The divorce agreement is not valid, but it will not come into effect until both parties get a divorce certificate from the Civil Affairs Bureau. The divorce agreement shall specify the expression of willingness of both parties to divorce and the consensus on matters such as child support, property and debt handling.

Legal basis

Article 176 of the Civil Code of the People's Republic of China

If the husband and wife divorce voluntarily, they shall sign a written divorce agreement and apply for divorce registration in person at the marriage registration office.

The divorce agreement shall specify the expression of the will of both parties to divorce voluntarily and the consensus opinions on matters such as child support, property and debt handling.

Article 69 of the Supreme People's Court's Interpretation on the Application of Marriage and Family Organization

If the divorce between the two parties is unsuccessful and one party repents in the divorce proceedings, the people's court shall consider the property and debt settlement agreement invalid and make a judgment according to the actual situation in accordance with Articles 187 and 189 of the Civil Code.

the provisions on property and debt disposal in the divorce agreement signed by the parties in accordance with Article 176 of the Civil Code are legally binding on both men and women. After the registration of divorce, the people's court shall accept the lawsuit arising from the dispute over the performance of the above agreement.
