1. Both men and women who require marriage registration should apply to the marriage registration authority of the district or county civil affairs bureau (or the town people's government) with the required documents.
The application for marriage registration or remarriage registration shall be handled in accordance with the marriage registration procedures.
2. Under normal circumstances, the marriage contract cannot be concluded by an agent, and the disabled must have relatives nearby, otherwise it will not have legal effect; In other words, the engagement can only be established if both men and women agree.
3. Only those who have the legal capacity for engagement can engage in engagement. At present, the legal definition of betrothal ability is based on age: men over 17 years old and women over 15 years old. A marriage contract concluded in violation of this provision is not invalid, but the parties or legal representatives may request the court to cancel it. Because, for minors under the age of 20, their engagement must be approved by the legal representative.
The engagement should not be enforced. Although the engagement should be observed, it should also follow the wishes of both men and women. If one party fails to perform, it cannot be enforced.
According to the current laws of our country, engagement is not a necessary procedure before the wedding, and a marriage without engagement does not lose its validity. Engagement is a kind of contractual behavior in law, and it is also an identity contract. The parties personally apply to the marriage registration office, and each person fills in a declaration of application for marriage registration.
5. Both parties must personally sign or press their fingerprints in the column of "Declarer" in the application for marriage registration in front of the marriage registrar.
6. The marriage registration authority shall examine the documents and statements submitted by both parties, and if they meet the requirements for marriage registration, they shall be granted registration.
Legal basis: Article 6 of the Marriage Law of the People's Republic of China, the age of marriage shall not be earlier than 22 for men and 20 for women. Late marriage and childbearing should be encouraged.
Article 5 When applying for marriage registration, mainland residents shall produce the following documents and supporting materials:
(1) My household registration book and ID card;
(2) A signed statement that I have no spouse and no direct blood relationship with the other party and collateral blood relationship within three generations.
