Article 2 The term “private medical institutions” as mentioned in these Measures refers to outpatient departments and clinics, hospitals and nursing homes run by individuals. Article 3: These Measures apply to the administrative regions of this city. Article 4 The Qingdao Municipal Health Administration Department is the administrative department in charge of private medical institutions in this city.
The health administrative departments of each district (city) are specifically responsible for the administrative management of private medical institutions in accordance with regulations.
Relevant government departments should cooperate with the health administrative department to supervise and manage private medical institutions. Article 5 Private medical institutions shall abide by relevant laws and regulations, abide by medical technology routines and medical ethics, and provide high-quality and efficient medical services. Article 6 Private medical institutions shall, in accordance with the requirements of the health administrative department, undertake social health work such as primary health care, health and epidemic prevention, maternal and child health care, and health education. Article 7 The legitimate rights and interests of private medical institutions are protected by state law and may not be infringed upon by any unit or individual. Chapter 2 Application and Approval Article 8 The health administrative departments of Qingdao City and various districts (cities) shall formulate development plans for medical institutions in the region based on the development status of local medical and health undertakings, and strengthen macro management of the establishment of private medical institutions. Article 9 Private medical institutions shall meet the following conditions:
(1) Outpatient departments or clinics shall have independent business premises; hospitals or nursing homes shall have a building area of ??no less than 25 square meters per employee Business rooms;
(2) Hospitals or nursing homes should have more than 20 beds;
(3) Practitioners should be staffed at a ratio of 1 to 1.3 per hospital bed , among which health technical personnel shall not be less than 80%;
(4) Have medical equipment and liquidity suitable for its business;
(5) Meet the approval of the people's government at or above the county level development plan for medical institutions in the region. Article 10 Anyone who has obtained the qualification of a physician (bachelor) and has been engaged in this profession for more than two consecutive years, or who has expertise in traditional Chinese medicine, massage, osteopathy, massage, medical cosmetology, etc., and has been assessed and recognized by the Qingdao Municipal Health Administration Department, will be eligible for admission. You can apply to open an outpatient department or clinic. Article 11 Anyone who is one of the following persons shall not apply to open or join a private medical institution:
(1) Employees of medical institutions owned by the whole people and collectively owned;
(2) Rural doctors in village clinics (institutions);
(3) Those who have been disqualified from practicing medicine;
(4) Suffering from mental illness, infectious diseases or other serious chronic diseases that make them unable to perform their jobs disease. Article 12 When applying to open a private medical institution, the sponsor shall submit the following supporting materials to the health administration department:
(1) Application report and articles of association;
(2) Personal identity And the identity, academic qualifications, professional title certificates of employees and health certificates issued by hospitals at or above the district (city) level;
(3) Proofs of business premises, medical equipment and working capital. Article 13: Outpatient departments and clinics shall be approved by the health administrative department of the district (city) where they are located and reported to the Qingdao Municipal Health Administration Department for record.
Hospitals and nursing homes shall be reviewed by the health administrative department of the district (city) where they are located and then reported to the Qingdao Municipal Health Administration Department for approval.
The health administrative department shall submit its review opinions and notify the applicant within fifteen days of receiving the application. Article 14 Private medical institutions can only open business after being reviewed and approved by the health administrative department and obtaining the "Practice License" of the private medical institution. Article 15 Private medical institutions shall not be named directly after the administrative division names of "China" and "province, city, district, township", nor may they use names such as "center, red cross, expert clinic"; outpatient departments, clinics The name should indicate the department or specialty.
After review and approval, a private medical institution shall engrave a seal and plaque consistent with the approved name and submit it to the approval authority for record. Article 16 If a private medical institution needs to change its person in charge, institution name, scope of practice and other registration matters, it shall go through the change registration procedures with the original approval department; if it changes its practice location and meets the conditions, it shall go through the change registration procedures.
Article 17 If a private medical institution ceases operations on its own initiative, it shall go to the original approval department to handle the suspension procedures and surrender the "Practice License" within 15 days from the date of suspension.
If the operator of an outpatient department or clinic encounters one of the conditions in Article 11 of these Measures, his or her "Practice License" shall be canceled; if a practitioner of a private medical institution encounters one of the preceding conditions, he shall Fire the person. Chapter 3 Practice Management Article 18 The health administrative department has the right to comprehensively evaluate and manage the practice activities and medical service quality of private medical institutions in accordance with the medical institution evaluation methods and evaluation standards prescribed by the state.
Private medical institutions shall practice according to the approved personnel, names, practice locations, scope of practice, etc., and their employees shall dress in accordance with regulations. Article 19 Private medical institutions shall use the medical care documents uniformly printed by the Qingdao Municipal Health Administration Department, and fill in, record and save them in accordance with regulations. Article 20 Private medical institutions shall implement the rules and regulations on medical care technology, epidemic reporting, disease statistics, disinfection and isolation formulated by the national and provincial health administrative departments.
