Article 1 In order to ensure citizens to exercise their rights of assembly, procession and demonstration according to law, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Assembly, Parade and Demonstration and the Measures of Sichuan Province for Implementing the Law of People's Republic of China (PRC) on Assembly, Parade and Demonstration, combined with the actual situation in Chengdu. Article 2 These Measures shall be observed in holding assemblies, processions and demonstrations within the administrative area of Chengdu. Article 3 The competent authorities of assembly, procession and demonstration are the district (city) and county public security organs where the assembly, procession and demonstration are located; Where the route of procession and demonstration passes through more than two districts (cities) and counties, the competent authority shall be the Municipal Public Security Bureau. Article 4 Whoever holds an assembly, a procession or a demonstration shall apply to the competent authority and obtain permission in accordance with these Measures. According to the second paragraph of Article 7 of the Law of People's Republic of China (PRC) Municipality on Assemblies, Processions and Demonstrations, there is no need to apply. Article 5 When holding an assembly, a procession or a demonstration, the person in charge shall be determined, and an application shall be submitted to the competent authority with a resident identity card or other valid identity documents five days ago, and an application registration form shall be filled in.

The application shall be signed by the person in charge, and shall specify the following items:

(a) the purpose, mode, slogan, slogan, number of people, number of vehicles, type and quantity of audio equipment of the assembly, procession and demonstration;

(two) the starting and ending time, route and place of the assembly and dissolution;

(three) the name, occupation, address and contact information of the person in charge.

If the person in charge is replaced, a new application shall be made in accordance with the provisions of the preceding paragraph. If an application is made by letter, e-mail, telephone or other means, the competent authority will not accept it. Article 6 After receiving an application for an assembly, a procession or a demonstration, the competent authority shall make a written decision on approval or disapproval two days before the application is held. If the license is not granted, the reasons shall be explained; If no decision is made within the time limit, it shall be deemed as permission.

The person in charge of an application for an assembly, a procession or a demonstration shall go to the competent authority to receive a notice of decision two days before the application is held. If the competent authority fails to receive or refuse to sign for it within the time limit, it shall be deemed to have withdrawn the application. Article 7 Where an application for holding an assembly, a procession or a demonstration needs to solve specific problems, the competent authority may, after receiving the application, notify the relevant authorities or units to negotiate with the person in charge of applying for holding the assembly, procession or demonstration to solve the problems, and may postpone the application for holding the assembly, procession or demonstration for five days.

After receiving the notice from the competent authority, the relevant organ or unit shall immediately negotiate with the person in charge of the application for assembly, procession and demonstration to solve the relevant problems, and inform the competent authority of the negotiation results within the statutory time limit. Article 8 An application for holding an assembly, a procession or a demonstration shall not be approved under any of the following circumstances:

(a) Violating the basic principles stipulated in the Constitution;

(2) endangering national unity, sovereignty and territorial integrity;

(3) sabotaging national unity and inciting national division;

(four) there are sufficient reasons to believe that the assembly, procession and demonstration applied for will directly endanger public security or seriously undermine social order. Article 9 If the person in charge of an assembly, a procession or a demonstration refuses to accept the decision of the competent authority not to grant permission, he may, within three days from the date of receiving the notice of the decision, apply to the people's government at the same level of the competent authority for reconsideration.

The people's government shall make a written decision within three days from the date of receiving the application for reconsideration. If a written decision is not made within the time limit, it shall be deemed that the decision of the competent authority has been revoked and the assembly, procession and demonstration are allowed. The applicant for reconsideration shall receive the reconsideration decision of the people's government within the statutory time limit. If the reconsideration organ fails to receive or refuse to sign the notice of reconsideration decision within the time limit, the application shall be deemed to be withdrawn.

The person in charge of the assembly, procession and demonstration approved by the people's government for reconsideration shall go through the relevant formalities with the competent authority with the notice of reconsideration decision.

The reconsideration decision of the people's government is final. Article 10 (1) Where an assembly, a procession or a demonstration passes through the location of a state organ, a military organ, a radio station, a television station or a foreign consulate in this Municipality, the competent authority may, in order to maintain order, set up a temporary cordon around the location of the above-mentioned unit, or set up warning signs on the ground, and may also set up obstacles when necessary. No one is allowed to cross without the permission of the police on duty. Article 11 The specific scope of the areas where assemblies, processions and demonstrations are prohibited shall be determined by the Municipal People's Government in accordance with the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations and the Measures of Sichuan Province for Implementing the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations. Article 12 An authorized assembly, procession and demonstration shall be conducted in accordance with the authorized purpose, manner, time, place, route and other matters, and the following acts are prohibited:

(1) Use or incite violence;

(2) Carrying weapons, controlled knives and inflammable and explosive dangerous goods;

(3) scribbling, portraying, posting slogans or distributing propaganda materials that are inconsistent with the permitted use along the way;

(four) the use of banners and placards inconsistent with the purpose of assembly, procession and demonstration;

(5) publishing or shouting remarks or slogans inconsistent with the purpose of an assembly, a procession or a demonstration;

(6) spreading rumors to mislead people or slandering or insulting others;

(seven) disturbing social order, production order, work order, teaching and scientific research order and people's life order;

(eight) interception, damage to vehicles, traffic jams;

(nine) the use of audio equipment with a volume exceeding the national standard;

(ten) occupation, damage to public facilities, garden green space;

(eleven) the impact of city appearance and environmental sanitation;

(twelve) hinder or resist the people's police to perform official duties according to law;

(thirteen) engage in other illegal and criminal activities or incite others to commit crimes.
