The term "port engineering construction" as mentioned in these Provisions refers to the construction of wharf engineering (including outfitting wharf engineering) and its supporting facilities, breakwater, anchorage, revetment and other projects within the scope of port planning in order to realize the port function. Article 3 The Ministry of Transport shall be in charge of the industry management of port engineering construction throughout the country.
Provincial transportation departments are responsible for the supervision and management of port engineering construction within their respective administrative areas.
The local port administrative department shall, in accordance with the provisions of the local people's government, supervise and manage the port engineering construction within its administrative area. Article 4 Port engineering construction shall comply with laws and regulations, technical standards and port planning. Fifth port engineering safety facilities should be designed, constructed and put into use at the same time as the main project.
New construction, reconstruction and expansion of wharf projects shall plan, design and build shore power facilities. The completed wharf should gradually implement the transformation of shore-based power supply facilities.
Port projects shall, in accordance with the requirements of laws and technical standards, build facilities for receiving pollutants from ships at the same time, and make a good connection with urban public transportation and disposal facilities.
Passenger transport hub project shall build passenger transport facilities in accordance with the requirements of specifications and technical standards to meet the needs of passengers for safe and convenient travel. Article 6 The port engineering construction shall be encouraged to adopt new technologies, new equipment, new processes and new materials, implement standardized management of engineering quality and safety, strengthen management and control of construction safety risks, and organize construction scientifically. Article 7 The port engineering construction project unit (hereinafter referred to as the project unit) shall apply for the project by logging in to the online project supervision platform established by the state (hereinafter referred to as the online platform), and fill in the information on commencement, construction progress and completion as required.
Provincial transportation departments and local port administrative departments should use online platforms for online approval, online monitoring and collaborative supervision. , thus improving the level of information management. Chapter II Management of Construction Procedures Article 8 Port engineering construction projects shall be carried out in accordance with the construction procedures prescribed by the state. Unless otherwise stipulated by the state, capital construction procedures shall not be simplified without authorization. Article 9 The following construction procedures shall be implemented for port engineering construction projects invested by the government:
(a) to carry out the pre-feasibility study of the project and prepare the project proposal;
(two) according to the approved project proposal, carry out the feasibility study of the project and prepare the feasibility study report;
(three) according to the approved feasibility study report, prepare the preliminary design documents;
(four) according to the approved preliminary design documents, the preparation of construction drawing design documents;
(five) to handle the examination and approval procedures for construction drawing design;
(six) according to the relevant provisions of the state, go through the relevant formalities before construction according to law, and start construction after conditions are met;
(7) Organizing the implementation of the project;
(eight) after the completion of the project, prepare the completion data and make preparations for the completion and acceptance of the project;
(9) Organizing the completion acceptance. Tenth port engineering construction projects invested by enterprises shall implement the following construction procedures:
(a) the preparation of the project application or fill in the filing materials, and perform the approval or filing procedures;
(two) according to the approved project application or filing data, the preparation of preliminary design documents;
(three) according to the approved preliminary design documents, the preparation of construction drawing design documents;
(four) to handle the examination and approval procedures for construction drawing design;
(five) in accordance with the relevant provisions of the state, go through the relevant formalities before construction according to law, and start construction after conditions are met;
(6) Organizing the implementation of the project;
(seven) after the completion of the project, prepare the completion data and make preparations for the completion acceptance of the project;
(8) Organizing the completion acceptance. Article 11 For port engineering construction projects that store, load and unload dangerous goods, the project unit shall, in addition to the provisions of Articles 9 and 10 of these Provisions, perform safety condition review and safety facility design review procedures and organize safety facility acceptance in accordance with the requirements of the Law on Safety in Production, the Regulations on Safety Management of Dangerous Chemicals and the Provisions on Safety Management of Dangerous Goods in Ports. Twelfth port engineering construction projects need to use the port coastline, the project unit shall go through the formalities for the use of the port coastline in accordance with the provisions on the administration of the use of the port coastline. Without obtaining the approval document for the use of the coastline or the opinions of the Ministry of Transport on the use of the coastline, construction shall not be started. Article 13 The Ministry of Transport shall be responsible for the preliminary design examination and approval of national key waterway engineering construction projects.
The provincial transportation department is responsible for the preliminary design approval of port engineering construction projects approved, approved or filed by the provincial people's government and its investment department.
The local port administrative department is responsible for the preliminary design approval of the remaining port engineering construction projects. Article 14 The project unit shall apply to the transportation department or the local port administrative department with approval authority for preliminary design approval, and provide the following materials:
(1) 1 original application documents;
(2) Preliminary design document and its electronic version 1 copy;
(3) An approved feasibility study report, or an approved project application, or a copy of 1 filing certificate.
