Legal basis: Article 4 of the Labor Contract Law. When an employer formulates rules and regulations or major issues that directly affect the vital interests of workers, it shall discuss with the workers' congress or all the workers, put forward plans and opinions, and determine them through equal consultation with trade unions or workers' representatives. The employing unit shall publicize or inform the rules and regulations and major issues directly related to the vital interests of workers. At the same time, the rules and regulations formulated through democratic procedures do not violate the provisions of national laws, administrative regulations and policies, and have been publicized to workers, which can be used as the basis for the people's courts to hear labor dispute cases.
