1, a fire death 10 or more, the fire control institutions of provinces and autonomous regions shall organize the investigation, and the public security criminal investigation department shall send personnel to participate in the investigation;
2. Before making a fire accident identification, the fire control institution shall summon the parties to the scene to explain the identified fire cause and listen to the opinions of the parties;
3, fire accident investigators should ask the insider, make a record, signed by investigators and respondents or fingerprint;
4, on-site inspection records shall be signed by fire accident investigators, witnesses or parties;
5. To extract traces and articles on site, a fire trace and article extraction list shall be filled in and signed by the extractor, witness or the party concerned. Packaging traces and articles, labeling, and signed by the packager, witness or party concerned;
6. If a fire causes death, the fire control institution shall immediately notify the criminal science and technology department of the public security organ at the same level to conduct corpse inspection. The criminal science and technology department of the public security organ shall issue a certificate of corpse inspection and identification to determine the cause of death.
Legal basis: Article 64 of the Fire Protection Law of People's Republic of China (PRC).
Whoever, in violation of the provisions of this Law, commits one of the following acts, which does not constitute a crime, shall be detained for not less than 10 days but not more than 15 days, and may be fined not more than 500 yuan; If the circumstances are minor, a warning or a fine of 500 yuan shall be imposed:
(a) instigating or forcing others to violate fire safety regulations and take risks;
(2) Fire caused by negligence;
(three) after the fire broke out, the alarm was stopped, or the person in charge of the report failed to call the police in time;
(four) disturbing the order of the fire scene, or refusing to carry out the command of the fire scene commander, which affects the fire fighting and rescue;
(5) Deliberately destroying or forging a fire scene;
(six) unauthorized unpacking or use of places and parts sealed by fire rescue agencies.
