(1) If the legally adopted child is infertile for more than five years after marriage, and the woman is over 3 years old and needs to adopt a child, it can only be adopted with the approval of the Population and Family Planning Bureau, otherwise it will be illegal adoption.
1. Adoption of children requires the following materials:
(1) Approval form in duplicate;
(2) marriage and childbirth certificate of the unit (or community), and the signature of the person in charge;
(3) both men and women apply;
(4) Copy and original of marriage certificate;
(5) Copies and originals of the household registration books of both men and women;
(6) Proof of infertility in hospitals above two counties.
(2) Illegal adoption of a child without the approval of the Population and Family Planning Bureau requires reporting the adopted son (female) to the household, and the following materials are required: 1. A certificate issued by the unit (or community) of both men and women (stating clearly the marriage, birth or non-birth, the name, gender and adoption time of the adopted child), and stamped with the official seal of the street (township) family planning office;
2. Those who have not given birth to children after marriage need to submit the proof of infertility in hospitals above two counties;
3. The director of the Family Planning Bureau shall go to the office to go through the relevant procedures for reporting the adoption of a child (female) after holding the certificate of both men and women and the certificate of infertility (only the certificate of both men and women who have given birth).
