In order to implement the relevant provisions of the Notice on Further Promoting the Stable and Healthy Development of the Real Estate Market in our city (Dong Jian [2020] No.7) and standardize the implementation of the policy of restricting the purchase and transfer of commercial housing, on the basis of the policy answer of the Notice on Further Promoting the Stable and Healthy Development of the Real Estate Market in our city, combined with the actual situation in our city, the relevant matters are hereby notified as follows:
First, the identification of second-hand commercial housing transaction transfer.
Non-local residents (hereinafter referred to as "buyers") who bought second-hand commercial housing in our city before July 25th, 2020 (excluding July 25th, the same below) can continue to go through the online signing transfer formalities according to the original policy if they can provide the seller with the Real Estate Sales Intermediary Contract or the House Sales Contract signed before the above date and the transfer certificate of the house purchase deposit or part of the house payment (cash payment is not recognized). The specific identification criteria are as follows:
(1) Collection and payment unit
1. Payer
(1) The buyer himself must provide his ID card.
(2) The close relatives of the buyer (spouse, parents, children, brothers and sisters, grandparents, grandparents and grandchildren, the same below) shall provide ID cards, household registration books, marriage certificates, birth medical certificates, notarization of kinship, kinship certificates of village neighborhood committees, kinship certificates issued by the public security department where the buyer is registered, and other materials that can prove the relationship with the close relatives of the buyer.
(3) The agent entrusted by the notary must provide ID card and notarial certificate (the notarial certificate should be issued before July 25, 2020, and the entrusted matters clearly include matters such as deposit payment and house purchase).
2. Payee
The seller himself (the owner of real estate registration) or the seller's spouse or adult children must provide identification cards, marriage certificates, household registration books, birth medical certificates, notarization of kinship and other supporting materials.
(2) Transfer voucher
1. Bank remittance
(1) bank counter transfer and online banking transfer vouchers between the buyer and the seller or entities meeting the above payment conditions, and affix the bank seal.
(2) If a bank provides payment and custody services for housing transaction funds, it shall provide a fund supervision agreement between the buyer and the seller and a valid bank transfer voucher for paying the corresponding fees, and the buyer and the seller shall sign the agreement and transfer the payment.
(3) The authenticity check of bank transfer vouchers can be handled in the following ways:
① The staff of the real estate registration department at the place where the real estate is located has passed the audit of the relevant bank official website, printed and signed the screenshot of the information checked online.
(2) The real estate registration department where the real estate is located conducts verification by sending a letter to the bank.
③ The applicant shows the online banking transfer record in the window of the real estate registration department where the real estate is located, prints the screenshot after the screenshot of the mobile phone, and the applicant and the window manager sign the printed screenshot for confirmation.
(4) The applicant and the bank staff (with work permit and bank power of attorney) sign at the window of the real estate registration department where the real estate is located to confirm that the transfer certificate is true and valid.
2. Alipay and WeChat transfer
If payment is made through Alipay or WeChat transfer (including WeChat "small change" payment), the payment transaction details voucher (with special seal for business voucher) issued by Alipay and WeChat showing the above payer and payee information (must be real name) shall be provided, and the bank transfer voucher shall be provided at the same time if the bank credit card or savings card is bound. The applicant must use his mobile phone to present the electronic certificate at the window of the real estate registration department where the real estate is located and send a successful notice (if the applicant is a non-payer, he must present the electronic certificate and send a screenshot of the successful notice), log in to the email address specified in the notice, download and open the detailed certificate of payment transaction, print the screenshot after the screenshot, and the applicant and the window manager sign the printed screenshot for confirmation.
3. Depository of funds paid by third parties such as Lifangtong.
If both parties to the transaction provide housing transaction fund payment and custody services through a third-party agency introduced by a real estate brokerage agency, they must provide the business license and payment business license of the third-party payment agency (the color copy is stamped with the official seal), the performance payment service agreement and a valid transfer voucher for paying the corresponding fees, and both parties must sign an agreement and transfer the payment. A real estate brokerage institution cooperating with a third-party payment institution shall submit a complete list of customers who collect and pay on behalf of the third-party payment institution to the real estate registration department, including the names of both parties to the transaction, the number of the house sales contract, the number of the electronic receipt, the transaction time and the transaction amount. , assist the real estate registration department to check.
(3) Remarks
If the transaction parties of the above transfer and payment vouchers are not the buyers and sellers themselves, the relevant vouchers must be expressed as "the purchase price of someone (referring to the buyer) or a house (referring to the transaction house)", "the purchase deposit of someone (referring to the buyer) or a house (referring to the transaction house)" or "the purchase price" or "the purchase deposit".
(4) Time limit for handling
Considering the epidemic situation and other reasons, non-local residents who meet the above criteria are allowed to continue to sign real estate sales contracts and go through the transfer procedures before February 3, 2020.
Second, on the purchase restriction policy of commercial housing
(1) If the family members of non-registered residents in this Municipality have full-time bachelor degree or above or junior professional titles, and can provide the labor contract of the city's work unit and the proof of paying social insurance for more than half a year every month in the two years before July 25, 2020, they can still purchase the first set of new commercial housing according to the original policy. Non-local registered families who meet the above conditions should complete the online signing of the relevant new commercial housing sales contract before June 365438+1October 365438+1October 2020. Those who have not been insured for more than half a year and have obtained the qualification of purchasing houses through one-time payment will not be recognized.
(2) Families who are not registered in this Municipality have paid personal income tax 1 year or 2 years before July 25, 2020, and can still purchase the first or second set of new commercial housing according to the original policy. Non-local registered families who meet the above conditions should complete the online signing of the relevant new commercial housing sales contract before June 365438+1October 365438+1October 2020. For those who have paid taxes in July 2020 1 or 2 years, and those who have declared taxes before August 2020 1 or those who have declared taxes in July in August, the tax authorities will put them in storage in August. Three. Policies to restrict the transfer of commercial housing
(1) Determination of the term of limited transfer
Commercial housing (including newly-built commercial housing and second-hand commercial housing, the same below) signed online before April 1 1, 2065438 requires indefinite transfer.

3. Commercial houses signed online after 0: 00 on July 25, 2020 can only be traded and transferred (including gifts) after obtaining the certificate of immovable property for three years.
(2) During the marriage, the date of registration of real estate rights at the time of the last real estate transaction or transfer shall prevail.
(3) About gifts
After the implementation of document 1. Dong Jian [2020] No.7, if the property donee is not registered in this city and is a close relative of the donor, the donee may be exempted from the social security payment requirements, but it must meet the requirements of the current housing purchase restriction policy in this city; If the donor is a non-resident of this city and has obtained the qualification of purchasing a house as a gift (subject to the date when the donee obtains the certificate of ownership of real estate, the same below), the commodity house can be purchased again after the donee has obtained the certificate of ownership of real estate for two years. Donated commercial housing can only be traded and transferred after obtaining the certificate of immovable property rights for 3 years.
2. If the donator of registered residents in this Municipality obtains the qualification of purchasing houses through donation, he shall not buy new commercial housing again after the donee has obtained the certificate of real estate ownership for two years. Donated commercial housing can only be traded and transferred after obtaining the certificate of immovable property rights for 3 years.
3. If the inheritance of commodity housing involves share donation, the transfer registration of inheritance donation shall be handled together, and both parties to the donation shall not be bound by the purchase restriction. The limited sales period of the house inherited (donated) by the successor (donee) shall be counted from the date when the decedent obtains the house ownership certificate; If the decedent fails to obtain the house ownership certificate, it shall be counted from the date when the heir (donee) obtains the house ownership certificate.
4. If the purchaser provides false certification materials to defraud the purchaser, once verified, the purchaser's qualification shall be cancelled and dealt with according to law, and recorded in the personal bad credit record, and the resulting economic and legal responsibilities shall be borne by the purchaser. Real estate development enterprises, real estate brokerage institutions and employees who instigate, induce and assist buyers to provide false certification materials to defraud the qualification of buying houses will be severely dealt with according to the law and regulations. Relevant enterprises, institutions and personnel that constitute a crime shall be investigated for criminal responsibility according to law. If the deposit or purchase price of second-hand commodity housing is paid by WeChat, Alipay or other third-party payment institutions before July 25, 2020, and the authenticity cannot be verified or determined through normal channels, the real estate registration center will study and confirm it with housing construction, the People's Bank of China and banking supervision departments. If the materials are found to be fraudulent, they will be transferred to the public security organs for handling.
5. After the implementation of Dong Jian [2020] No.7 Document, if the transfer period of commercial housing is not full, and the owner of the house puts it on the market for sale in advance without authorization and collects the deposit or purchase price from the purchaser, the risk of being unable to trade and the economic and legal responsibilities arising therefrom shall be borne by the owner of the house. Real estate agencies and brokers should carefully check whether the entrusted houses meet the relevant requirements of the transfer restriction policy, and refuse to accept the entrustment if they do not meet the trading conditions. Real estate agencies and brokers who provide brokerage services for houses that do not meet the trading conditions or are prohibited from trading in violation of regulations will be dealt with severely according to the law.
Six, this notice and the "policy answer" is inconsistent with the previous relevant policies and measures, this notice shall prevail.
