Legal analysis: the material evidence was collected by the plaintiff. When the people's court receives the evidential materials submitted by the parties, it shall issue a receipt indicating the name, number of pages, number of copies, original or photocopy of the evidence and the time of receipt, and the person in charge shall sign or seal it. The people's court has the right to investigate and collect evidence from the relevant units and individuals, and the relevant units and individuals may not refuse. The people's court shall distinguish the authenticity of the documents submitted by the relevant units and individuals, and examine and determine their validity. The evidence shall be presented in court and cross-examined by the parties. Evidence involving state secrets, commercial secrets and personal privacy shall be kept confidential. If it needs to be presented in court, it may not be presented publicly.
Legal basis: Article 64 of the Civil Procedure Law of People's Republic of China (PRC), the parties have the responsibility to provide evidence of their own claims. The people's court shall investigate and collect evidence that the parties and their agents ad litem cannot collect on their own due to objective reasons, or evidence that the people's court considers necessary for hearing a case. The people's court shall comprehensively and objectively examine and verify the evidence in accordance with legal procedures.
