In the process of execution, the people's court conducts a search on the person subjected to execution, his residence or hidden property that fails to fulfill the obligations specified in legal documents, which is called a search.
When the people's court takes search measures, the president shall issue a search warrant, and the people's court must meet the following conditions when taking search measures:
First, the time limit for performance determined by the effective legal documents has expired;
Second, the person subjected to execution fails to perform the obligations determined by legal documents;
Third, it is believed that there is an act of concealing property.
Before conducting a search, the search personnel must dress in accordance with the regulations and produce a search warrant and identity documents.
When the people's court searches, irrelevant personnel are prohibited from entering the search site; If the object of the search is a citizen, it shall notify the person subjected to execution or his adult family members and grass-roots organizations to send personnel to be present; If the object of the search is a legal person or other organization, it shall notify its legal representative or principal responsible person to be present; If there is a superior competent department, it shall also notify the relevant personnel of the competent department to be present, and the refusal to be present will not affect the search.
Searching a woman's body should be carried out by a female supervisor. Property found in the search that should be seized according to law shall be handled in accordance with the provisions of the second paragraph of Article 224 and Article 226 of the Civil Procedure Law of our country.
A search record shall be made, which shall be signed or sealed by the searcher, the searched person and other persons present. Refuse to sign or seal, it shall be indicated in the search record.
