Article 77 The traffic management department of the public security organ shall, according to the work responsibilities of the traffic police, combine the traffic order, traffic flow conditions and traffic accident patterns and characteristics in the jurisdiction, as well as the difficulty of management of different positions, arrange For service work, determine the tasks and goals of law enforcement, and carry out assessment and evaluation work focusing on law enforcement image, law enforcement procedures, law enforcement effectiveness, law enforcement discipline, law enforcement workload, law enforcement quality, and police handling.

No fines shall be issued or issued in disguised form, and the number of penalties shall not be used as the sole basis for assessing the effectiveness of traffic police law enforcement.

The assessment and evaluation results should be published regularly, recorded in the traffic police's personal law enforcement files, and linked to the traffic police's evaluation of excellence, merit recording, rank and job promotion, and annual assessment and distribution of civil servants, and reward measures should be fulfilled.

Article 78 The traffic management departments of the provincial, municipal (prefecture) and county-level public security organs shall disclose their service systems and procedures, publish reporting hotlines, consciously accept supervision from the society and the masses, and conscientiously accept complaints from the masses. Report and resolutely investigate and deal with traffic police violations of laws and disciplines.

Article 79 The traffic management department of the public security organ shall establish and improve the on-duty police officer system, and promptly discover the deviations of the traffic police in law enforcement image, law enforcement discipline, law enforcement procedures, and handling of police officers by receiving the public. Mistakes can be corrected at any time to make law enforcement supervision work dynamic and routine.

Article 80 The traffic management department of the public security organ shall establish the law enforcement files of its own unit and its affiliated traffic police, and implement law enforcement quality assessment, law enforcement responsibility system and law enforcement fault investigation. Law enforcement files can be electronic files or paper files.

The specific content of law enforcement files shall be formulated uniformly by the traffic management department of the provincial public security agency in consultation with the public security legal department in accordance with the requirements for law enforcement quality evaluation.

Article 81 The traffic management department of the public security organ shall regularly analyze the law enforcement situation of the traffic police through law enforcement files, discover and sort out serious law enforcement problems, and formulate rectification measures.

Article 82 The traffic police brigade shall set up full-time legal officers, and the traffic police squadron shall set up part-time legal officers. Legislative officers should focus on reviewing the factual basis, evidence collection, application of procedures, document production, etc. of traffic police on duty and law enforcement, and standardize the filling and production of traffic police case files and documents.

Article 83 The traffic management department of the public security organ may use the traffic violation information system to implement online process management, online approval and online supervision of law enforcement cases, and strengthen the analysis and judgment of traffic police law enforcement situations.

Article 84 When traffic police are on duty on the road to enforce law, the following actions are strictly prohibited:

(1) Illegal detention of vehicles, motor vehicle driving licenses, driving licenses and motor vehicle numbers license;

(2) Violating regulations and collecting fines on the spot, failing to issue a fine receipt, failing to issue a summary penalty decision, or failing to fill in the amount of the fine truthfully;

(3) Using To facilitate the use of one’s position to solicit or accept other people’s property or seek other benefits;

(4) Illegal use of sirens and sign lights;

(5) Interception of motor vehicles when not performing emergency official duties;

(6) Deliberately embarrass the offender;

(7) Have disputes or conflicts with the offender or onlookers due to one’s own fault;

( 8) Engage in activities that are not within the scope of duties.

Chapter 12 Supplementary Provisions

Article 85 The public security organs of each province, autonomous region, and municipality directly under the Central Government may formulate implementation measures based on local realities.

Article 86 This specification will come into effect on January 1, 2009. The "Traffic Police Road Duty Law Enforcement Work Regulations" issued by the Ministry of Public Security on November 14, 2005 were abolished at the same time.
