Legal analysis: Workers who voluntarily leave their jobs can write a voluntary resignation certificate. In other cases, the employee has the right to refuse to issue a certificate of voluntary resignation. The voluntary resignation certificate written by the forced laborer in the unit is a manifestation of evading the responsibility of the unit and also a manifestation of forcing the laborer to give up the claim for compensation. Especially in the case that working conditions have led to the forced resignation of workers, the certificate of voluntary resignation of workers will become reasonable evidence for enterprises to evade their responsibilities. This kind of behavior obviously violates the wishes of the workers and is an obvious illegal act that does not abide by the principle of voluntary equality in the labor contract. Laborers can report the situation to the trade union or the labor inspection department, and the trade union and the labor inspection department will report the situation. If employees suffer losses because they don't carry out the company's behavior, employees can apply for labor arbitration, or bring a lawsuit to the court, asking the enterprise to compensate employees for their losses.
Legal basis: Article 39 of the Labor Contract Law: The employer unilaterally terminates the labor contract (negligent termination).
The employer may terminate the labor contract if the employee is under any of the following circumstances: (1) The employee is proved to be unqualified for employment during the probation period; (two) a serious violation of the rules and regulations of the employer; (three) serious dereliction of duty, corruption, causing great damage to the employer; (4) The laborer establishes labor relations with other employers at the same time, which has a serious impact on the completion of the work tasks of the unit, or the employer refuses to correct it; (5) The labor contract is invalid due to the circumstances specified in Item 1 of Paragraph 1 of Article 26 of this Law; (6) Being investigated for criminal responsibility according to law.
