be dealt with in accordance with the relevant provisions of the state and these regulations. Article 3 Marine environmental protection shall be planned in an overall way, giving consideration to land and sea, giving priority to prevention, and paying equal attention to pollution prevention and ecological construction. Article 4 The local people's governments at or above the county level in the coastal areas shall incorporate marine environmental protection into the national economic and social development plan of the region, adhere to the principle of giving priority to environmental protection, adopt policies and measures conducive to marine environmental protection, increase investment in marine environmental protection, and strengthen marine environmental protection.

The funds required for marine environmental protection, such as marine ecological construction and marine environmental monitoring, shall be arranged by the local people's governments at or above the county level along the coast according to the needs of marine environmental protection and the actual situation in the region and included in the fiscal budget at the corresponding level. Article 5 The competent administrative department of environmental protection of the coastal local people's governments at or above the county level (hereinafter referred to as the competent administrative department of environmental protection), as the unified supervision and management department of environmental protection, directs, coordinates and supervises the marine environmental protection work in the sea areas under the jurisdiction of the government at the corresponding level, and is responsible for the prevention and control of inland river pollutants and the environmental protection work caused by coastal engineering construction projects within their respective administrative areas.

The marine administrative department of the coastal local people's government at or above the county level (hereinafter referred to as the marine administrative department) is responsible for the supervision and management of the marine environment in the sea areas under the jurisdiction of the government at the corresponding level, organizing marine environmental investigation, monitoring, surveillance, evaluation and scientific research, protecting and restoring the marine ecological environment, and protecting the environment caused by marine engineering construction projects, marine dumping of wastes and other related marine development activities.

The maritime administrative agency shall be responsible for the supervision and management of pollution of the marine environment by non-military vessels in the waters of the port area and non-fishing and non-military vessels outside the waters of the port area, and shall be responsible for the investigation and handling of pollution accidents; Inspect and deal with pollution accidents caused by foreign ships sailing, berthing and operating in waters under jurisdiction. Where a ship pollution accident causes damage to the fishery, the fishery administrative department shall participate in the investigation and handling.

The fishery administrative department of the coastal local people's government at or above the county level (hereinafter referred to as the fishery administrative department) is responsible for the supervision and management of marine environment pollution by non-military vessels in the fishing port waters under the jurisdiction of the government at the corresponding level and fishing vessels outside the fishing port waters, the protection of fishery ecological environment in the waters under the jurisdiction of the government at the corresponding level, and the investigation and handling of fishery pollution accidents other than those specified in the preceding paragraph. Article 6 The implementation of marine environmental protection shall be incorporated into the environmental protection term responsibility objectives of the people's governments of cities and counties (cities, districts) with coastal districts, and a system of responsibility assessment and accountability shall be implemented.

The local people's governments at or above the county level in coastal areas shall report to the people's congresses at the corresponding levels and their standing committees on the quality of the marine environment in their respective areas, the implementation of the system for controlling the total discharge of pollutants in key sea areas and other marine environmental protection work. Seventh coastal local people's governments at or above the county level and their relevant departments shall strengthen the publicity and education of marine environmental protection laws and regulations, encourage and support units and individuals to carry out public welfare activities to protect the marine environment. Units and individuals that have reported illegal acts that pollute the marine environment and made remarkable achievements in protecting and improving the marine environment shall be commended and rewarded. Chapter II Supervision and Management Article 8 The provincial marine administrative department shall, jointly with the provincial environmental protection administrative department, the maritime administrative agency and the municipal people's government with coastal districts, formulate the marine environmental protection plan of this province and the marine environmental protection plan of key sea areas according to the marine functional zoning of this province, and submit them to the provincial people's government for approval after comprehensive balance by the provincial development and reform administrative department.

The list of key sea areas in this province shall be compiled by the provincial marine administrative department in conjunction with the municipal people's government with coastal districts and relevant provincial departments, and submitted to the provincial people's government for approval and promulgation. Article 9 Marine environmental protection planning includes marine environmental protection objectives, main tasks, main measures, requirements for various departments and coastal areas, and arrangements for marine ecological construction projects.

Marine environmental protection planning should be linked with environmental protection planning, overall planning for coastal development and planning for the use of sea areas. Article 10 The marine administrative departments of cities and counties (cities, districts) with coastal districts shall, jointly with the environmental protection administrative departments and relevant marine administrative agencies, formulate implementation plans according to the provincial marine environmental protection plans and the marine environmental protection plans of key sea areas, organize their implementation after being approved by the people's government at the same level, and report them to the provincial marine administrative departments and the environmental protection administrative departments for the record. Article 11 The marine administrative departments of provinces and cities divided into districts shall, jointly with relevant departments, regularly organize marine resources and environmental surveys in the coastal areas and key sea areas under the jurisdiction of the government at the corresponding level. The investigation contents mainly include: marine chemistry, marine biology and ecology, and pollutant discharge from major estuaries.
