The flood control, drought relief and wind prevention activities mentioned in these Regulations refer to the prevention, emergency rescue, post-disaster emergency disposal and related management activities of disasters caused by factors such as rainstorm, flood, drought and typhoon. Article 3 Flood control, drought relief and wind prevention activities shall adhere to the principles of people-oriented, prevention first, combination of prevention and rescue, government-led, unified leadership, public participation and subordination of local interests to overall interests. Article 4 Flood control, drought relief and wind prevention work shall be carried out under the responsibility system of the chief executives of the people's governments at all levels, with territorial management as the mainstay, unified command and responsibility at different levels.
People's governments at or above the county level shall incorporate flood control, drought relief and wind prevention into the national economic and social development plan at the corresponding level, establish and improve the working mechanism of flood control, drought relief and wind prevention, improve the information level of flood control, drought relief and wind prevention command, and incorporate the funds needed for flood control, drought relief and wind prevention into the financial budget at the corresponding level.
The people's government at the county level and its relevant departments, the people's government at the township level, and the sub-district offices are responsible for the specific work such as flood control, drought relief and wind prevention knowledge propaganda and skills popularization, plan formulation, emergency drills, danger investigation and handling, disaster and danger reporting, and organization of personnel transfer within their respective jurisdictions or industries.
Emergency management, water conservancy, development and reform, education, industry and information technology, public security, civil affairs, finance, natural resources, ecological environment, urban and rural housing construction, transportation, agriculture and rural areas, cultural tourism, health, meteorology, radio and television, maritime affairs, electric power, communications and other departments and units. Should be in accordance with their respective responsibilities, do a good job in flood control, drought relief and wind prevention. Article 5 The people's governments at or above the county level shall set up a flood control, drought relief and wind prevention headquarters, which shall be composed of the heads of relevant departments and units, the local garrison and the People's Armed Forces Department. Under the leadership of the flood control, drought relief and wind prevention headquarters at a higher level and the people's government at the same level, they shall uniformly command the flood control, drought relief and wind prevention work in their respective administrative areas. The chief commander of the flood control, drought relief and wind prevention headquarters shall be the person in charge of the people's government at the corresponding level, and the member units of the flood control, drought relief and wind prevention headquarters shall be determined by the people's government at the corresponding level.
Other emergency command institutions established by the people's governments at all levels shall obey the command of the flood control, drought relief and wind prevention command institutions of the people's governments at the same level when responding to rainstorms, floods, droughts and typhoons according to law.
The daily work of the flood control, drought relief and wind prevention headquarters shall be undertaken by the emergency management department at the same level, and shall be responsible for the organization, coordination, supervision and guidance of flood control, drought relief and wind prevention within their respective administrative areas.
Township people's governments and sub-district offices shall clearly undertake flood control, drought relief and wind prevention work, and guide the villagers' committees and residents' committees in flood control, drought relief and wind prevention work. Article 6 Villagers' committees and residents' committees shall, according to the actual situation and under the guidance of the local people's government, formulate emergency plans for disaster prevention and avoidance, carry out propaganda and emergency drills on flood control, drought relief and wind prevention, transmit information such as forecasting and early warning, transfer and avoidance, collect and report disaster situations, organize villagers and residents to carry out self-help and mutual assistance, and help maintain social order. Seventh citizens, legal persons and other organizations shall cooperate with flood control, drought relief and wind prevention activities and obey the emergency command.
Newspapers, radio, television, Internet and other news media and communication operating units shall promptly send flood control, drought and wind warning information and defense guidelines to the public, carry out public welfare publicity on flood control and drought emergency, self-help and mutual rescue, and enhance public awareness of disaster prevention and avoidance.
Organs, organizations, schools, enterprises, institutions and other units and organizations should take various forms to carry out safety knowledge education activities on flood control, drought prevention and wind protection, and conduct drills in a timely manner to improve the public's scientific disaster prevention and avoidance and self-help and mutual rescue capabilities. Chapter II Defense Preparation Article 8 The flood season in this province is generally from the middle of April to the middle of 10 every year.
The flood control, drought relief and windproof headquarters of the provincial people's government determines and announces the start and end dates of the flood season in the province every year according to the rain and water conditions and the actual flood control work. The flood control, drought relief and wind prevention headquarters of the people's government at the prefecture level or above the city level may, according to the local actual situation, determine and announce that the administrative region will enter the flood season ahead of schedule or postpone the end of the flood season. Article 9 The water administrative department of the people's government at or above the county level shall, within the prescribed limits of authority, organize the preparation of flood and drought disaster prevention and control plans, solicit the opinions of relevant departments at the same level, report them to the water administrative department of the people's government at the next higher level for the record after being approved by the people's government at the same level.
Flood disaster prevention and control planning should include flood control engineering and non-engineering measures construction, flood control management and so on. Flood prevention and control planning in coastal areas should also include the prevention of typhoon storm surge.
Drought disaster prevention and control planning should include drought relief organizations, emergency water sources, emergency facilities, drought monitoring network construction, drought relief material reserves, safeguard measures, etc.
Natural resources, transportation, housing and urban and rural construction, agriculture and rural areas, electric power and other departments responsible for flood control, drought relief and wind prevention shall incorporate flood control, drought relief and wind prevention projects and non-engineering measures into the planning content when preparing relevant plans.
