2. The real estate license is the name of two people, and there are some cases where one person signs a contract, including:
(1) If one of the property owners obtains the power of attorney from another property owner, he has the right to buy and sell the relevant house on his behalf, which can be signed by one property owner who has obtained the power of attorney, and the contract is valid.
(2) If one property owner fails to obtain the power of attorney from the other property owner, but the buyer has reason to believe that he has the right to sell the house and pay a reasonable price, the contract is valid.
(3) If one party's property owner sells the property without the consent of the other party's property owner, and after one party signs it, the other party's property owner ratifies the consent, the contract is valid.
3. Relevant regulations:
(1) The General Principles of Civil Law stipulates that:
Article 66 An act without agency, beyond agency or after termination of agency can only be ratified by the principal, who shall bear civil liability. If the act is not ratified, the actor shall bear civil liability. Knowing that someone else has committed a civil act in my name without denying it is regarded as consent.
(2) The Property Law stipulates that:
Article 106 Where a person who has no right to dispose of a realty or chattel transfers it to an assignee, the owner has the right to recover it; Unless otherwise provided by law, in any of the following circumstances, the transferee obtains the ownership of real estate or chattel:
The transferee is in good faith when accepting real estate or movable property;
(2) Transfer at a reasonable price;
(3) The transferred immovable property or movable property that should be registered according to law has been registered, and the transferred immovable property or movable property that does not need to be registered has been delivered to the transferee.
If the transferee obtains the ownership of real estate or chattel in accordance with the provisions of the preceding paragraph, the original owner has the right to claim compensation from the unauthorized person.
Where the parties have acquired other real rights in good faith, the provisions of the preceding two paragraphs shall apply mutatis mutandis.
