Labor arbitration procedure

A labor dispute case shall be decided within 45 days from the date when the labor dispute arbitration committee accepts the arbitration application. If the laborer refuses to accept the arbitration award, he may bring a lawsuit to the people's court within 15 days from the date of receiving the arbitration award.

(1) Application and acceptance

When a party applies for labor dispute arbitration, it shall submit an application for arbitration. In practice, the arbitration application should include the following contents:

2. If a party refuses to appear in court or withdraws from court without the consent of the arbitration tribunal, the applicant shall be rejected and the respondent may arbitrate by default;

3. After the hearing, the list of arbitrators shall be announced and asked whether to apply for withdrawal;

4. Then the parties make statements, debate and finally make a ruling.
