Generally speaking, the main body of the administrative license, administrative punishment and administrative law enforcement inspection files of our bureau is legal, the facts are clear, the evidence is conclusive, the basis is accurate, the procedures are standardized, the case is closed on schedule, the information is complete, the filing is timely and standardized, and it meets the requirements of laws and regulations.

Third, the main achievements

(1) Administrative license

In February of 65438, xx, our bureau was listed as a government work department by the municipal government, and the subject of administrative license implementation was legal. The administrative license is subject to a "one-window" acceptance system. According to the regulations of the government affairs hall, all matters related to approval and licensing have entered the approval hall of the municipal government. Eight administrative examination and approval and service projects, such as the overall grain purchase license and liquor wholesale (preliminary examination), were completed on time in strict accordance with the administrative examination and approval process and commitment period. The entry and completion rate of approved projects reached 65,438+000%. The administrative examination and approval window has also established an electronic file for administrative examination and approval. Archives shall be filed in time, and binding shall be unified and standardized.

(2) Administrative punishment

1, conscientiously perform their duties, do not exceed their duties, and do not abuse their powers. In terms of alcohol supervision, the Notice on Implementing the Food Safety Law issued by seven ministries and commissions, including the Ministry of Commerce, requires "doing a good job in the management of alcohol circulation, continuing to do a good job in the management of industries such as the registration system of alcohol operators and the accompanying list system of alcohol circulation", strictly implementing the Notice on Further Strengthening the Quality and Safety of Alcohol issued by the Ministry of Health, the State Administration for Industry and Commerce and the Office of the State Food Safety Committee, and earnestly carrying out administrative law enforcement inspections.

4. In terms of administrative fees, the Regulations on the Administration of Administrative Fees in Shanxi Province shall be strictly implemented, and the regulations of the Ministry of Commerce stipulate that fees shall be charged according to the cost. However, before the approval of the Provincial Department of Finance and the Provincial Price Department, our bureau will not charge fees, and there is no illegal act of charging without a "license fee" or issuing a receipt for financial charges.

(3) Administrative law enforcement inspection

According to houma city's "Notice Spirit on Further Strengthening the Work of Rectifying Chaos and Optimizing the Environment for Economic Development", all law enforcement inspections of our bureau should be audited by the Municipal Office of Rectifying Chaos and signed by the vice mayor in charge of optimizing the environment, and carried out by combining daily inspection, reporting and complaint inspection and special inspection on holidays. The law enforcement inspection of our bureau adopts the principle of giving priority to education and supplementing punishment. In view of the problems discovered for the first time, they shall be ordered to make corrections, focusing on education, and severely punish those who do not change their education.

Fourth, the existing problems

1. Some rules and regulations of the Ministry of Commerce, such as "Where there are laws and regulations, the provisions of laws and regulations shall prevail", have unclear responsibilities, which brings great difficulties to grassroots law enforcement.

2. In the process of alcohol law enforcement, the merchants who do not cooperate with the inspection lack the law enforcement documents of "providing within a time limit", which brings inconvenience to inspection and punishment.

3. The responsibility of the commercial department for alcohol supervision is very clear: "Do a good job in the management of alcohol circulation, and continue to do a good job in the management of industries such as the registration system of alcohol operators and the accompanying list system of alcohol circulation", but the superior documents always regard "alcohol counterfeiting" as the main task of law enforcement, which leads to the grass-roots units being unable to administer according to law.

4. Because the scope of liquor stipulated in the Regulations on the Administration of Liquor in Shanxi Province and the Measures for the Administration of Liquor Circulation of the Ministry of Commerce are inconsistent, it is difficult to define whether cooking wine belongs to the scope of law enforcement in the process of law enforcement, which brings inconvenience to law enforcement inspection.

5. The basic information of the personal administrative punishment file of the party concerned is incomplete; The writing is not neat and beautiful.

6. After filing the case, there is a phenomenon that the paper size and specifications used by the parties to provide evidence materials are not uniform, and the parties cannot sign page by page when they provide more materials.
