Legal analysis
Not necessarily legal, the validity of the seal contract of the village Committee depends on the situation. It is illegal to build a house without a land use certificate, and it shall go through the examination and approval procedures according to law. Only after the examination and approval according to the actual situation and relevant laws and regulations can the house be built according to law. According to relevant laws and regulations, a civil juristic act shall meet the following conditions:
(1) The actor has corresponding capacity for civil conduct;
(2) the meaning is true;
(3) It does not violate the law or public interests.
In addition, the conditions of a conditional contract must meet the following requirements:
First, conditions must be future facts, that is to say, conditions do not exist in reality, but belong to objective, uncertain, unforeseeable facts, which may or may not be realized, and conditions are uncertain.
Second, the conditions are set by the parties rather than legal. As a condition, the facts must be chosen by the parties themselves and the result of the agreement between the two parties, not the conditions stipulated by law. That is, it is an arbitrary clause in the contract rather than a statutory clause.
Third, the conditions must be legal. The parties shall not take the fact that it harms public interests, public order or the legitimate rights and interests of others as an additional condition of the contract. According to the Supreme People's Court's judicial interpretation, a conditional civil act that violates the law shall be deemed invalid.
Fourth, the conditions must not contradict the main contents of the contract.
