Article 87 of the Negotiable Instruments Law of People's Republic of China (PRC) can be used: "The amount of a cheque issued by the drawer of a cheque shall not exceed the amount actually recorded at the drawee at the time of payment. If the cheque issued by the drawer exceeds the actual deposit amount of the payer at the time of payment, it is a bad cheque. It is forbidden to write a bad check. " Article 88 of the People's Republic of China (PRC) Negotiable Instruments Law states that "the drawer of a cheque may not issue a cheque that is inconsistent with the signature style or seal of its reserved name." Article 31 of the Measures for the Implementation of Bill Management stipulates that "if the purpose of issuing a blank check or a check inconsistent with its reserved signature is not to defraud property, the People's Bank of China shall impose a fine of 5% of the face value but not less than 1000 yuan". The Shenzhen Central Sub-branch of the People's Bank of China will punish the drawer who issues a bad check (including a check whose signature is inconsistent with its reserved signature) according to the above provisions.
Although the promissory note does not fall within the scope of the above punishment, it may not be issued and the bank will not accept it.
