Legal analysis: the identification of traffic accident liability usually requires the signature of both parties, but if the parties refuse to sign the road traffic accident identification, mediation is not applicable. The traffic police may state the relevant information in the Letter of Confirmation of Road Traffic Accidents and serve the Letter of Confirmation of Road Traffic Accidents on the parties concerned.

Legal basis: Article 26 of the Procedures for Handling Road Traffic Accidents does not apply to mediation under any of the following circumstances. After the traffic police state the relevant situation in the road traffic accident confirmation, they can serve the road traffic accident confirmation to the parties: (1) The parties have objections to the road traffic accident confirmation; (two) the parties refused to sign the road traffic accident certificate; (three) the parties do not agree to mediation.
