Article 40 If the public security organ decides to make compulsory isolation for drug addicts, it shall make a written decision on compulsory isolation for drug addicts, deliver it to the decided person before compulsory isolation for drug addicts, and notify the family, unit and local police station of the decided person within 24 hours after delivery; If the decision-maker does not tell his real name and address, and his identity is unknown, the public security organ shall notify him after finding out his identity.

If the person who is decided refuses to accept the decision of compulsory isolation and detoxification made by the public security organ, he may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Responsibility of drug rehabilitation medical institutions

(1) When a medical institution for drug rehabilitation collects the medical history and physical examination of drug addicts, the public security organ entrusted by it shall send relevant personnel to assist. If the medical institution for drug rehabilitation considers it necessary to test the biological samples of drug addicts, the public security organ entrusted by it shall assist in providing the test samples collected on the spot. If the drug rehabilitation medical institution considers it necessary to re-collect other human biological samples, the entrusted public security organ shall provide assistance.

(2) The detection reagents used by drug rehabilitation medical institutions should be products approved by the US Food and Drug Administration, and avoid cross-reaction with commonly used drugs.

(3) Drug rehabilitation medical institutions and their medical staff shall, in accordance with the norms, practices and relevant provisions of diagnosis and treatment, identify drug addicts with the results of medical history, mental symptom examination, physical examination and human biological sample detection.

(4) The drug rehabilitation medical institution shall issue a drug rehabilitation appraisal report within three working days from the date of accepting the entrustment, which shall be signed by the appraisers and stamped with the official seal of the drug rehabilitation medical institution. The appraisal report is made in duplicate, one for the public security organ entrusted with the appraisal and the other for future reference.

(five) the cost of entrusting a medical institution for drug addiction identification shall be borne by the entrusting unit.
