General rule

The China Federation of Industry and Commerce (hereinafter referred to as the Federation of Industry and Commerce) is a people's organization and chamber of commerce led by the * * * production party of China, which is oriented to the industrial and commercial circles, with non-public enterprises and non-public economic persons as the main body. It is a bridge between the party and the government to contact people in the non-public economy, and an assistant for the government to manage and serve the non-public economy. The work of the Federation of Industry and Commerce is an important part of the party's United front work and economic work. The cause of Federation of Industry and Commerce is an important part of Socialism with Chinese characteristics's cause.

The Federation of Industry and Commerce takes the Constitution of People's Republic of China (PRC) as the fundamental criterion and carries out its work in accordance with the articles of association.

Holding high the great banner of Socialism with Chinese characteristics, guided by Deng Xiaoping Theory, Theory of Three Represents and Scientific Outlook on Development, the Federation of Industry and Commerce adheres to the leadership of the Party, adheres to the basic economic system with public ownership as the main body and multiple ownership economies developing together, serves the overall situation of the party and the state around the economic construction center, continues to emancipate the mind, persists in reform and opening up, promotes scientific development and promotes social harmony.

The Federation of Industry and Commerce has the basic characteristics of United front, economy and folk, and takes the healthy development of non-public economy and the healthy growth of non-public economic people as its working theme. Give full play to the guiding role in the ideological and political work of non-public economy, play an important role in the participation of non-public economy in national political life and social affairs, play an auxiliary role in government management and service of non-public economy, promote the reform and development of trade associations and chambers of commerce, and play a synergistic role in building harmonious labor relations and strengthening and innovating social management.

The Federation of Industry and Commerce aims to build people's organizations and chambers of commerce with firm politics, distinctive features, sound mechanism, efficient service and excellent work style, and comprehensively strengthens ideological construction, organizational construction, work style construction, anti-corruption construction and system construction, and constantly enhances cohesion, influence and execution; Adhere to the policy of unity, service, guidance and education, guide people in the non-public sector of the economy to firmly support the leadership of the Production Party of China, unswervingly follow the Socialism with Chinese characteristics road, and actively participate in socialist economic construction, political construction, cultural construction, social construction and ecological civilization construction, so as to build China into a prosperous, strong, democratic, civilized and harmonious socialist modern country and strive for the complete reunification of the motherland and the great rejuvenation of the Chinese nation.

Chapter I Functions and Tasks

Article 1 Strengthen and improve the ideological and political work of non-public economic people.

(a) to guide non-public economic people to practice the socialist core value system, establish Socialism with Chinese characteristics's ideal, establish the concept of giving consideration to righteousness and interests, putting righteousness first, study and implement the principles and policies of the party and the state, carry forward the fine tradition of self-education, consciously combine the development of their own enterprises with the development of the country, combine personal prosperity with the prosperity of all the people, and combine following market rules with promoting socialist morality and patriotism. Publicize and commend the advanced models among them.

(2) Guide non-public economic people to carry forward Chinese traditional virtues, carry forward the new fashion of the times, be rich and think about the source, be rich and think about progress, actively undertake social responsibilities, devote themselves to public welfare undertakings, strengthen corporate culture construction, support corporate party building, and provide necessary conditions for grassroots party organizations to carry out activities and play their roles.

Article 2 Participate in political consultation, play the role of democratic supervision, and actively participate in the discussion of state affairs.

(a) close contact with non-public economic people, in-depth understanding of their wishes and demands, and put forward relevant opinions and suggestions to the party and the government.

(two) around the implementation of the party's line, principles and policies, participate in the formulation and implementation of relevant state policies and regulations, and promote the improvement of the market environment, policy environment, legal environment and social environment of the non-public economy.

(three) to help representatives of the non-public economy improve their ability and level of participating in and discussing state affairs, actively reflect social conditions and public opinion, and participate in political life and social affairs in an orderly manner.

(four) do a good job in the discovery, training, recommendation and management of representatives of the non-public economy.

Article 3 Assist the government in managing and serving the non-public economy.

(1) Actively explore the establishment of service carriers and mechanisms that meet the requirements of the socialist market economy, provide services in policy, information, law, financing, technology and talents for non-public enterprises according to the requirements of Scientific Outlook on Development, guide non-public enterprises to accelerate the transformation of economic development mode and industrial optimization and upgrading, promote structural adjustment and independent innovation, and continuously enhance market competitiveness, risk resistance and sustainable development capabilities.

(two) to strengthen ties with the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province, and promote economic and trade cooperation. Actively carry out non-governmental diplomacy, strengthen exchanges and cooperation with foreign industrial and commercial circles, and provide services for international cooperation of non-public enterprises.

(three) to undertake matters entrusted by the government and relevant departments. Organize non-public enterprises to participate in the implementation of the national regional development strategy, serve the local economic construction, and promote the coordinated development of urban and rural areas and regions.

Article 4 Promote the reform and development of trade associations and chambers of commerce.

(a) to perform the duties of the competent business unit of social organizations, guide and promote the Chamber of Commerce to formulate the articles of association of the Chamber of Commerce in accordance with laws, regulations and articles of association, improve the corporate governance structure, standardize internal management, play the role of publicizing policies, providing services, reflecting demands, safeguarding rights and interests, and strengthening self-discipline, and cultivate and develop the Chamber of Commerce with China characteristics.

(two) to participate in the formulation of policies and laws of trade associations and chambers of commerce. Guide the chamber of commerce to reflect the development trend of the industry and promote the healthy development of the industry.

Article 5 Participate in coordinating labor relations, coordinate social management and promote social harmony and stability.

(a) to participate in the tripartite meeting to coordinate labor relations, in conjunction with government departments, trade unions and other representatives of relevant enterprises, * * * to promote labor relations legislation, improve the labor standard system and labor relations coordination mechanism, * * * to study and solve major problems in labor relations, and to participate in labor dispute mediation and arbitration.

(two) to guide the non-public enterprises to negotiate with the trade unions on an equal footing on issues involving the vital interests of employees, such as wages, welfare and social insurance, and sign collective contracts.

(3) Coordinate the relationship between the interests of investors and the rights and interests of workers, guide non-public enterprises to build harmonious labor relations, actively create jobs, strictly abide by relevant state laws, regulations, policies and measures, respect and safeguard the legitimate rights and interests of employees, assist in guiding the party building work of non-public enterprises, promote the establishment of trade unions and other group organizations, and actively carry out activities.

Article 6 Reflect the interests of non-public enterprises and non-public economic persons and safeguard their legitimate rights and interests. Participate in mediation and arbitration of economic disputes.

Seventh to strengthen the management and protection of social production according to law.

Chapter II Members

Article 8 All enterprises, organizations and individuals who recognize the Articles of Association, voluntarily join the Federation of Industry and Commerce and promise to fulfill their membership obligations may apply for membership.

(a) after the application for membership of various enterprises is approved, it is an enterprise member.

The main members of the enterprise are non-public enterprises, mainly including private enterprises, limited liability companies and joint-stock companies controlled by non-public economic sectors, Hong Kong and Macao investment enterprises, etc.

(2) Trade associations, trade chambers of commerce, foreign chambers of commerce, private enterprise associations, self-employed workers' associations and other relevant social organizations with legal person qualifications shall become group members after their application for membership is approved;

The chamber of commerce under the Federation of Industry and Commerce is a group member.

(three) the main investors and operators of non-public enterprises and individual industrial and commercial households. After the membership application is approved, it is an individual member;

People related to the work of the Federation of Industry and Commerce and Hong Kong and Macao businessmen investing in the Mainland can apply for individual membership;

After consultation, representatives of units that have established working contacts with the Federation of Industry and Commerce may be invited to join in their personal capacity;

In the past, businessmen were all individual members.

Article 9 The principle of voluntary membership and free withdrawal shall be implemented.

The federations of industry and commerce at all levels may, according to the articles of association and the actual situation, formulate specific membership conditions and procedures for joining or withdrawing, and report them to the federation of industry and commerce at the next higher level for the record.

Article 10 If a member violates the articles of association or criminal law, his membership shall be suspended or cancelled.

Article 11 Members of local federations of industry and commerce at all levels are also members of superior federations of industry and commerce.

Article 12 Members shall enjoy the following rights:

The right to vote, to be elected and to vote;

(two) to reflect opinions, requirements and suggestions to the Federation of Industry and Commerce;

(three) to participate in the visit, study and training activities organized by the Federation of Industry and Commerce;

(4) Accepting the services provided by the Federation of Industry and Commerce;

(five) require the Federation of Industry and Commerce to safeguard their legitimate rights and interests;

(six) to supervise the work of the Federation of Industry and Commerce.

Thirteenth members have the following obligations:

(1) Abide by the articles of association;

(2) Implementing organizational resolutions;

(3) Paying membership fees according to regulations;

(4) Caring for and supporting the work of the Federation of Industry and Commerce;

(five) accept the supervision of the organization;

(six) to handle matters entrusted by the organization.

Chapter III Weaving

Article 14 The Federation of Industry and Commerce shall establish national organizations and local organizations according to the administrative divisions of the country: The All-China Federation of Industry and Commerce is a national organization, referred to as the National Federation of Industry and Commerce for short; The Federation of Industry and Commerce of provinces, autonomous regions and municipalities directly under the Central Government and the Federation of Industry and Commerce of Xinjiang Production and Construction Corps, and the Federation of Industry and Commerce of cities (autonomous regions, autonomous prefectures, leagues and municipalities directly under the Central Government) are local organizations. County (city, banner, district of provincial city) Federation of Industry and Commerce is not only a local organization, but also a grassroots organization. The chamber of commerce under the Federation of Industry and Commerce is a grass-roots organization.

Article 15 The Federation of Industry and Commerce may establish trade chambers (trade associations), township chambers of commerce, street chambers of commerce, park chambers of commerce, foreign chambers of commerce and other chambers of commerce, and take them as the competent business units.

Article 16 The organizing principle of the Federation of Industry and Commerce is democratic centralism. The higher level Federation of Industry and Commerce has a guiding relationship with the lower level Federation of Industry and Commerce.

Article 17 The highest authority of the Federation of Industry and Commerce is the member congress. Its functions and powers are:

(1) Hearing and deliberating the report of the Executive Committee;

(2) Electing the Executive Committee;

(three) to discuss and decide on important matters of the Federation of Industry and Commerce.

The National Congress of China Federation of Industry and Commerce is responsible for amending the articles of association.

Eighteenth Congress of the Federation of Industry and Commerce (General Assembly), held every five years. If necessary, the meeting can be held in advance or postponed.

Members' Congress shall be convened by the Executive Committee. During the congress, the elected presidium shall preside over the meeting.

Nineteenth representatives of the Federation of Industry and Commerce Congress shall be elected through consultation, and some representatives may be invited to participate if necessary.

The number of deputies to the Congress and the allocation method shall be decided by the executive committee or the authorized standing committee.

Article 20 The Executive Committee of the Federation of Industry and Commerce is the highest leading body of the Federation of Industry and Commerce when the members' congress is not in session, and its functions and powers are:

(a) to implement the resolutions of the members' congress or the members' congress;

(two) to hear and consider the report of the Standing Committee;

(3) To discuss and decide on tasks;

(4) Electing the chairman, vice-chairmen and standing committee members.

The term of office of the Executive Committee is five years, and a plenary meeting is held every year.

The allocation and selection of members of the next Executive Committee shall be decided by the last Executive Committee or the authorized Standing Committee.

Article 2 1 Responsibilities and obligations of members of the Executive Committee:

(a) adhere to the correct political direction and conscientiously implement the party's line, principles and policies;

(two) to play the role of participating in the discussion of state affairs and put forward suggestions on important issues in economic and social development;

(three) love the work of the Federation of Industry and Commerce, to participate in the organization's meeting activities;

(4) Implementing the resolutions of the Federation of Industry and Commerce;

(five) extensive contact with members, reflect the opinions and demands of members;

(six) to put forward opinions and suggestions on the work of the Federation of Industry and Commerce.

Article 22 The Standing Committee is composed of the Chairman, the Vice-Chairmen, the Secretary-General and members of the Standing Committee. Each term of office is the same as that of the Executive Committee, and the functions and powers of the Executive Committee are exercised when the Executive Committee is not in session:

(1) Implementing the resolutions of the Executive Committee;

(2) discussing research tasks;

(3) Be responsible and report to the Executive Committee.

The meeting of the Standing Committee is held twice a year.

The allocation and appointment of the number of members of the next Standing Committee shall be decided by the previous Standing Committee or the authorized Standing Committee.

The county-level Federation of Industry and Commerce decides whether to set up a standing committee according to the situation.

Article 23 The chairman shall preside over the meeting and the vice chairman shall assist the chairman in his work. The chairman and vice-chairman form a chairman's meeting to study and decide on major issues.

The vice-chairmen are divided into full-time vice-chairmen and part-time vice-chairmen. In principle, full-time vice-chairmen shall not be re-elected for more than two terms. In principle, the part-time vice-chairman of the All-China Federation of Industry and Commerce does not serve continuously, and the part-time vice-chairman of the local Federation of Industry and Commerce does not serve for more than two consecutive terms.

The National Federation of Industry and Commerce and the Provincial Federation of Industry and Commerce shall have executive vice-chairmen elected by the executive committees at the same level.

The secretary-general of the local Federation of Industry and Commerce is elected by the executive committee at the same level and is a member of the chairman's meeting.

The leading bodies and leaders produced by each Executive Committee will continue to preside over the regular work during the next Congress (general meeting) until the next Executive Committee produces new leading bodies and leaders.

Twenty-fourth meetings of the Standing Committee and directors can be held by means of communication under special circumstances.

Article 25 An executive committee member who fails to attend the meeting of the executive committee for three times without approval shall be dismissed from his post; If a member of the Standing Committee fails to attend the meeting of the Standing Committee for three times, he shall be removed from his post as a member of the Standing Committee.

Article 26 The composition of the Executive Committee and the Standing Committee of the Federation of Industry and Commerce may be adjusted during the session, and the adjusted personnel shall be approved by the Executive Committee or the Standing Committee and reported to the Executive Committee for confirmation.

When the local Federation of Industry and Commerce changes, it shall report the preparations to the Federation of Industry and Commerce at the next higher level, and the election results shall be reported to the Federation of Industry and Commerce at the next higher level for the record.

Article 27 The Federation of Industry and Commerce shall set up working departments and special committees according to the needs of work.

Article 28 The establishment or merger of local federations of industry and commerce shall be reported to the Party committee at the same level for approval, and reported to the federation of industry and commerce at the next higher level for the record.

Article 29 The All-China Federation of Industry and Commerce is also called the China Folk Chamber of Commerce, and the local federation of industry and commerce is a local chamber of commerce.

The president is also the chairman of the Federation of Industry and Commerce. In principle, the vice-chairman shall be the full-time vice-chairman of the Federation of Industry and Commerce and the representative of the non-public economy. The chairman and vice-chairman are elected by the executive Committee of the Federation of Industry and Commerce.

In principle, the non-public economic representatives among the vice-presidents of China private chambers of commerce do not serve continuously, and the non-public economic representatives among the vice-presidents of local chambers of commerce do not serve for more than two consecutive terms.

Chapter IV Staff

Thirtieth organs of the Federation of Industry and Commerce shall, in accordance with the provisions of the Civil Service Law of People's Republic of China (PRC), strengthen the training, assessment, encouragement and supervision of staff, and build a civil servant team with strong politics, precise business and correct style.

Thirty-first Federation of Industry and Commerce staff should do:

(1) Hold high the great banner of Socialism with Chinese characteristics, earnestly study Marxism–Leninism, Mao Zedong Thought, Deng Xiaoping Theory, Theory of Three Represents and Scientific Outlook on Development, study the Party's theory, line, principles and policies, learn modern market economy, modern science and technology, modern management and legal knowledge, and have the theoretical, policy and professional level required to perform their duties;

(2) Establish Socialism with Chinese characteristics's ideals and beliefs, have a strong sense of professionalism and responsibility, love the cause of the Federation of Industry and Commerce, emancipate the mind, be brave in innovation, be loyal to their duties, work hard, and have strong political grasping ability, investigation and research ability, mass work ability and implementation promotion ability;

(3) Insist on seeking truth and being pragmatic, go deep into the grassroots, conduct investigation and study, establish a good style of work, keep close contact with members and non-public economic people, and enhance service awareness;

(four) be strict with yourself, diligent and honest, take the overall situation into account, observe discipline, and consciously accept the supervision of organizations and members.

Chapter V Emblem

Article 32 The emblem of the Federation of Industry and Commerce is a pattern composed of bridges and ties.

The emblem of the Federation of Industry and Commerce can be worn as a badge; It can be hung in offices, activity places and meeting places organized by the Federation of Industry and Commerce; Can be used as a sign on souvenirs and office supplies; It shall not be used for commercial purposes without authorization.

Chapter VI Supplementary Provisions

Article 33 These Articles of Association are the unified articles of association of industrial and commercial associations at all levels (China non-governmental chambers of commerce and local chambers of commerce), which were adopted by the National Congress of China Federation of Industry and Commerce.

Article 34 The right to interpret these Articles of Association belongs to the All-China Federation of Industry and Commerce.
