Bank drafts can be used to transfer money, and "bank drafts" marked with cash can also be withdrawn.
The issuing bank of a bank draft is the drawee of the bank draft, and the place of payment of the bank draft is the place where the agent drawee or drawer is located.
The signature of the drawer of a bank draft on the draft shall be the special seal for bank draft approved by the People's Bank of China and the signature or seal of its legal representative or its authorized agent.
When issuing a bank draft, the following items shall be recorded: the words "bank draft" shall be marked; Commitment to unconditional payment; Ticket amount; Name of payer; Name of payee; Date of issue; Signature of drawer. Without any of the above records, the bank draft is invalid.
The time limit for presentment payment of bank draft is 1 month from the date of issue. If the holder presents payment beyond the payment time limit, the agent payer (bank) will not accept it.
The guarantor may assume the guarantee responsibility for the bank draft debt according to law.
A bank draft may be transferred by endorsement, but a bank draft marked "cash" may not be transferred by endorsement.
If the bank draft is marked with the word "cash" and the agent payer is lost, the payer may notify the payer or the agent payer to report the loss of payment.
When a bank draft is lost, the loser may request payment or refund from the issuing bank on the basis of the certificate issued by the people's court that he enjoys the right to the bill.
