Provisions on the Administration of Qiongzhou Strait Ferry Transportation (Guangdong)
Article 1 In order to strengthen the management of ferry transportation in Qiongzhou Strait and maintain the normal transportation order, these Provisions are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Waterway Transportation Management and relevant laws and regulations. Article 2 These Provisions shall apply to ships engaged in commercial ferry transportation in Qiongzhou Strait, their owners and operators, and enterprises and their personnel that provide wharf facilities and services for Qiongzhou Strait ferry. Article 3 The Qiongzhou Strait ferry transportation mentioned in these Provisions refers to the passenger and car ferry transportation in the coastal waters at the junction of Wailuo Port in xuwen county, Guangdong Province and Puqian Port in Wenchang City, Hainan Province, and at the junction of Wushi Port in Leizhou City, Guangdong Province and Xinying Port in Lingao County, Hainan Province. Article 4 Guangdong Province and Hainan Province respectively set up Qiongzhou Strait Ferry Transportation Management Office (hereinafter referred to as Strait Office). According to the authorization of the traffic administrative departments of the two provinces, the Straits Office shall perform the following duties:

(a) responsible for the implementation of administrative regulations and normative documents issued by the people's governments of the two provinces and the traffic administrative departments of the two provinces on the traffic management in Qiongzhou Strait;

(II) Be responsible for the management of Qiongzhou Strait ferry transport capacity, accept the application of waterway transport enterprises and units in this province to operate Strait ferry transport, sign the preliminary examination opinions, and submit them to the provincial traffic administrative department for examination and approval;

(three) to coordinate the handling of disputes between ports and shipping in Qiongzhou Strait ferry transportation;

(four) to organize and guide the port and shipping enterprises to do a good job in the connection transportation of cars and ships, and to maintain the order of transportation in the Straits;

(five) to investigate and deal with all kinds of illegal acts in violation of the provisions on the administration of cross-strait transportation market. Fifth companies and ships engaged in ferry transportation in Qiongzhou Strait must be approved by the traffic administrative departments of the two provinces. If a shipping company is registered in Hainan Province, it must first apply for a business license with the administrative department for industry and commerce of Hainan Province, and then go through the examination and approval procedures with the administrative department of communications of Hainan Province. If a shipping company is registered in Guangdong Province, it must first go through the examination and approval procedures with the traffic administrative department of Guangdong Province, and then go through the business license with the administrative department for industry and commerce of Guangdong Province with the approval documents.

Ships engaged in ferry transportation in Qiongzhou Strait must obtain a ship business transportation certificate from the transportation administrative department where their shipping company is located.

Those who have not applied for a business license and obtained a ship business transportation certificate shall not engage in ferry transportation in Qiongzhou Strait. Article 6 Ships engaged in ferry transportation in Qiongzhou Strait and enterprises or personnel providing wharf facilities and services for them must obey the management of the Straits Office.

Passenger ferry transportation should be done by setting the ship, route, schedule, time and dock. The ship shall not leave the post or delay the voyage without reason.

Port enterprises shall reasonably arrange berths according to the timetable agreed by the Straits Affairs Offices of the two provinces, and load or unload ships according to the prescribed timetable. Seventh channel ferry transportation must be charged in accordance with the approved items and standards. Passengers cross the sea with one vote. Tickets are uniformly printed, distributed and managed by the Straits Offices of the two provinces in accordance with relevant regulations. No unit or individual may raise the charging standard and increase the charging items. Eighth ship owners, operators and enterprises that provide wharf facilities services for them shall educate their employees to establish good professional ethics, operate in a civilized manner and provide quality services; Strengthen management and security work to maintain the normal order and safety of passengers and vehicles. Passengers, vehicles and goods shall not be smuggled aboard. It is strictly forbidden to take advantage of work to accept money and goods, collect fees indiscriminately, and extort money; It is strictly forbidden to make things difficult for passengers, shippers and drivers. Ninth in violation of the provisions of this Ordinance, engaged in Qiongzhou Strait ferry transport, shall be ordered to suspend business, confiscate the illegal income, and impose a fine of 5 times the illegal income. Tenth port enterprises do not arrange berths in accordance with the timetable and scheduling principles drawn up by the Straits Affairs Offices of the two provinces, and shall be fined 2000 yuan.

If the ship does not obey the dispatching management, the owner or operator of the ship shall be fined 2000 yuan. Eleventh ships, port enterprises and their staff collect fees or blackmail drivers, shippers and passengers, confiscate the illegal income, and impose a fine of 2000 yuan on the owners or operators of ships and port enterprises; The perpetrator and the person in charge of the post shall be fined 10 times the illegal income respectively. Twelfth port enterprises do not use unified bills, bills, confiscate their illegal income, and impose a fine of +00 times the illegal income; Those who do not carry out the passenger's one-vote crossing the sea shall have their illegal income confiscated, be ordered to make immediate corrections, and be fined five times the illegal income. Article 13 If a ship is fined three times within one year, it shall be ordered to stop sailing and make rectification; The time to suspend business for rectification shall not exceed 60 days. If a ship is punished again after being suspended for rectification within the year, its business transportation certificate shall be revoked. Those who have been sentenced to revoke their business transportation licenses shall not re-participate in Qiongzhou Strait ferry transportation. Article 14 If it is necessary to revoke the ship's business transportation certificate, it shall be withheld by the Straits Office of the investigated place and reported to the traffic administrative departments of the two provinces, and the original issuing authority shall revoke the ship's business transportation certificate.

If the ship's business transportation license is revoked but not revoked, with the approval of the provincial traffic administrative department, the original investigation report of the Straits Office may refuse the ship to dock at its own port or wharf.

Other punishments shall be executed by the Straits Office in the place of investigation. Fifteenth the implementation of fines, confiscation of illegal income punishment, must be issued by the financial sector unified printing confiscation receipt, indicating the number of illegal matters and illegal punishment notice, signed by the executor and stamped with the seal of the executive unit. Otherwise, the punished person has the right to refuse to pay the fine.

Fines and confiscations shall be turned over to the treasury in accordance with regulations.
