Chapter I General Principles

Article 1 In order to standardize the transaction behavior of bidding (procurement) agencies, maintain the order of the agency market, improve the quality of agency services, promote the construction of the credit system, and improve the punishment mechanism for dishonesty, according to the Bidding Law of People's Republic of China (PRC), the Procurement Law of People's Republic of China (PRC), the Implementation Regulations of the Bidding Law of People's Republic of China (PRC) and the Procurement Law of People's Republic of China (PRC).

Article 2 These Measures shall apply to bidding (procurement) agencies (hereinafter referred to as "agencies") that enter the trading platform of Jilin Public Resources Trading Center (hereinafter referred to as "provincial trading platform") to carry out trading activities.

The term "agency" as mentioned in these Measures refers to a social intermediary organization established according to law, engaged in bidding (procurement) agency business and providing related services.

Article 3 Provincial trading platforms provide operational service guarantee for public resource trading projects that must enter the market to carry out trading activities.

Public * * * resources trading projects that must enter the market are listed on the provincial trading platform according to the Jilin Provincial Public * * * Resources Trading Catalogue issued by the Jilin Provincial People's Government.

Article 4 Jilin Provincial Public Resource Trading Center (Jilin Provincial Government Procurement Center) (hereinafter referred to as the Provincial Trading Center) is responsible for the operation and management of provincial trading platforms.

The provincial trading center provides services such as releasing information, arranging the sale of tender seats, opening the bid evaluation site and extracting experts for public * * * resource trading projects that must enter the market.

Article 5 An agency shall conduct agency business according to laws and regulations, conduct trading activities according to the relevant procedures of the provincial trading center, and consciously abide by the rules and regulations of the provincial trading center.

Article 6 When an agency enters the provincial trading center to carry out agency business, it shall implement the employee registration system and consciously accept the management mode of credit evaluation. The administrative supervision and management departments and other relevant departments shall perform their duties of supervision and management of intermediary institutions according to law.

Chapter II Notes

Article 7 Any institution that complies with relevant laws and regulations and has a valid renewal can register itself on the website of the provincial trading center.

Article 8 The registration of an agency shall meet the following conditions:

(1) Having the ability to bear civil liability independently;

(2) Having a good business reputation and a sound financial accounting system;

(3) Having the necessary equipment and professional technical ability to perform the contract;

(4) Having a good record of paying taxes and social security funds according to law;

(5) It has no major illegal records in its business activities within three years;

(six) to obtain the qualification or qualification to carry out the corresponding agency business according to law;

(seven) is not included in the list of people who have been executed for breach of trust, parties to major tax violations, and serious violations of government procurement records;

(eight) commitment to abide by the rules and regulations and management regulations of the provincial trading center.

Article 9 The conditions for the registration of employees of intermediary institutions are as follows:

It should be a formal employee who signs a labor contract with the agency and the agency pays social insurance premiums according to law.

Article 10 An agency shall timely enter and update the registered information and materials, and be responsible for the authenticity, accuracy, completeness and validity of the information and materials. The unified social credit code is the only symbol for the registration of institutions, and relevant information will be publicized on provincial trading platforms, subject to social supervision (except those involving state secrets and commercial secrets).

Article 11 If the registered information (including employees) of an agency changes, it shall be handled in time within 10 working days from the date of information change.

Article 12 An agency shall have the necessary personnel to carry out agency business and a sound internal supervision and management system.

Chapter III Code of Conduct for Entry Trading

Thirteenth employees sent to the provincial trading platform to engage in trading activities shall meet the following conditions:

(a) registered in the website of the provincial trading center and signed a labor contract with an intermediary agency, which pays social insurance premiums according to law;

(two) familiar with the policies and regulations formulated by the competent department of public resources trading industry in Jilin Province;

(three) familiar with the working procedures and business processes of the provincial trading center, and able to operate the trading system skillfully;

(four) other conditions that should be met in public resources trading activities.

Fourteenth intermediaries in the provincial trading platform to carry out public resources trading activities should comply with the following norms:

(1) Performing agency duties according to law within the scope of entrusted agency;

(two) to organize the staff of this unit to learn the relevant rules and regulations of public resources trading in Jilin Province and the operation manual of the system platform;

(three) to participate in the study and training, work meetings, inspection and other activities organized by the provincial trading center;

(4) Consciously safeguard the authenticity and integrity of the transaction data, and shall not delete or tamper with the valid data generated by the trading system without authorization, and shall properly keep the relevant record materials of each transaction activity of specific bidding (procurement) projects, and shall not forge, alter, conceal or destroy them;

(five) abide by the provincial trading platform management system. Randomly select experts from the bid evaluation expert database designated by the Jilin Provincial Public Resources Transaction Management Committee (hereinafter referred to as the provincial comprehensive bid evaluation expert database), except as otherwise provided by relevant state laws and regulations or industry management departments;

(6) Abide by professional ethics and consciously safeguard the legitimate rights and interests of the tenderee and bidders;

(seven) to ensure that the information provided is true, accurate, comprehensive and effective;

(eight) found illegal behavior or abnormal situation should retain evidence, timely report, truthfully reflect, and actively cooperate with the investigation;

(nine) abide by social ethics and consciously safeguard the safety and order of public places;

(ten) before the start of trading activities, inform the staff of the bidding (procurement) unit about the trading operation procedures and the trading discipline that should be observed;

(eleven) to perform other obligations stipulated by laws and regulations related to the transaction of public resources.

Article 15 When an agency implements a specific transaction, it shall first sign an agency agreement with the bidding (procurement) unit, specify the agency scope, transaction mode, entrusted matters and handling period, and stipulate the rights and obligations of both parties, and shall not exceed the agency authority.

The agency puts forward the service demand through the trading system (telephone reservation and entrustment are not accepted), and the service demand of a special project or the personalized service demand of a project formally applies to the provincial trading center in written form.

Article 16 Operation flow of agent entry transaction.

(1) project registration

(2) Venue reservation

1. The opening and evaluation time of all trading items, as well as the reservation, change and cancellation of the venue, are completed through the trading system;

2. If the bid evaluation content includes sample display or needs on-site demonstration and explanation by bidders (suppliers), the corresponding options should be checked and described in words when booking the bid evaluation site. If there are special properties such as sample specifications, weight and materials, or complicated demonstrations and explanations, or it is necessary to bring prohibited items into the bid evaluation area, a written demand application should be submitted to the provincial trading center before booking the bid evaluation site. The provincial trading center shall give a reply within 3 working days after receiving the above application;

3. If the site cannot be opened and evaluated on time after the site reservation is successful, an application for canceling the site shall be submitted in time and the reasons shall be explained;

4. If the time of bid opening and bid evaluation is changed, an application for changing the site shall be submitted in time and the reasons shall be explained.

(three) to submit an application for the formation of a bid evaluation expert committee.

The agency shall, in the trading system, submit an application for the establishment of a bid evaluation expert committee in accordance with the requirements of "Jilin Province Public Resource Trading Center Bid Evaluation Expert Extraction System", and the types and number of experts shall comply with laws and regulations and the provisions of relevant administrative supervision and management departments.

(four) issued a tender (procurement) announcement.

1. The agency issues a tender (procurement) announcement through the trading system;

2. The content and format of the tender (procurement) announcement shall meet the requirements of relevant laws and regulations;

3. The release application shall be submitted at least 1 working days before the release date stipulated in the tender (procurement) announcement, and the provincial trading center shall give a reply within 1 working days after receiving the application;

4. Timely check the release of tender (procurement) announcement. Unpublished, it should be revised and resubmitted in time according to the feedback.

(5) Apply for a bid seat.

The agency shall go to the provincial trading center for bidding admission and sale registration 1 working days before the start date of bidding sale stipulated in the bidding (procurement) announcement.

(6) Enter the basic information of the personnel entering the bid evaluation area.

1. The agency shall, at least 1 hour before the deadline for bid opening, enter the basic information of the personnel entering the bid evaluation area through the trading system; If there is special demand for the number of visitors, an application shall be submitted to the provincial trading center through the "special project" reporting channel of the trading system at least 2 working days in advance. After receiving the above application, the provincial trading center shall give a reply within 1 working day;

2 in the relevant departments of the state to set up the evaluation expert database to extract experts, should be submitted to the provincial trading center before the start of the evaluation work;

3. Personnel who have not entered information shall not enter the bid evaluation area.

(7) bid opening

The agency shall arrive at the bid opening site 15 minutes before the bid opening (bid closing) time specified in the transaction (procurement) announcement, and make good preparations for bid opening. The personnel who organize the bid opening must include the project leader and at least 1 full-time technicians agreed in the agency contract, and wear the work logo of the unit.

Organize the bid opening meeting in strict accordance with legal procedures, including but not limited to the following procedures:

1. Sign for the tender documents according to the requirements of the tender documents. Before the deadline for bidding, check the sealing and marking of the bidding documents according to the requirements of the bidding documents. Those that do not meet the requirements will not be accepted, and those that meet the requirements shall be signed and properly kept, and the signed bidding documents shall not be opened before the bid opening;

2. The staff of the agency shall announce the discipline of bid opening before the bid opening. During the bid opening, we should cooperate with the staff of the provincial trading center to strengthen on-site management, strictly abide by the discipline of bid opening, and clear up the personnel who disturb the order of the bid opening site;

3. Check the documents and sing the standard. Bidders (suppliers) or their elected representatives or social supervisors should check the sealing of the bidding documents, and after confirmation, the staff will unpack them and read them out in public;

4. If the bidder (supplier) has any questions or doubts about the bid opening activities, it shall raise them on the spot, and the agency staff shall promptly handle the questions and questions raised by the bidder (supplier) representative;

5. Maintain order at the scene and handle disputes at the scene according to law;

6. Announce the end of bid opening, timely sort out the bid opening information and documents required for bid evaluation, and hand over all the information to the bid evaluation room under the supervision of social supervisors (supervised by tenderee or purchaser, without social supervisors). The bid opening materials shall not be altered or destroyed, and materials irrelevant to bid evaluation shall not be included.

(8) Selecting experts.

Select bid evaluation experts in the bid evaluation area. Those who enter the bid evaluation area get their ID cards after being verified by the access control system, and enter the designated area for related activities under the guidance of the staff of the provincial trading center. Those who fail to pass the verification shall not enter the bid evaluation area. Personnel entering the bid evaluation area are not allowed to enter or leave without authorization. If it is really necessary to enter and exit, it shall fill in the Registration Form for Temporary Entry and Exit of Agents of Jilin Provincial Public Resource Trading Center (downloaded from the website of the Provincial Trading Center), and register the entry and exit time, accompanied by the competent person or service personnel.

1. Personnel and quantity entering the bid evaluation area. The number of bid evaluation experts shall be implemented in accordance with the requirements submitted for the formation of the bid evaluation committee. Engineering construction project: The number of social supervisors shall be implemented according to the relevant regulations, with 2 staff members and expert representative 1 person (in case of temporary replacement under extreme special circumstances, the power of attorney issued by the tenderee shall be provided). Government procurement projects: government employees 1 person, representatives of procurement units 1 person (in case of temporary replacement under special circumstances, the power of attorney issued by the tenderee shall be provided);

2. Choose experts. The staff of the provincial trading center are randomly selected from the provincial comprehensive evaluation expert database according to the "Evaluation Expert Extraction Table" provided by the agency or social supervisor.

If it is necessary to change the number and type of experts in the process of extraction, it shall be proposed by the tenderer or agency, and supplemented by the staff of the provincial trading center after confirmation.

(9) Bid evaluation

Before the bid evaluation begins, the staff of the bidding agency (procurement) should do a good job in identifying the bid evaluation experts of this project;

The bid evaluation activities are presided over by the staff of the agency, including but not limited to: introducing the project name and participants, announcing the discipline of bid evaluation (review), and organizing bid evaluation (review) activities;

In the process of bid evaluation (review), if the bid evaluation (review) activities cannot be carried out normally due to unexpected circumstances, the staff of this institution shall take the initiative to contact the regional managers of bid evaluation, control the situation in time, do a good job in collecting and retaining on-site evidence, report to the administrative supervision and management department, and properly dispose of it according to the law and regulations;

If the bid evaluation cannot be completed on time and it is necessary to provide delayed service, the agency shall submit an application for delayed bid evaluation to the provincial trading center before the bid evaluation date 15:30 (the application form for delayed bid evaluation shall be collected at the service desk of the bid evaluation area on the fifth floor), and the delayed service shall not be provided if the application is not made (the bid evaluation time shall not exceed 20: 00 on the same day in principle). Do not provide overnight bid evaluation service).

(ten) release the winning candidates and the winning publicity.

1. The agency shall announce the winning candidate and the winning result through the trading system;

2. The time, content and form of the publicity of the winning candidate and the winning result shall meet the requirements of laws and regulations;

3. The release application shall be submitted 1 working days before the release date specified by the candidate winning the bid and the result of the bid, and the provincial trading center shall give a reply within 1 working days after receiving the application;

4. The release of the successful candidate and the publicity of winning the bid shall be checked in time, and the unpublished candidate shall be revised and resubmitted in time according to the feedback.

(1 1) change and cancellation

For example, the agency changes or cancels the scheduled time and place of bid opening and evaluation, released information, etc. , submit the application through the trading system and explain the reasons, and the provincial trading center will give a reply within 1 working days after receiving the application.

(12) Reconsideration and reassessment.

The agency shall submit a request for reconsideration or re-evaluation to the provincial trading center by letter, submit an application for the time and place of appointment for reconsideration or re-evaluation through the trading system, and the provincial trading center shall give a reply within 3 working days after receiving the application.

After receiving the results of reconsideration or re-evaluation, the institution shall issue relevant announcements with reference to the provisions of paragraph 10 of this article.

Article 17 An agency shall not harm or collude with others to harm the national interests, social interests and the legitimate interests of other parties during the whole transaction.

Article 18 An agency shall carry out agency activities in accordance with the law within the scope of its agency business, and shall not sell, lend or lease the agency qualification of the bidding (procurement) project for entering the market.

Chapter IV Evaluation Management

Nineteenth provincial trading center shall evaluate and manage the trading behavior of the agency in accordance with the provisions of Chapter III.

Article 20 The cumulative deduction system is adopted in the evaluation, which is basically divided into 100, and the deduction is publicized once every quarter. The evaluation period is 1 year, and the points deducted during this period shall be handled according to the Administrative Measures for the Evaluation of Agency Trading Behavior of Jilin Public Resource Trading Center.

Article 21 When employees who carry out agency business deduct points, the agency will deduct points with the same score. Employee deduction shall be publicized together with agent deduction.

Twenty-second quarterly summary statistical results shall be publicized in the first month of the next quarter, and the publicity period shall be 5 working days.

Twenty-third agencies and employees have objections to the deduction, shall submit a written complaint to the provincial trading center within the publicity period. The staff of the provincial trading center will re-examine according to the regulations and inform the complainant of the re-examination results within 15 days. If the review results change the original statistical results, the results after the review shall be publicized.

Article 24 The provincial trading center only implements evaluation grade management for institutions that enter the market to carry out trading activities, and divides * * * into six grades: A, B, C, D, E and F. At the beginning of the scoring cycle, the institution defaults to Grade A. If the institution violates rules and regulations during trading, it needs to participate in the study, training and assessment of the provincial trading center. After passing the examination, the score will be restored to 100, and the rating will be reduced to Grade B (every deduction below 60 points will reduce the rating by one grade). The provincial trading center regularly publicizes the evaluation level of the agency.

Chapter V Supplementary Provisions

Twenty-fifth if there is a policy adjustment or system reform, the agency should cooperate with the administrative supervision and management departments and the provincial trading center to make corresponding adjustments.
