Chapter I General Provisions Article 1 In order to do a good job in flood control and flood fighting, to ensure the safety of people's lives and property and the smooth progress of economic construction, these detailed rules are formulated in accordance with the Regulations on Flood Control in People's Republic of China (PRC) and combined with the actual situation in our province. Article 2 These Regulations shall apply to flood control and flood fighting activities within the territory of this province. Article 3 Flood control work shall follow the principle of "safety first, constant vigilance, prevention first, and all-out rescue", and follow the principle of unity and cooperation and local interests serving the overall situation. Article 4 Flood control work shall be carried out under the responsibility system of the chief executives of the people's governments at all levels, with unified command and responsibility at different levels. All relevant departments should implement the post responsibility system for information prevention. Article 5 All units and individuals have the obligation to participate in flood control and flood fighting. China People's Liberation Army and Armed Police Force are important forces for flood control and fighting. Chapter II Flood Control Organizations Article 6 The provincial flood control headquarters, under the leadership of the national flood control headquarters and the provincial people's government, is responsible for organizing and leading the flood control and flood fighting work in the whole province, and its offices are located in the provincial water administrative department and the provincial Yellow River channel authority respectively. Seventh city (prefecture), county (city) people's government to set up flood control headquarters, composed of relevant departments, the local garrison and the people's Armed Forces Department, with the heads of people's governments at all levels as the command. Under the leadership of the flood control headquarters of the people's government at a higher level and the people's government at the same level, implement the flood control instructions of the higher level, formulate various flood control and flood fighting measures, and uniformly command the flood control and flood fighting work in the region. Its offices are located in the water administrative department of the government at the same level and the competent authority of the Yellow River, and are responsible for handling the daily work of flood control within its jurisdiction. Article 8 River management institutions, water conservancy and hydropower project management units and construction units under construction along the river shall set up flood control institutions to participate in flood control and flood fighting during the flood season under the leadership of the flood control headquarters of the people's government with jurisdiction. Article 9 The flood control office established by the urban construction department shall be responsible for handling the daily flood control work in urban areas under the leadership of the flood control headquarters of the people's government at the same level.

Departments and units with flood control tasks, such as petroleum, electric power, posts and telecommunications, railways, highways, shipping, mining, commerce, materials, etc., shall form temporary flood control organizations in flood season, and be responsible for flood control work in their own industries and units under the unified leadership of the flood control headquarters of the people's government with jurisdiction. Article 10 County and township people's governments shall organize mass standing flood control teams with militia as the backbone, reserve flood control teams for reservoirs and dikes, and mobile flood control teams for rivers with heavy flood control tasks such as the Yellow River. Flood storage and detention areas should organize relocation and rescue teams. Chapter III Preparation for Flood Control Article 11 The people's governments at or above the county level shall formulate flood control work plans (including measures to prevent ordinary floods and floods exceeding the standard) according to the comprehensive planning of river basins, the actual situation of flood control projects and the flood control standards set by the state or the province.

Flood prevention schemes for the main streams of the Yellow River and Huaihe River are reported to the State Council for approval and implementation; Flood control schemes for Hongru River, Shaying River, Weihe River, Producer Canal, Tangbai River, Luo Yi River and Huiji River shall be submitted to the provincial people's government for approval before implementation; Flood control schemes for other rivers shall be implemented after being approved by the people's government with jurisdiction.

The people's government of a city shall, according to the comprehensive river basin planning, urban flood control planning and river flood control scheme, formulate urban flood control schemes, and report them to the people's government at a higher level or its authorized institutions for approval before implementation.

After the flood prevention plan is approved, people's governments at all levels must implement it. Article 12 Enterprises and institutions with the task of flood control and flood fighting shall formulate their own flood control and flood fighting measures according to the flood prevention plan of the region or river course where they are located, and report them to the higher authorities of their own units for approval after being approved by the local flood control headquarters. Article 13 For large-scale reservoirs (including medium-sized reservoirs under large-scale management), key sluices and major flood control rivers, the provincial water administrative department shall organize relevant municipal, land and project management units to formulate flood control plans and flood control guarantee tasks in flood season according to the project planning and design and the actual situation of the project, and on the premise of promoting profits and obeying flood control and ensuring safety, and submit them to the provincial flood control headquarters for approval. The flood season dispatching schemes of Luhun Reservoir, Banqiao Reservoir, Suya Lake, Nanwan Reservoir and Nianyushan Reservoir were reported to the Yellow River Water Conservancy Commission and Huaihe River Water Conservancy Commission for approval respectively. Flood diversion sluice measures along the Yellow River shall be formulated by the local competent department of the Yellow River according to the relevant flood control planning of the Yellow River in this province. Other reservoirs, sluices, hydropower stations and rivers' flood season dispatching plans and flood control guarantee tasks shall be organized by the water administrative departments of cities (prefectures) and counties (cities) respectively and reported to the flood control headquarters at the same level for approval.

After the flood season operation plan is approved, the reservoir, hydropower station, sluice and river management unit shall be responsible for the implementation. Article 14 Flood control headquarters at all levels shall organize inspection of various flood control facilities before flood season, and instruct the responsible units to deal with the problems affecting flood control safety within a time limit, and shall not delay flood control and flood fighting.

All relevant departments and units should report the problems affecting flood control safety and treatment measures to the flood control headquarters with direct jurisdiction, and the flood control headquarters must study and deal with the reported problems and report the results to the flood control headquarters at a higher level for future reference. Fifteenth river cleaning, bridges, approach roads, docks and other river-crossing engineering facilities with serious backwater and water blocking shall be carried out in accordance with the laws and regulations of the state and this province on river management.
