Maternity leave will be provided for 98 days in 2022. Generally, from half a month before delivery to two and a half months after delivery, female employees enjoy no less than ninety-eight days of maternity leave. During maternity leave or caregiver leave for a female employee, the employer shall pay holiday pay at a rate that is not lower than the employee's standard salary. During the period of maternity leave for working women, the employer shall not reduce their wages, dismiss them or terminate their labor contracts in other ways.
Legal basis: Article 7 of the "Special Provisions on Labor Protection of Female Employees"
Female employees are entitled to 98 days of maternity leave when they give birth, including 15 days of pre-natal leave. If it is difficult to give birth, the maternity leave should be increased by 15 days; if there are multiple babies, the maternity leave can be increased by 15 days for each additional baby.
Female employees who have a miscarriage before the 4th month of pregnancy are entitled to 15 days of maternity leave. If you have a miscarriage after 4 months of pregnancy, you will enjoy 42 days of maternity leave.
Article 8
The maternity allowance for female employees during their maternity leave, for those who have participated in maternity insurance, will be paid by the maternity insurance fund based on the employer’s average monthly salary of employees in the previous year. Payment; for those who do not participate in maternity insurance, the employer will pay according to the standard of female employees’ pre-maternity leave wages.
The medical expenses for childbirth or miscarriage of female employees shall be paid by the maternity insurance fund in accordance with the items and standards stipulated in maternity insurance. For those who have participated in maternity insurance, they shall be paid by the maternity insurance fund; for those who have not participated in maternity insurance, they shall be paid by the employer.
What information is required to apply for maternity leave?
1. Employees must provide valid ID card information and maternity information until the unit’s human resources department receives the maternity leave application form;
2 , fill it out as required, and submit it to the supervisor, manager, etc. for signature;
3. Submit the maternity leave application and related birth information to the personnel department for verification and filing.
