People's Republic of China (PRC) villagers' election law

Article 297 Where a member of a villagers' committee becomes vacant due to resignation, transfer, recall, termination of qualification, death or moving out of the village, a villagers' meeting by-election shall be held within 1 month.

When the director is away, the deputy director will make up for it; When the deputy director is absent, he shall be replaced by the member who won the most votes in the first round of counting. If a member gets the same number of votes in the first round of counting, the number will be more than one round; Vacant members are elected by-election.

Members of the villagers' committee are vacant, but there are still not less than 3 people. Upon the decision of the villagers' meeting or the villagers' representative meeting, a by-election may not be held.

Article 298 If by-election is needed, the villagers' meeting or villagers' representative meeting shall fill in the application form for by-election, and the by-election procedure shall be started after the approval of the township government.

The by-election shall be presided over by the villagers' representative meeting. The number of candidates for by-election of villagers' committee members should be more than the number of places to be elected. The by-election procedure is the same as that of the villagers' committee.

Article 299 The term of office of a by-election member of a villagers' committee shall expire.

Article 312 Whoever commits one of the following acts shall be ordered by the government at a higher level to make corrections, and the persons who are directly responsible shall be given disciplinary sanctions:

(1) Designate candidates for villagers' committees.

(two) in violation of legal procedures to adjust, recall or change the candidates for the villagers' committee.

(three) to appoint or appoint members of the villagers' committee.

(four) in violation of legal procedures to recall or replace members of the people's Committee.

(5) delaying the general election of the villagers' committee for more than two months without justifiable reasons.

(six) the election is not conducted in accordance with legal procedures.

(seven) to prevent the members of the villagers' committee elected according to law from taking office.
