Article 1 is to standardize the management of key construction projects, guide capital investment, ensure the project quality and on-schedule completion of key construction projects, improve investment efficiency, and promote the sustained, rapid and healthy development of the national economy. According to relevant national regulations These regulations are formulated based on the actual situation of the province. Article 2 These Measures shall apply to the determination and management of key construction projects in this province. Article 3 The Provincial Key Construction Leading Group shall uniformly lead and manage the construction of key projects in the province. The leading group has an office (full name: Hubei Provincial Key Construction Office, referred to as Provincial Key Office, the same below), which is responsible for the daily work of the construction and management of key projects in the province.
Regional regions, cities, and states should establish corresponding agencies to participate in the management of national and provincial key construction projects within their regions. Article 4 Provincial key construction projects include capital construction projects and technological transformation projects, specifically including:
(1) Large and medium-sized projects in infrastructure, basic industries and pillar industries;
(2) High-tech projects that can drive technological progress in the industry;
(3) Projects that cross regions and have a significant impact on the economic development of the province or region;
(4) Projects that have a significant impact on social development;
(5) Other key projects. Article 5 The determination and implementation of key construction projects shall follow the following principles:
(1) The project layout is reasonable and the leading products meet market needs;
(2) The project legal person is clear and All construction conditions are met;
(3) Project construction should pay equal attention to environmental protection and resource conservation;
(4) Promote regional economic development and social development. Article 6: In order to increase the preliminary work of key construction projects, key construction projects are divided into two categories: preparation and under construction. After the project pre-feasibility study report is approved, if it meets Articles 4 and 5 of these Measures, it shall be applied through the feasibility study report approval channel and recommended to the provincial key office. Upon approval, it may be listed as a provincial preparatory key construction project; a provincial preparatory key After the construction project start report is approved, it can be listed as a key construction project under construction. Article 7 Key construction projects must strictly abide by capital construction and technical transformation procedures. The application documents should have the following contents:
(1) The application report for preparatory key construction projects should state the following contents: project, name of project legal person (construction unit), construction location, project scale, total investment and Funding sources, economic benefits or social benefits, as well as project proposals and feasibility study report approval documents.
(2) Applications for key construction projects should be accompanied by the following documents: feasibility study report, preliminary design and approval documents, documents related to project capital and other fund implementation, environmental protection and project construction land included in the land Approval of the annual development and utilization plan and other relevant documents. Article 8 Provincial key construction projects shall be determined at the beginning of each year and shall be handled according to the following procedures:
(1) Relevant provincial departments and prefecture, city, state planning and economic and trade departments shall comply with Article 4, Article 4 of these Measures Article 5 and Article 6 stipulate that after balancing the capital construction projects and technical transformation projects that have been approved for feasibility study in the department and region, an application for listing as a key or preparatory key construction project shall be submitted to the provincial planning and economic and trade departments.
(2) The provincial planning and economic and trade departments will conduct a comprehensive balance every year based on the applications from relevant local, municipal, state and provincial departments, propose annual key construction projects in the province, and submit them to the provincial key projects. At the beginning of the year, the Provincial Key Construction Office convened relevant departments for a study, and after a comprehensive balance, it was submitted to the Provincial Key Construction Leading Group for approval.
(3) The province's annual key construction projects will be announced by the provincial planning department after being reviewed and approved by the provincial key construction leading group and reviewed and approved by the provincial people's congress.
Projects that need to be listed as national key construction projects shall be declared by the provincial planning and economic and trade departments to the national planning and economic and trade departments. Article 9 Once a provincial key construction project is determined, the Provincial People's Government will issue a Hubei Province Key Construction Project Certificate and a Hubei Province Key Construction Project Signboard. Article 10: The construction of key projects shall be managed at different levels. The state and province are responsible for key national construction and provincial key construction projects; projects that have an important impact on regional economic development are managed by prefectures, cities, and states with reference to these measures. When major issues are involved in the implementation of provincial key construction projects, the provincial key office will coordinate and resolve them together with relevant departments. If it is difficult to solve, the provincial key office will formulate a solution and submit it to the provincial key construction leading group for decision.
Article 11 A project legal person responsibility system shall be implemented for key commercial construction projects. The project legal person shall be responsible for the entire process from project planning, financing, construction to production and operation, loan repayment and asset value preservation and appreciation. The organizational form and organizational structure of the project legal person shall be implemented in accordance with the Company Law of the People's Republic of China and relevant national regulations. In order to facilitate the supervision, inspection, coordination and service of key construction projects by the provincial key construction leading group, the provincial key construction project unit’s charter, board of directors, board of supervisors members, appointment of general manager and other relevant documents must be reported to the provincial key construction office for filing. The organizational management form of key non-commercial construction projects can be implemented with reference to the relevant provisions of the legal person responsibility system for construction projects. The list of responsible persons and relevant management rules and regulations should also be reported to the provincial key office for filing. Article 12: Key commercial construction projects shall implement a capital system in accordance with relevant national and provincial regulations. Article 13 Key construction projects shall be constructed in accordance with the approved design documents, and shall not expand the scale of construction, improve construction standards, or change construction content without authorization. For projects that exceed the estimated budget, the design unit will put forward opinions and submit them to the relevant departments for approval together with the project legal person ***.
