Legal analysis: collective land lease does not need to be signed by every household, and the number of consenters can reach 2/3. The rural collective land contract scheme must be discussed and agreed by most collective members. According to the relevant laws and regulations, major collective affairs decisions must be democratic. Members of collective economic organizations have the right to participate in villagers' congresses or elect villagers' representatives to form villagers' congresses and exercise the right to manage village affairs.

Legal basis: Article 261 of the Civil Code of People's Republic of China (PRC) stipulates that the real estate and movable property collectively owned by farmers belong to the collective members.

The following matters shall be decided by collective members in accordance with legal procedures:

(a) the land contract scheme and land contract to organizations or individuals outside the collective;

(two) the adjustment of contracted land between individual land contractual management rights holders;

(three) the use and distribution of land compensation fees;

(4) Changes in the property rights of collectively-funded enterprises and other matters;

(5) Other matters prescribed by law.
