Chapter I General Provisions

In order to strengthen and standardize the fire safety management of organs, organizations, enterprises and institutions, prevent fires and reduce fire hazards, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC).

These Provisions shall apply to the fire safety management of state organs, organizations, enterprises and institutions (hereinafter referred to as units) in People's Republic of China (PRC).
Except as otherwise provided by laws and regulations.

Units shall abide by fire laws, regulations and rules (hereinafter referred to as fire laws and regulations), implement the fire policy of putting prevention first and combining prevention with elimination, perform fire safety duties and ensure fire safety.
Article 4
The legal representative of a legal entity or the main person in charge of an unincorporated entity is the person in charge of fire safety of the entity and is fully responsible for the fire safety work of the entity.
Article 5
Units shall implement the fire safety responsibility system and post fire safety responsibility system step by step, clarify the fire safety responsibility step by step and post by post, and determine the fire safety responsible persons at all levels and posts.
Chapter II Fire Safety Responsibility
Article 6
The person in charge of fire safety of the unit shall perform the following fire safety duties:
(a) to implement fire laws and regulations, to ensure that the fire safety of the unit meets the requirements, and to master the fire safety status of the unit;
(two) combining the fire control work with the production, scientific research and management activities of the unit, and approving the implementation of the annual fire control work plan;
(three) to provide the necessary funds and organizational guarantee for the fire safety of this unit;
(four) to determine the responsibility for fire safety step by step, and to approve the implementation of the fire safety system and the operating rules for ensuring fire safety;
(five) the organization of fire inspection, supervise and urge the implementation of fire hazards rectification, timely handling of major issues involving fire safety;
(six) according to the provisions of fire laws and regulations to establish a full-time fire brigade, voluntary fire brigade;
(seven) to organize the formulation of fire fighting and emergency evacuation plans in line with the actual situation of the unit and conduct drills.
Article 7
The unit can determine the fire safety administrator of the unit according to the needs. The fire safety administrator is responsible for the person in charge of fire safety of the unit, and implements and organizes the following fire safety management work:
(a) to formulate the annual fire control work plan and organize the implementation of daily fire safety management;
(two) to organize the formulation of fire safety systems and operating procedures to ensure fire safety, and to inspect and supervise their implementation;
(three) to formulate the capital investment and organizational guarantee scheme for fire safety work;
(four) to organize the implementation of fire inspection and rectification of fire hazards;
(5) Organizing the maintenance of the fire-fighting facilities, fire-fighting equipment and fire safety signs of the unit, ensuring that they are in good condition and effective, and ensuring smooth evacuation passages and safety exits;
(6) Organizing and managing full-time fire brigades and volunteer fire brigades;
(seven) to organize the publicity, education and training of fire fighting knowledge and skills for employees, and organize the implementation and drills of fire fighting and emergency evacuation plans;
(eight) other fire safety management work entrusted by the fire safety responsibility unit.
The fire safety administrator shall regularly report the fire safety situation to the person in charge of fire safety, and timely report the major issues related to fire safety. If the fire safety manager is not determined, the fire safety management work specified in the preceding paragraph shall be implemented by the person in charge of fire safety of the unit.
Article 8
When contracting, leasing or entrusting operation and management, the property right unit shall provide buildings that meet the requirements of fire safety, and the parties shall specify the fire safety responsibilities of all parties in the contract concluded in accordance with relevant regulations; Fire truck passages, evacuation facilities involving public fire control safety and other building fire control facilities shall be managed by the property right unit or the entrusted management unit.
Units that contract, lease or entrust management shall abide by these provisions and perform fire safety duties within the scope of their use and management.
Article 9
For buildings with more than two property units and users, the property units and users shall specify the management responsibilities of fire truck passages, evacuation facilities involving public fire control safety and other building fire control facilities, and may entrust unified management.
Article 10
Residential property management units shall perform the following fire safety duties within the scope of management:
(a) to formulate a fire safety system, implement fire safety responsibilities, and carry out fire safety publicity and education;
(two) to carry out fire inspection to eliminate fire hazards;
(three) to ensure the smooth flow of evacuation routes, safety exits and fire engines;
(four) to ensure that public fire control facilities, equipment and fire safety signs are in good condition and effective.
Other property management units shall be responsible for the fire safety management within the scope of entrusted management.
Article 11
For holding large-scale activities with fire hazards such as assemblies, fireworks parties and lantern festivals, the organizers, contractors and units providing venues shall specify the fire safety responsibilities of all parties in the signed contracts.
Article 12
The construction unit is responsible for the fire safety of the construction site. The general contractor shall be responsible for the implementation of the general construction contract. The subcontractor shall be responsible to the general contractor and obey the general contractor's fire safety management on the construction site.
For the local reconstruction, expansion and decoration of buildings, the construction unit shall specify the fire safety responsibilities of all parties on the construction site in the contract signed with the construction unit.
Chapter III Fire Safety Management
Article 13
Units within the following scope are key units of fire safety, and strict management shall be implemented in accordance with the requirements of these Provisions:
(a) shopping malls (markets), hotels (restaurants), stadiums (gymnasiums), auditoriums, public places of entertainment and other public gathering places (hereinafter referred to as public gathering places);
(2) Hospitals, sanatoriums and boarding schools, nurseries and kindergartens;
(3) State organs;
(4) Radio stations, television stations and postal and communication hubs;
(5) Passenger stations, docks and civil airports;
(six) public libraries, exhibition halls, museums, archives and cultural relics protection units with fire danger;
(seven) power plants (stations) and power grid enterprises;
(8) Units that produce, fill, store, supply and sell inflammable and explosive chemicals;
(nine) clothing, shoes and other labor-intensive production and processing enterprises;
(10) Important scientific research units;
(eleven) other units that may have a fire, which may cause heavy casualties or property losses in the event of a fire.
High-rise public buildings such as high-rise office buildings (office buildings) and high-rise apartment buildings, underground public buildings such as urban subways and underground sightseeing tunnels, important urban traffic tunnels, large warehouses and storage yards where materials such as grain, cotton, wood and department stores are concentrated, and the construction sites of national and provincial key projects shall be strictly managed in accordance with the requirements of these Provisions for key units of fire control safety.
Article 14
Key fire safety units, their fire safety responsible persons and fire safety managers shall be reported to the local public security fire control institutions for the record.
Article 15
Key units of fire safety shall establish or determine the centralized management department of fire control work and determine full-time or part-time fire management personnel; Other units shall determine full-time or part-time fire management personnel, and may determine the centralized management functional departments of fire control work. Centralized management functional departments and full-time and part-time fire management personnel shall implement fire safety management under the leadership of the person in charge of fire safety or the fire safety administrator.
Article 16
Public gathering places shall, after meeting the following fire safety conditions, report to the local public security fire control institutions for fire safety inspection, and can only be opened for use after passing the inspection:
(a) to go through the examination and approval procedures for fire protection design of construction projects according to law, and pass the fire protection acceptance;
(two) establish and improve the fire safety organization, fire safety responsibility is clear;
(three) the establishment of fire safety management system and operating rules to ensure fire safety;
(4) Employees have received fire safety training;
(five) the building fire control facilities are complete, intact and effective;
(six) to formulate fire fighting and emergency evacuation plans.
Article 17
Hold assemblies, fireworks parties, lantern festivals and other large-scale activities with fire hazards. The organizer or undertaker shall, after meeting the fire safety conditions, declare to the public security fire control institutions to carry out fire safety inspection on the activity place, and hold it only after passing the inspection.
Article 18
Units shall, in accordance with the relevant provisions of the state and in combination with their own characteristics, establish and improve fire safety systems and operating procedures to ensure fire safety, and promulgate and implement them.
The unit fire safety system mainly includes the following contents: fire safety education and training; Fire inspection and inspection; Management of safety evacuation facilities; Fire (control room) on duty; Maintenance and management of fire fighting facilities and equipment; Rectification of fire hazards; Safety management of using fire and electricity; Flammable and explosive dangerous goods and fire and explosion prevention in places; Organization and management of full-time fire brigade and volunteer fire brigade; Fire fighting and emergency evacuation planning exercises; Inspection and management of gas and electrical equipment (including lightning protection and antistatic); Fire safety assessment and rewards and punishments; Other necessary fire safety contents.
Article 19
Units should identify the parts that are prone to fire, may seriously endanger personal and property safety and have a significant impact on fire safety, set up obvious fire signs and implement strict management.
Article 20
Units shall implement strict fire safety management on the use of open flames. It is forbidden to use open flames in places where there is a danger of fire and explosion; If it is necessary to carry out open flame operations such as electricity and gas welding due to special circumstances, the hot work department and personnel shall go through the examination and approval procedures in accordance with the fire management system of the unit, and implement the on-site guardian. Only after confirming that there is no danger of fire or explosion can hot work be carried out. Hot work construction personnel shall abide by fire safety regulations and implement corresponding fire safety measures.
When public gathering places or buildings used by two or more units need to use open flames in local construction, the construction unit and the user unit shall take fire prevention measures to separate the construction area from the use area, remove flammable and combustible substances in the hot work area, configure fire-fighting equipment and designate special personnel to monitor them, so as to ensure fire safety within the construction and use scope.
Hot work is prohibited during the operation of public casinos.
Article 21
Units shall ensure the smooth evacuation routes and exits, set fire safety evacuation signs and emergency lighting facilities in line with state regulations, and keep fire doors, fire shutters, fire safety evacuation signs, emergency lighting, mechanical smoke exhaust and air supply, fire accident broadcasting and other facilities in normal condition.
The following acts are strictly prohibited:
(1) occupying an evacuation passage;
(two) set up fences and other obstacles that affect evacuation on the safety exit or evacuation passage;
(3) During the period of enterprise, production, teaching and work. The exit is locked or blocked, or the fire safety evacuation indication sign is blocked or covered;
(four) other acts that affect the safe evacuation.
Article 22
Units shall abide by the relevant provisions of the state and implement strict fire safety management for the production, use, storage, sale, transportation or destruction of inflammable and explosive dangerous goods.
Article 23
Units shall, in accordance with the relevant provisions of fire laws and regulations, establish full-time fire brigades and voluntary fire brigades, equip them with corresponding fire fighting equipment, organize fire fighting business learning and fire fighting skills training, and improve their ability to prevent and put out fires.
Article 24
When a fire breaks out in a unit, it shall immediately implement the fire fighting and emergency evacuation plan, and ensure timely alarm, rapid fire fighting and timely evacuation of personnel. Peripheral units should give support. All units and personnel shall provide convenience for fire alarm free of charge and shall not obstruct the alarm.
Units shall provide convenience and conditions for public security fire control institutions to rescue personnel and put out fires.
After the fire is put out, the fire unit shall protect the scene, accept the accident investigation, truthfully provide the fire accident situation, assist the public security fire control institutions to investigate the cause of the fire, verify the fire loss and find out the responsibility for the fire accident. Without the consent of the public security fire control institutions, the disaster site shall not be cleaned up without authorization.
Chapter IV Fire Prevention Inspection
Article 25
Key units of fire safety shall conduct daily fire inspection, and determine the personnel, content, place and frequency of inspection. Other units may organize fire prevention inspection as required. The contents of the inspection shall include:
(a) illegal use of fire and electricity;
(two) whether the safety exits and evacuation passages are unblocked, and whether the safety evacuation signs and emergency lighting are in good condition;
(three) whether the fire control facilities, equipment and fire safety signs are in place and complete;
(four) whether the normally closed fire door is closed, and whether the articles stacked under the fire shutter affect the use;
(5) On-the-job situation of personnel in key fire safety positions;
(six) other fire safety situation.
Fire inspection in public gathering places during business hours shall be conducted at least once every two hours; At the end of business, the business premises shall be inspected to eliminate the residual fire. Hospitals, nursing homes, boarding schools, nurseries and kindergartens should strengthen night fire inspection, and other key fire safety units can organize night fire inspection according to the actual situation.
Fire patrol personnel shall promptly correct violations and properly handle fire hazards. If it cannot be handled on the spot, it shall be reported immediately. When you find the first fire, you should immediately call the police and put it out in time.
Fire inspection shall fill in the inspection records, and the inspectors and their supervisors shall sign the inspection records.
Article 26
Organs, organizations and institutions shall conduct fire inspection at least once every quarter, and other units shall conduct fire inspection at least once a month. The contents of the inspection shall include:
(a) the implementation of fire hazards rectification and preventive measures;
(2) Information on safe evacuation routes, evacuation signs, emergency lighting and safety exits;
(three) the situation of fire truck passage and fire water source;
(four) the configuration and effectiveness of fire fighting equipment;
(five) illegal use of fire and electricity;
(six) the knowledge of key types of workers and other employees;
(seven) the management of key parts of fire safety;
(eight) the implementation of fire and explosion prevention measures for inflammable and explosive dangerous goods and places and the fire safety of other important materials;
(nine) fire (control room) on duty and facilities operation and records;
(ten) fire inspection;
(eleven) the establishment and good and effective situation of fire safety signs;
(twelve) other contents that need to be checked.
Fire prevention inspection should fill in inspection records. The inspectors and the person in charge of the inspected department shall sign the inspection records.
Article 27
Units shall, in accordance with the requirements of the relevant provisions of the inspection and maintenance of building fire control facilities, inspect and maintain the integrity and effective state of building fire control facilities.
Article 28
Units equipped with automatic fire control facilities shall, in accordance with regulations, conduct comprehensive inspections and tests on their automatic fire control facilities on a regular basis, and issue inspection reports for future reference.
Article 29
Units shall, in accordance with the relevant provisions, regularly carry out maintenance and repair inspection of fire extinguishers. A file shall be established for fire extinguishers to record the configuration type, quantity, installation location, inspection and maintenance unit (personnel), chemical replacement time and other related information.
Chapter V Rectification of Fire Hazard
Article 30
The unit shall promptly eliminate the existing fire hazards.
Article 31
For the following violations of fire safety regulations, the unit shall instruct the relevant personnel to correct and supervise the implementation on the spot:
(a) illegally entering the place where inflammable and explosive dangerous goods are produced and stored;
(two) the illegal use of open flame operation or smoking in places with fire and explosion danger, the use of open flame and other violations of the ban;
(three) lock or block the exit, or occupy or pile up items that affect the smooth evacuation passage;
(four) the use of fire hydrants and fire fighting equipment is blocked or used for other purposes; (five) the normally closed fire door is in the open state, and the articles stacked under the fire shutter affect the use;
(six) fire facilities management, personnel on duty and fire patrol personnel leave their posts without permission;
(seven) illegal closure of fire control facilities, cut off fire power supply;
(eight) other acts that can be corrected on the spot.
Violation of the provisions of the preceding paragraph and corrections shall be recorded for future reference.
Article 32
For fire hazards that cannot be rectified on the spot, the centralized management functional department of fire control work or full-time or part-time fire management personnel shall report the existing fire hazards to the fire safety manager or fire safety responsible person of the unit in a timely manner according to the management division of the unit, and put forward the rectification plan. The fire safety manager or the person in charge of fire safety shall determine the rectification measures and time limit, as well as the departments and personnel responsible for rectification, and implement the rectification funds.
Before the fire hazard is eliminated, the unit shall implement preventive measures to ensure fire safety. If fire control safety cannot be guaranteed, fire may be caused at any time or personal safety will be seriously endangered in case of fire, the dangerous parts shall be suspended for rectification.
Article 33
After the rectification of fire hazards is completed, the department or personnel responsible for rectification shall submit the rectification record to the person in charge of fire safety or the fire safety administrator for signature and confirmation, and then file it for future reference.
Article 34
For major fire hazards that cannot be solved by urban planning and layout itself, as well as major fire hazards that cannot be solved by organs, organizations and institutions, units shall put forward solutions and report to the higher authorities or local people's governments in a timely manner.
Article 35
Public security fire control institutions shall be ordered to correct fire hazards within a time limit, and units shall make corrections within the prescribed time limit, and write a reply for rectification of fire hazards and submit it to public security fire control institutions.
Chapter VI Publicity, Education and Training on Fire Safety
Article 36
Units should carry out regular fire safety activities through various forms.
Publicity and education. Key units of fire safety shall conduct fire safety training for each employee at least once a year. Publicity, education and training should include:
(a) the relevant fire laws and regulations, fire safety system and operating rules to ensure fire safety;
(two) the fire risk and fire prevention measures of this unit and this post;
(three) the performance of fire fighting facilities and the use of fire fighting equipment;
(four) the knowledge and skills of reporting fires, fighting initial fires and self-help and escape.
Fire safety training for employees in public gathering places should be conducted at least once every six months, and the training content should also include the knowledge and skills of organizing and guiding the evacuation of people present.
The unit shall organize new employees and employees entering new positions to conduct pre-job fire safety training.
Article 37
In the course of business and activities, public gathering places should publicize the common sense of fire prevention, fire fighting, evacuation and escape to the public by posting pictures, broadcasting and closed-circuit television.
Schools and kindergartens should educate students and children on fire safety knowledge through entertaining and entertaining.
Article 38
The following personnel shall receive special fire safety training:
(a) the person in charge of fire safety and the fire safety administrator of the unit;
(two) full-time and part-time fire management personnel;
(3) the fire control room on duty and operating personnel;
(four) other personnel who should receive special training on fire safety in accordance with the regulations.
The personnel in Item (3) of the preceding paragraph shall hold relevant certificates.
Chapter VII Fire Fighting and Emergency Evacuation Plans and Exercises
Article 39
Fire fighting and emergency evacuation plans formulated by key fire safety units
It shall include the following contents:
(1) Organization, including: fire fighting action group, communication contact group, evacuation guidance group and safety protection and rescue group;
(2) Alarm and alarm handling procedures;
(3) Organizational procedures and measures for emergency evacuation;
(four) procedures and measures to put out the initial fire;
(5) Procedures and measures for communication, safety protection and rescue.
Article 40
Key units of fire safety shall conduct drills at least once every six months in accordance with the fire fighting and emergency evacuation plan, and constantly improve the plan in light of the actual situation. Other units shall, in combination with the actual situation of their own units, formulate corresponding emergency plans and organize drills at least once a year.
During the fire drill, obvious signs should be set up and the personnel within the drill scope should be informed in advance.
Chapter VIII Fire Protection Archives
Article 41
Key units of fire control safety shall establish and improve fire control files. Fire archives shall include the basic situation of fire safety and fire safety management. The fire protection archives shall reflect the basic situation of the fire protection work of the unit in detail and comprehensively, with necessary charts and graphs, and be updated in time according to the changes of the situation.
Units shall keep fire control files for future reference.
Article 42
The basic situation of fire safety shall include the following contents:
(a) the basic situation of the unit and the key parts of fire safety;
(two) the documents and materials of the fire design audit, fire acceptance and fire safety inspection before the construction, use or opening of the building or place;
(three) fire management organizations at all levels and the person in charge of fire safety;
(4) Fire safety system;
(5) Fire-fighting facilities and equipment;
(six) full-time fire brigade, volunteer fire brigade personnel and their fire fighting equipment;
(seven) the situation of key types of personnel related to fire safety;
(eight) certification materials of new fire protection products and fire prevention materials;
(nine) fire fighting and emergency evacuation plan.
Article 43
Fire safety management shall include the following contents:
(a) various legal documents issued by public security fire control institutions;
(two) regular inspection records of fire control facilities, comprehensive inspection reports of automatic fire control facilities and maintenance records;
(three) fire hazards and their rectification records;
(four) fire inspection and inspection records;
(5) Inspection records of gas and electrical equipment (including lightning protection and antistatic);
(six) fire safety training records;
(seven) the drill record of fire fighting and emergency evacuation plan;
(eight) fire records;
(9) Records of fire rewards and punishments.
The records in items (2), (3), (4) and (5) of the preceding paragraph shall record the personnel, time, place, contents, fire hazards found and treatment measures. ; The record of item (6) shall record the training time, participants and contents. The record in item (7) shall record the time, place, content, participating departments and personnel of the exercise.
Article 44
Other units shall uniformly keep the basic information of their own units, various legal documents issued by public security fire control institutions, and materials and records related to fire control work for future reference.
Chapter IX rewards and punishments
Article 45
Units shall incorporate fire safety work into internal inspection, assessment and appraisal. Units shall commend and reward departments (teams and groups) and individuals that have made outstanding achievements in fire safety work. Those who fail to perform fire safety duties according to law or violate the unit's fire safety system shall be given administrative disciplinary action or other treatment in accordance with relevant regulations.
Article 46
In violation of these provisions, administrative punishment shall be given according to law, and shall be punished in accordance with relevant laws and regulations; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter X Supplementary Provisions
Article 47
Public security fire control institutions shall supervise the implementation of these Provisions in accordance with the law, and bear legal responsibility for their acts of abusing their powers, neglecting their duties and engaging in malpractices for selfish ends.
Article 48
These Provisions shall come into force as of May 2002. Where the relevant provisions in the regulations issued by the Ministry of Public Security before the implementation of these Provisions are inconsistent with these Provisions, these Provisions shall prevail.
