To establish a travel agency, the following conditions must be met: To apply for the establishment of a travel agency to operate domestic tourism business and inbound tourism business, the following conditions must be met: (1) There is a fixed business location, that is, the applicant has property rights Business premises or business premises rented by the applicant with a lease period of not less than one year; (2) Necessary business facilities, that is, more than 2 direct landline telephones, fax machines, photocopiers, and tourism administration facilities Computers with networking conditions for departments and other tourism operators; (3) Have a registered capital of no less than 300,000 yuan. Registered Capital Article 7 The registered capital of a travel agency shall meet the following requirements: (1) International travel agencies, the registered capital shall not be less than 1.5 million yuan; (2) Domestic travel agencies, (registered capital of 300,000 yuan) and quality guarantee deposit (200,000 yuan) yuan in cash). Deposit Article 8 When applying to establish a travel agency, a quality guarantee deposit shall be paid to the tourism administrative department in accordance with the following standards: (1) If an international travel agency operates inbound tourism business, it shall pay RMB 600,000; if it operates outbound tourism business, it shall pay RMB 1.2 million. (2) Domestic travel agencies, pay RMB 200,000. The quality guarantee deposit and the interest generated during the period under the management of the tourism administrative department belong to the travel agency; the tourism administrative department can withdraw a certain proportion of management fees from the interest in accordance with relevant national regulations. (3) The scope of application of the quality guarantee deposit: (1) The travel agency violates the travel contract and infringes upon the legitimate rights and interests of tourists, which is verified to be true by the tourism administrative department; (2) The travel agency causes tourists to pay advance travel due to dissolution, bankruptcy or other reasons cost loss. The effective period for requesting quality deposit compensation is 90 days, calculated from the time when the claimant was infringed upon. (4) Situations in which the quality deposit is not applicable (1) The travel agency is unable to perform the contract due to force majeure; (2) Tourists have personal or property accidents during the tour; (3) Other economic disputes other than the applicable guarantee deposit; ( 4) The prescribed limitation period has been exceeded; (5) The judicial authority has accepted the case. Application Article 9 To apply for the establishment of an international travel agency, an application shall be submitted to the tourism management department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located; after review and approval by the tourism management department of the people's government of the province, autonomous region, or municipality directly under the Central Government, it shall be reported to the tourism administrative department of the State Council. Review and approve. To apply for the establishment of a domestic travel agency, you must apply for approval from the tourism management department of the province, autonomous region, or municipality where you are located. Article 10 To apply for the establishment of a travel agency, the following documents shall be submitted: (1) Application for establishment; (2) Feasibility study report for establishing a travel agency; (3) Articles of Association of the travel agency; (4) Resumes of the travel agency manager and deputy manager and Article 6 of these Regulations Qualification certificate specified in Paragraph 3 of Article; (5) Fund credit certificate issued by the bank where the account is opened, and capital verification report issued by the certified public accountant and its accounting firm or audit firm; (6) Certificate of business location; (7) Business equipment prove. Article 11 After receiving the application, the tourism administrative department shall review it according to the following principles: (1) It conforms to the tourism development plan; (2) It meets the needs of the tourism market; (3) It meets the conditions stipulated in Article 6 of these Regulations. The tourism administrative department shall make a decision on approval or disapproval within 30 days from the date of receipt of the application, and notify the applicant. Article 12 The tourism administrative department shall issue a "Travel Agency Business License" to the approved applicant, and the applicant shall obtain a business license from the industrial and commercial administrative agency with the "Travel Agency Business License". Those who have not obtained the "Travel Agency Business License" are not allowed to engage in tourism business. Article 13 If a travel agency changes its business scope, it shall go through the change registration procedures with the industrial and commercial administrative department after being reviewed and approved by the original tourism administrative department. If a travel agency changes its name, business location, legal representative, etc., or ceases operations, it shall go to the industrial and commercial administrative department to handle the corresponding change registration or deregistration, and file it with the original tourism administrative department that reviewed and approved it. Article 14 The tourism administrative department shall implement an announcement system for travel agencies. Announcements include opening announcements, name change announcements, business scope change announcements, business closure announcements, and license revocation announcements. Article 15 If a travel agency receives more than 100,000 tourists every year, it may establish a branch without legal person status (hereinafter referred to as a branch). Each time an international travel agency establishes a branch, it shall increase its registered capital by RMB 750,000 and pay an additional quality guarantee deposit of RMB 300,000; for each domestic travel agency that establishes a branch, it shall increase its registered capital by RMB 150,000 and pay an additional quality guarantee deposit of RMB 50,000. Travel agencies and their branches shall implement unified management, unified finance, unified solicitation, and unified reception. Branches established by travel agencies shall be subject to the supervision and management of the tourism management department of the local people's government at or above the county level where they are located. Article 16 Foreign travel agencies that establish permanent offices within the territory of the People's Republic of China must obtain approval from the tourism administrative department of the State Council.

The permanent offices of foreign travel agencies can only engage in tourism consultation, liaison and publicity activities, and are not allowed to operate tourism business.
