Chapter I General Provisions

Article 1 In order to strengthen the management of bus and tram passenger transport in this Municipality, maintain labor order, improve service quality, safeguard the legitimate rights and interests of passengers and operators, and promote the development of bus and tram passenger transport, these Regulations are formulated according to the actual situation of this Municipality.

Article 2 These Regulations shall apply to the operation and related management activities of bus and tram passenger transport within the administrative area of this Municipality.

The term "buses and trams" as mentioned in these Regulations refers to buses and trams that operate in accordance with fixed lines, stations and specified time within the administrative area of this Municipality, are used for carrying passengers, and are charged according to the approved operating charges.

Article 3 Shanghai Municipal Bureau of Transportation (hereinafter referred to as the Municipal Bureau of Transportation) is the administrative department in charge of bus and tram passenger transport in this Municipality, and is responsible for organizing the implementation of these Regulations.

Shanghai Public Transport Passenger Transport Management Office under the Municipal Transportation Bureau (hereinafter referred to as the Municipal Public Transport Management Office) is responsible for the daily management, supervision and inspection of bus and tram passenger transport in this Municipality, and implements administrative penalties according to the authorization of these Regulations.

The district and county people's governments and relevant administrative departments shall, in accordance with their respective responsibilities, coordinate the implementation of these regulations.

Article 4 The development of bus and tram passenger transport should be compatible with economic development, urban construction, environmental protection and people's living standards, conform to the overall urban planning, and be coordinated with other modes of bus and tram passenger transport.

According to the nature of public transport public welfare undertakings, this Municipality implements the principle of giving priority to development, implements corresponding support policies for the construction and investment of bus and tram passenger transport facilities, and forms a reasonable price mechanism. This Municipality encourages the application of advanced science and technology and management methods in the management of bus and tram passenger transport.

Article 5 The Municipal Transportation Bureau shall, according to the actual needs of urban development and convenience for citizens to travel, organize the preparation of passenger transport development plans for buses and trams, and incorporate them into the overall urban planning after comprehensive balance by the municipal planning administrative department.

Article 6 The business activities of bus and tram passenger transport in this Municipality shall follow the principles of obeying planning, fair competition, safe operation, standardized service and convenience for passengers.

Chapter II Lines and Line Management Rights

Article 7 The Municipal Transportation Bureau shall, on the basis of listening to the opinions of the people's governments of all districts and counties and other parties, formulate or adjust the bus and tram passenger line network planning (hereinafter referred to as line network planning) and site planning of this Municipality in conjunction with relevant departments according to the development plan of this Municipality's bus and tram passenger transport.

The development and adjustment of bus and tram passenger lines (hereinafter referred to as lines) in this Municipality shall meet the requirements of line network planning.

Article 8 The Municipal Transportation Bureau shall, jointly with the municipal public security and municipal administrative departments, formulate annual plans for line development and adjustment according to the actual needs of line network planning and urban development, and publish them before implementation.

When formulating the annual plan for line development and adjustment, the Municipal Transportation Bureau shall listen to the opinions of the citizens and the relevant district and county people's governments. The county people's government can also put forward opinions on opening or adjusting the line according to the actual needs of the local area, which will be included in the annual plan for opening and adjusting the line after being examined and approved by the Municipal Transportation Bureau in conjunction with the municipal public security and municipal management departments.

Ninth tourist routes should be included in the network planning. The development and adjustment of tourist routes are proposed by the municipal tourism administration department and determined after the balance of the Municipal Transportation Bureau.

Article 10 Operators engaged in line operation shall obtain the line operation right granted by the Municipal Transportation Bureau.

(six) there are corresponding management personnel and drivers, ticket sellers and dispatchers who have obtained service qualification certificates, among which the driver should have more than one year's driving experience.

If the operator obtains the right to operate the line, the Municipal Transportation Bureau shall issue a certificate of the right to operate the line.

Thirteenth Municipal Transportation Bureau shall strengthen the construction of urban bus and tram passenger transport infrastructure; Strengthen the management of bus and tram passenger transport market and investigate and deal with unlicensed business practices; Except in special circumstances, double lines are not opened for the lines of the confirmed operators.

Article 14 The Municipal Transportation Bureau shall organize an annual review of the operation and service conditions of operators, and the results of the review shall be used as one of the bases for granting or revoking the right to operate lines.

The Municipal Transportation Bureau shall invite representatives of passengers to participate in the evaluation of the operators' operation and service conditions, and listen to the opinions of all sectors of society.

Fifteenth operators who have obtained the right to operate the line shall be issued by the Municipal Public Transport Management Office according to the number of vehicles they operate; Drivers, ticket sellers and dispatchers who have passed the training and examination shall be issued with corresponding service certificates by the Municipal Public Traffic Management Office.

The annual inspection system shall be implemented for vehicle operation certificates and service certificates of drivers, ticket sellers and dispatchers. Operating vehicles that have not passed the annual inspection or failed the annual inspection shall not be used for line operation; Drivers, ticket sellers and dispatchers who fail to pass the annual inspection or fail to pass the annual inspection shall take part in the training and go through the annual inspection procedures only after passing the examination.

Drivers, ticket sellers and dispatchers who did not take the test or failed the test shall not be issued the corresponding service certificates by the Municipal Public Transport Management Office.

Drivers, ticket sellers and dispatchers whose service qualification certificates have been revoked shall not issue corresponding service qualification certificates within two years.

Chapter III Operation Management

Sixteenth operators in obtaining the right to operate the line, should implement the passenger service, traffic safety and other aspects of the operation and management system.

Operators shall organize operations in accordance with the approved routes, stations, shifts, time, number of vehicles, models and vehicle passenger quotas, and shall not change or stop operations without authorization.

Seventeenth operators shall, according to the operation requirements and passenger flow situation stipulated in these regulations, prepare the line operation plan and report it to the Municipal Public Traffic Management Office for the record. Operators shall operate according to the line operation plan.

The Municipal Public Transport Management Office shall supervise and inspect the implementation of the operator's line operation plan.

Eighteenth need to use unmanned ticket operation, the operator shall, within ten days from the date of operation, to the municipal public transport management office for the record.

In case of unmanned ticketing operation, the operator shall, in accordance with the provisions of the Municipal Transportation Bureau on unmanned ticketing operation vehicles, set up coin boxes, electronic card readers and electronic station reporting equipment and keep them intact; The ticket should be next to the coin box.

Twenty-first operators need to terminate their operations due to dissolution, bankruptcy and other reasons within the term of the right to operate the line, and shall notify the Municipal Transportation Bureau in writing three months before the date of termination. The Municipal Transportation Bureau shall determine the new operators before the operators terminate their operations.

Twenty-second need to suspend or terminate the line operation, site use, the operator shall submit a written application to the Municipal Transportation Bureau, after examination and approval.

If it is necessary to change the site or operation line, the operator shall submit a written application to the Municipal Public Traffic Management Office, which shall be implemented after the approval of the municipal public security, municipal and other administrative departments.

If the network planning is adjusted, the Municipal Public Transport Management Office may require the operator to implement the operation adjustment, and the operator shall implement it.

Because of the road, underground pipelines and other urban infrastructure construction or road conditions affect the safety of operation, the municipal public transport management office can, according to the opinions put forward by the municipal public security and municipal management departments, require operators to implement operational adjustments, and operators should implement them.

Twenty-third in addition to force majeure or other emergencies, the operator shall, five days before the implementation date, with the approval of the Municipal Public Transport Management Office, publicly announce the operation adjustment announcement at each station of the line.

Except for force majeure or other emergencies, if the Municipal Public Transport Management Office implements operational adjustment according to the provisions of the third and fourth paragraphs of Article 22 of these regulations, it shall make an announcement at each station of the line five days before the implementation date.

If more than two related lines are adjusted at the same time, the Municipal Public Transport Management Office shall also make an announcement through the news media.

Twenty-fourth in any of the following circumstances, the operator shall, in accordance with the unified dispatch of the Municipal Public Transport Management Office, timely organize the evacuation of vehicles and personnel:

(1) There is a serious shortage of vehicles at major passenger distribution points;

(2) Organizing major social activities;

(3) Other emergency evacuation.

Twenty-fifth operators shall collect fees in accordance with the operating fees approved by the Municipal People's government.

After the operator collects the operating expenses from the passengers, it shall issue an equivalent ticket recognized by the Municipal Transportation Bureau and the Municipal Tax Department.

The bus tickets uniformly printed and sold by the municipal public passenger ticketing agencies are common in the city's operating routes, and operators and their employees may not refuse. The recovery and settlement of tickets shall be handled by the municipal public passenger ticketing agencies and operators in accordance with the provisions of the Municipal Transportation Bureau.

Twenty-sixth operators should strengthen the inspection, maintenance and repair of operating vehicles, and make records to ensure that the vehicles put into operation meet the following requirements:

(a) the vehicle is clean and tidy, and the facilities are in good condition;

(two) vehicle performance and exhaust emissions meet the technical specifications stipulated by the state;

(three) in the designated location, indicate the operating charges, the name of the line and the name of the operator;

(four) put a copy of the vehicle operation license in the designated location;

(5) Posting the Shanghai Bus and Tram Ride Rules (hereinafter referred to as the Ride Rules) formulated by the Municipal Transportation Bureau according to these Regulations, the schematic diagram of the route direction and the passenger complaint telephone number at the specified position.

Twenty-seventh equipped with radio communication dispatching equipment, the operator shall report and register the radio communication dispatching equipment and its frequency to the Municipal Public Traffic Management Office, and keep the equipment in a continuous and normal working state.

Twenty-eighth operators should strengthen the management of drivers, ticket sellers and dispatchers, and improve the quality of service.

Drivers and ticket sellers shall observe the following provisions when engaging in operational services:

(1) Carrying a service certificate consistent with the vehicle operation certificate;

(two) according to the approved line, site, frequency, time, vehicle passenger quota operation;

(three) according to the approved business charges;

(four) in the provisions of the site or approved by the * * * where there is a welcome station;

(five) in accordance with the provisions of the line name, vehicle direction and stop site name, the correct use of electronic stop reporting equipment;

(six) keep the vehicle clean and tidy, and maintain the order of riding in the carriage;

(seven) the vehicle shall not be handed over to the personnel who do not have the conditions stipulated in these regulations;

(eight) vehicles are not allowed to stay at the site, which hinders the operation order;

(nine) to provide necessary help for the old, young, sick, disabled, pregnant women and passengers with babies;

(10) Smoking in the car is prohibited.

Dispatchers engaged in job scheduling shall comply with the following provisions:

(1) Wearing a service certificate;

(2) Dispatch vehicles according to the traffic operation plan, and dispatch vehicles reasonably under special circumstances;

(3) Truthfully record the driving data.

Twenty-ninth passengers have the right to obtain safe and convenient passenger service.

In any of the following circumstances, passengers may refuse to pay the fare:

(a) the operating vehicle fails to indicate the operating charge standard according to the regulations;

(two) the driver or conductor does not issue or is not equipped with a ticket that meets the requirements;

(3) Failing to turn on the air-conditioning or ventilation facilities on vehicles equipped with air-conditioning facilities according to regulations;

(4) The electronic bus card cannot be used on the vehicle equipped with the electronic card reader, because the electronic card reader is not opened or has a fault.

When the vehicle fails to operate normally in operation, passengers have the right to ask the driver and conductor of the vehicle on the same line and in the same direction to ride for free, and the driver and conductor of the vehicle on the same line and in the same direction shall not refuse; If the driver or conductor cannot arrange to take the vehicle on the same route and in the same direction within the specified time, the passenger has the right to demand a refund of the fare at the original price.

Passengers should pay the fare according to the regulations. If the passenger fails to pay the fare according to the regulations, the operator and his employees may ask him to pay the fare, and may charge him five times the operating fee standard.

Chapter IV Facilities Construction and Management

Article 31. Without the approval of the original examination and approval unit, no unit or individual may occupy or change the use of bus and tram passenger land and space designated and reserved in the overall urban planning of this Municipality.

Thirty-second people's governments at all levels should support, encourage and participate in the new construction, renovation or expansion of large bus and tram station facilities and parking lots.

New construction, renovation and expansion of bus and tram station facilities and parking lots shall conform to the bus and tram development planning, network planning and station planning of this Municipality. The planning administrative department shall solicit the opinions of the Municipal Transportation Bureau before issuing the construction project planning permit.

In any of the following circumstances, the construction unit shall, in accordance with the planning requirements, support the construction of bus and tram parking facilities:

(a) new or expanded airports, railway stations, passenger terminals, long-distance bus stations, rail transit stations and other public places where passenger flow is distributed;

(2) Building or expanding large-scale public facilities;

(three) new or expanded residential areas with a certain scale.

The construction unit shall notify the Municipal Transportation Bureau to participate in the acceptance before it can be put into use. Those that fail to pass the inspection or the inspection shall not be put into use.

Without the approval of the Municipal Transportation Bureau, the station facilities shall not be closed or used for other purposes.

Thirty-third line stations should be set up in accordance with the principle of convenience for passengers and reasonable spacing between stations.

The operator shall set up vehicle dispatching and waiting facilities at the starting and ending stations of the line, and post the riding rules, the price list of operating charges and the passenger complaint telephone number.

The starting and ending stations of new lines should be set up with upper and lower stations respectively.

Thirty-fourth operators should set up stop signs (including temporary stop signs, the same below) at bus and tram stations in accordance with the unified standards stipulated by the Municipal Public Transport Management Office.

Bus and tram stop signs shall indicate the line name, the time of the first and last bus, the names of stops and stops along the way, the driving direction, operating charges and other contents, and keep them clear and intact; For lines with operating frequency intervals of more than 30 minutes, the time when each vehicle passes through the site should also be indicated.

If the construction project may endanger the safety of tram power supply facilities, the construction unit shall negotiate with the tram power supply unit and take corresponding safety protection measures before construction.

Chapter V Supervision, Inspection and Complaints

Article 39 The Municipal Transportation Bureau and the Municipal Public Traffic Management Office shall strengthen the supervision and inspection of bus and tram operation activities.

Personnel engaged in supervision and inspection of the Municipal Transportation Bureau and the Municipal Public Traffic Management Office shall hold administrative law enforcement certificates.

Fortieth city bus management office and operators shall establish a complaint acceptance system to accept passengers' complaints about violations of these regulations.

Forty-first operators shall make a reply within ten working days from the date of accepting passenger complaints. Passengers who have objections to the operator's reply may appeal to the Municipal Public Transport Management Office.

The Municipal Public Transport Management Office shall make a reply within twenty working days from the date of accepting the passenger's complaint or appeal.

Forty-second city public transport management office can check the complaints and complaint handling of operators. When verifying and handling complaints, the Municipal Public Transport Management Office shall issue a verification notice to the operators.

The operator shall, within ten working days from the date of receiving the verification notice, reply the relevant information or handling opinions in writing to the Municipal Public Transport Management Office.

Chapter VI Legal Liability

Forty-third in violation of the provisions of the first paragraph of Article 10 of these regulations, those who engage in bus and tram business without obtaining the right to operate the line shall be confiscated by the Municipal Public Traffic Management Office and fined between 5,000 yuan and 50,000 yuan. Before making an administrative punishment, the Municipal Public Traffic Management Office may detain the operating vehicle and order the actor to go to the designated place for treatment within the prescribed time limit.

Forty-fourth in violation of the provisions of the second paragraph of Article 10 of these regulations, any of the following acts shall be confiscated by the Municipal Transportation Bureau, and a fine of not less than 5,000 yuan but not more than 50,000 yuan may be imposed, or the certificate of line operation right shall be revoked:

(a) the right to operate the line is contracted out to other units or individuals;

(two) unauthorized transfer of line management rights.

In violation of the provisions of the sixteenth paragraph of this Ordinance, the operator fails to implement the passenger service and traffic safety operation management system, and the Municipal Transportation Bureau shall order it to make corrections within a time limit. If no correction is made within the time limit, the Municipal Transportation Bureau may revoke its line operation certificate.

If the acts in the first and second paragraphs cause heavy losses to public or private property, serious social impact or other serious consequences, the Municipal Transportation Bureau may revoke part or all of its certificate of line operation right.

Article 45 Whoever, in violation of the provisions of the first paragraph of Article 15 of these regulations, operates a vehicle without a license or the driver, conductor or dispatcher has no service license, shall be ordered by the Municipal Public Traffic Management Office to make corrections or make corrections within a time limit, and may also be given a warning or fined between 1,000 yuan and 5,000 yuan.

Drivers, ticket sellers and dispatchers have one of the following acts, and the Municipal Public Traffic Management Office may impose a warning or a fine of 50 yuan or 200 yuan; If serious consequences are caused, the service certificate may be revoked:

(a) in violation of the provisions of the second and third paragraphs of article twenty-eighth, failing to comply with the service standards of employees;

(two) in violation of the provisions of the third paragraph of article twenty-ninth, failing to organize passengers to transfer or refund free of charge;

(three) in violation of the provisions of the third paragraph of article thirty-fifth, do not obey the website management personnel.

Forty-sixth operators have one of the following acts, the municipal public transport management office shall order them to make corrections or make corrections within a time limit, and may impose a warning or a fine of more than 200 yuan but less than 2,000 yuan:

(four) in violation of the provisions of article twenty-sixth, the operating vehicles do not meet the requirements.

(a) in violation of the provisions of the seventeenth paragraph of this Ordinance, the traffic operation plan has not been reported to the Municipal Public Transport Management Office for the record;

(two) in violation of the provisions of the provisions of article twentieth, not in the provisions of the site or the * * * approved by the escort station arrangement;

(three) in violation of the provisions of article twenty-fifth, not in accordance with the approved operating charges, not to issue equivalent tickets or refuse to accept ordinary bus tickets after charging fees;

(four) in violation of the provisions of article twenty-eighth, the illegal rate of drivers, ticket sellers and dispatchers of operators has exceeded 2% for two consecutive months.

If the operator commits one of the following acts, the Municipal Public Transport Management Office shall order it to make corrections or make corrections within a time limit, and may impose a fine of 1000 yuan or more 10000 yuan or less:

(a) in violation of the provisions of article twenty-first, to terminate the operation without authorization;

(two) in violation of the provisions of the first paragraph and the second paragraph of article twenty-second, the operation is adjusted without authorization;

(three) in violation of the provisions of the first paragraph of article twenty-third, the operation adjustment has not been announced;

(four) in violation of the provisions of article twenty-fourth, do not obey the unified dispatch of the municipal public transport management office.

Forty-seventh one of the following acts, the municipal public transport management office shall order the perpetrator to make corrections or make corrections within a time limit, and may impose a fine of two thousand yuan or more and twenty thousand yuan or less:

(a) in violation of the provisions of the fifth paragraph of Article 32 of these regulations, the operator closes the station facilities without authorization or uses the station facilities for other purposes.

(two) in violation of the provisions of the second paragraph of article thirty-third, the operator fails to set up vehicle dispatching and waiting facilities at the starting and ending stations of the line.

(three) in violation of the provisions of article thirty-fourth, the operator did not set up a stop sign.

(four) in violation of the provisions of the second paragraph of article thirty-fifth, do not maintain the order of on-site operation.

(five) in violation of the provisions of the first paragraph of article thirty-sixth, the location, area and color of the advertisements placed by the operators on the operating vehicles do not meet the requirements of the operation and management of buses and trams.

(six) in violation of the provisions of the second paragraph of article thirty-sixth, playing audio advertisements or distributing written advertisements in the carriage.

(seven) in violation of the provisions of the third, fourth and fifth paragraphs of article thirty-seventh, endangering the safety of tram power supply facilities. If the actor's illegal behavior causes property losses, he shall also be liable for compensation.

Forty-eighth Municipal Transportation Bureau and Municipal Public Transport Management Office shall establish and improve the supervision system for the law enforcement of passenger transport supervision and inspection personnel. City Transportation Bureau, City Public Transport Management Office directly in charge and other directly responsible personnel dereliction of duty, abuse of power, corruption, by their units or the competent department at a higher level shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 49 If a party refuses to accept a specific administrative act of the Municipal Transportation Bureau or the Municipal Public Transport Management Office, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Administrative Reconsideration Law of People's Republic of China (PRC) or the Administrative Procedure Law of the People's Republic of China.

If a party fails to apply for reconsideration, bring a lawsuit or perform a specific administrative act within the time limit, the Municipal Transportation Bureau or the Municipal Public Transport Management Office that has made the specific administrative act may apply to the people's court for compulsory execution.

Chapter VII Supplementary Provisions

Article 50 The meanings of relevant terms in these Regulations:

(a) * * * station refers to the starting station, terminal station and hub station used by two or more lines.

(2) Double-track refers to a new line whose total length exceeds 70% of the original line, or a new line passing through the main tourist source section of the original line and whose starting and ending stations are close to the original line.

(3) Towns refer to central cities, new towns, central towns and general towns.

(4) The violation rate of drivers, ticket sellers and dispatchers refers to the percentage of drivers, ticket sellers and dispatchers who violate the provisions of these Regulations to the total number of drivers, ticket sellers and dispatchers with service certificates.

Fifty-first operators who have been engaged in line operation before the implementation of these regulations shall go through the formalities for obtaining the right to operate the line with the Municipal Transportation Bureau.

Article 52 These Regulations shall come into force as of 20011.
