Measures for the administration of inspection and quarantine of entry-exit grain and feed
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Import and Export Commodity Inspection and its implementing regulations, the Law of People's Republic of China (PRC) on Entry and Exit Animal and Plant Quarantine and its implementing regulations, the Law of People's Republic of China (PRC) on Food Hygiene and relevant laws and regulations in order to strengthen the inspection and quarantine administration of entry and exit grain and feed. Article 2 These Measures shall apply to the inspection, quarantine, supervision and administration of grain and feed entering or leaving the country through trade and non-trade means (including re-export). Article 3 The term "grain" as mentioned in these Measures refers to the seeds of cereals (such as wheat, corn, rice, barley, rye, oats and sorghum), beans (such as soybeans, mung beans, peas, red beans, broad beans and chickpeas), potatoes (such as potatoes, cassava and sweet potatoes) and their processed products (such as rice). Feed refers to the by-products of grain and oilseed processing (such as wheat bran, bean cake, soybean meal, etc.). Article 4 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ) is responsible for the inspection, quarantine, supervision and management of entry-exit grain and feed throughout the country, and the entry-exit inspection and quarantine institution established by AQSIQ (hereinafter referred to as inspection and quarantine institution) is responsible for the inspection, quarantine, supervision and management of entry-exit grain and feed within its jurisdiction. Chapter II Quarantine Approval Article 5 The General Administration of Quality Supervision, Inspection and Quarantine shall implement a quarantine approval system for imported grain and feed. The owner or his agent shall go through the examination and approval procedures before signing the trade contract. Article 6 The procedures for going through quarantine examination and approval procedures are as follows:

(1) The consignor or his agent shall fill in the Application Form for Quarantine Permit of Entry Animals and Plants in People's Republic of China (PRC) in advance, apply to the inspection and quarantine institution directly under the port of entry for preliminary examination, and provide relevant materials such as epidemic prevention measures in production and processing sites and transportation and processing links after entry.

(two) directly under the inspection and quarantine institutions to review whether the import quantity is consistent with the processing and production capacity, and whether the transportation, processing and treatment links meet the requirements of animal and plant quarantine and epidemic prevention supervision. If it meets the requirements, the inspection and quarantine institution directly under it shall sign the preliminary examination opinions and report them to the AQSIQ for approval.

(3) Upon examination by the General Administration of Quality Supervision, Inspection and Quarantine, if it meets the examination and approval conditions, it shall issue the Quarantine Permit for Entry Animals and Plants in People's Republic of China (PRC) (hereinafter referred to as the Quarantine Permit); If it does not meet the examination and approval conditions, it will not be issued, and the applicant will be informed of the reasons for not issuing the certificate. Article 7 The consignor or his agent shall indicate in the trade contract the quarantine requirements for imported grain and feed indicated in the quarantine license. Article 8 In any of the following circumstances, the owner or his agent shall reapply for the quarantine license:

(1) Changing the types of imported grain and feed or increasing the weight by more than 10%;

(2) Changing the exporting country or region;

(3) Changing the port of entry;

(four) beyond the validity period of the quarantine license. Chapter III Entry Inspection and Quarantine Article 9 The consignor or his agent shall apply to the inspection and quarantine organ at the entry port for inspection before the grain and feed enter the country, and provide the following documents as required:

(1) Quarantine license;

(2) inspection methods and standards agreed in trade documents (trade contracts, letters of credit, etc.). ) or the cost of submitting samples;

(3) Other relevant documents that need to be provided. Article 10 The General Administration of Quality Supervision, Inspection and Quarantine shall, according to the needs of work, send inspection and quarantine personnel to investigate the epidemic situation in the countries or regions where grain and feed are exported, and carry out pre-inspection and loading supervision before shipment. Article 11 Inspection and quarantine institutions shall conduct inspection and quarantine on imported grain and feed according to the following requirements:

(a) the inspection and quarantine requirements stipulated in the bilateral inspection and quarantine agreement, protocol and memorandum signed by the government of China and the government of the exporting country or region;

(2) Inspection and quarantine requirements stipulated by China laws, administrative regulations and AQSIQ;

(3) Quarantine requirements specified in the quarantine license;

(4) Other inspection and quarantine requirements in the trade contract. Article 12 The grain and feed imported by ships can be discharged at the port only after the inspection and quarantine institutions have passed the inspection and quarantine on the surface of the goods at the anchorage; Special circumstances require inspection and quarantine after berthing, which must be approved by the inspection and quarantine institution.

For the grain and feed unloaded at different ports, the inspection and quarantine institution at the early unloading port will only carry out inspection and quarantine on the goods unloaded in Hong Kong, and inform the inspection and quarantine institution at the location of the next unloading port in writing in time. Where a unified exit permit is required, the inspection and quarantine organ at the port of discharge shall collect and issue certificates. Article 13 Grain and feed imported by other means such as containers can only be transported, sold and used after passing inspection and quarantine. Article 14 Inspection and quarantine institutions shall supervise and manage the transit of the original means of transport and the original packaged grain and feed.

Changes in the means of transport and packaging of transit grain and feed shall be handled in accordance with the requirements of entry inspection and quarantine.

If it belongs to the international container transportation transit of Eurasia Continental Bridge, it shall be handled in accordance with the Trial Measures for the Management of Transit Transportation of Eurasia Continental Bridge. Article 15 For imported grain and feed that have passed the inspection and quarantine, the inspection and quarantine institution shall issue the inspection and quarantine certificate of imported goods and allow them to enter the country for sale or use.
