Article 4 An applicant for motor vehicle driver's license business shall truthfully submit the prescribed materials to the vehicle management office, truthfully declare the prescribed matters, and be responsible for the authenticity of the substantive contents of his application materials.
Article 5 The traffic administrative department of the public security organ shall establish a supervision system for handling motor vehicle driving license business in the motor vehicle management office, and strengthen the supervision and management of drivers' examination, issuance and use of driving licenses.
Article 6 The vehicle management office shall use the computer management system of motor vehicle driver's license to issue and print the motor vehicle driver's license, and the motor vehicle driver's license that is not issued and printed by the computer management system is invalid.
The database standard and software of the computer management system for motor vehicle driver's license are unified throughout the country, which can completely and accurately record and store the whole process information of handling personnel's application acceptance, subject examination and motor vehicle driver's license issuance, and can transmit the relevant information to the national public security traffic management information system in real time.
Chapter II Application for Motor Vehicle Driving License
Section 1 Motor Vehicle Driving License
Article 7 Whoever drives a motor vehicle shall obtain a motor vehicle driver's license according to law.
Article 8 Motorists are allowed to drive in the following order: large buses, tractors, city buses, medium buses, large trucks, small cars, small automatic cars, low-speed trucks, three-wheeled cars, small automatic buses for the disabled, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles, mopeds, wheeled self-propelled vehicles, trolleybuses and trams (Annex 1).

Section 2 Application
Article 11 An applicant for a motor vehicle driving license shall meet the following conditions:
(1) Age condition:

(2) Physical condition:

(six) drunk driving, operating motor vehicles, motor vehicle driving license has been revoked according to law for less than ten years;
(seven) the motor vehicle driver's license has been revoked according to law for less than two years due to other circumstances;
(eight) the driver's license has been revoked according to law for less than three years;
(9) Other circumstances stipulated by laws and administrative regulations.
Whoever drives a motor vehicle without obtaining a motor vehicle driver's license and commits one of the acts in items 5 to 7 of the first paragraph shall not apply for a motor vehicle driver's license within the prescribed time limit.
Article 13 Anyone who applies for a motor vehicle driver's license for the first time may apply for a motor vehicle driver's license with the quasi-driving types of city buses, large trucks, small cars, small automatic cars, low-speed trucks, three-wheeled cars, small automatic buses for the disabled, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles, mopeds, wheeled bicycles, trolleybuses and trams.
If you apply for a motor vehicle driver's license for the first time in your temporary residence, you can apply for a motor vehicle driver's license for automobiles, small automatic cars, low-speed trucks, three-wheeled cars, small automatic passenger cars for the disabled, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles and mopeds.
Article 14 Anyone who holds a motor vehicle driver's license and applies for increasing the number of quasi-driving models shall not record full 12 points in this scoring cycle and the latest scoring cycle before application. To apply for increasing the quasi-driving type of medium-sized buses, tractors and large buses, the following provisions shall also be met:
(a) to apply for increasing the quasi-driving type of medium-sized passenger cars, and to obtain the quasi-driving type qualification for driving city buses, large trucks, small cars, small automatic cars, low-speed trucks or three-wheeled cars for more than three years, and not to record full 12 points in the last three consecutive scoring cycles before the application;
(2) Those who apply for increasing the tractor's quasi-driving type have obtained the driving qualification of medium-sized passenger cars or large trucks for more than three years, or obtained the driving qualification of large passenger cars for more than one year, and have not scored 12 points in the last three consecutive scoring cycles before the application;
(3) Those who apply for increasing the permitted driving type of large passenger cars have obtained the qualification of permitted driving type of medium-sized passenger cars or large trucks for more than five years, or obtained the qualification of permitted driving type of tractors for more than two years, and have not scored 12 in the last five consecutive scoring cycles before the application.
The quasi-driving models that can be applied for in the temporary residence are small cars, small automatic cars, low-speed trucks, three-wheeled cars, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles and mopeds.
Fifteenth any of the following circumstances, shall not apply for large passenger cars, tractors, medium-sized passenger cars, large trucks quasi driving type:
(a) the death caused by a traffic accident, bear the same responsibility;

(three) the motor vehicle driving license has been revoked or revoked for less than ten years.

Article 17 An applicant for a motor vehicle driver's license shall apply to the vehicle management office in accordance with the following provisions:

(three) active servicemen (including armed police) to apply in their place of residence;
(4) Overseas personnel apply at their place of residence or residence;

Article 19 To apply for increasing the number of quasi-driving models, the applicant shall submit a motor vehicle driver's license in addition to filling out the application form and submitting the documents specified in Article 18.
Article 20 When applying for a motor vehicle driver's license, a holder of a motor vehicle driver's license of the army or the armed police force shall fill in an application form and submit the following documents and vouchers:
(1) the identity certificate of the applicant; Demobilized, demobilized or discharged personnel shall also submit certificates of demobilization, demobilized or discharged from the army and the armed police force;
(2) A certificate of physical condition issued by a medical institution at or above the county level or at the regiment level;

Article 21 When applying for a motor vehicle driver's license, an overseas motor vehicle driver's license holder shall fill in an application form and submit the following documents and vouchers:

If the application belongs to foreign embassies and consulates in China personnel or personnel of representative offices of international organizations in China, it shall be implemented in accordance with the principle of diplomatic reciprocity;
(3) Motor vehicle driver's license. If it is not expressed in Chinese, a Chinese translation shall also be issued.
Chapter III Motor Vehicle Driver Examination
Section 1 Examination Contents and Eligibility Criteria
Article 22 The examination contents of motor vehicle drivers are divided into the examination subjects of road traffic safety laws and regulations and related knowledge (hereinafter referred to as "subject 1"), the examination subjects of venue driving skills (hereinafter referred to as "subject 2") and the examination subjects of road driving skills and safe and civilized driving knowledge (hereinafter referred to as "subject 3").
Twenty-third examination content and qualification standards are unified throughout the country, and corresponding examination items are stipulated according to different driving types.
Article 24 The contents of Subject 1 examination include: road traffic, traffic signals, traffic safety violations and traffic accident handling, application and use of motor vehicle driver's license, motor vehicle registration and other road traffic safety laws, regulations and rules.
Twenty-fifth subject two examination contents include:
(a) large buses, tractors, city buses, medium-sized buses, large trucks, ramps, fixed-point parking and starting, side parking, passing through unilateral bridge, curve driving, right-angle turning, passing through width-limiting doors, passing through continuous obstacles, rolling pavement, turning around on narrow roads, coping with simulated expressways, continuous steep mountain roads, tunnels, rainy (foggy) days, wet roads and emergencies.
(two) small cars, small automatic cars, small automatic passenger cars and disabled low-speed trucks, parking, starting, side parking, curve driving and right-angle turning on the ramp;
(3) Three-wheeled vehicles, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles and mopeds stop and start on the ramp and pass through unilateral bridge;
(4) The examination contents of wheeled bicycles, trolleybuses and trams shall be determined by the traffic administrative department of the provincial public security organ.
The traffic administrative department of the provincial public security organ may, according to the actual situation, increase the examination content for the quasi-driving type specified in items 1 and 2 of the first paragraph.
Article 26 The contents of the road driving skills test in Subject 3 include: preparing for the test of large buses, tractors, city buses, medium buses, large trucks, small cars, small automatic cars, low-speed trucks and small automatic buses for the disabled, starting, driving in a straight line, adding and subtracting gears, changing lanes, stopping by the side, going straight through intersections, turning left at intersections, turning right at intersections, crossing crosswalks, passing through school areas, etc. The examination contents of other quasi-driving models shall be determined by the traffic management department of the provincial public security organ.
The test mileage of large and medium-sized buses shall not be less than 20km, including10km during the day and 5km at night. The test mileage of tractors, city buses and large trucks shall not be less than10km, of which the test mileage shall not be less than 5km during the day and 3km at night. The test mileage of small cars, small automatic cars, low-speed trucks and small automatic buses for the disabled is not less than 3 kilometers, and no less than 20% of vehicles are selected for night test; If you don't take the night show, you have to take the simulated night show lighting test.
For large buses, tractors, city buses, medium-sized buses and large trucks, the traffic administrative department of the provincial public security organ shall increase the content of driving tests for complex roads such as mountains, tunnels and steep slopes according to the actual situation. For other vehicles that are allowed to drive, the traffic management department of the provincial public security organ may increase the examination content according to the actual situation.
Article 27 The contents of the general knowledge test of safe and civilized driving in subject 3 include: the operating requirements of safe and civilized driving, the knowledge of safe driving in bad weather and complex road conditions, the emergency handling methods in unexpected situations such as tire puncture, and the knowledge of handling after traffic accidents.
Twenty-eighth holders of military and armed police motor vehicle driver's license to apply for motor vehicle driver's license of large buses, tractors, medium-sized buses and large trucks, should take the examination of subject 1 and subject 3; Those who apply for other quasi-driving motor vehicle driver's licenses are exempted from the examination and issued with motor vehicle driver's licenses.
Twenty-ninth to apply for a motor vehicle driver's license with an overseas motor vehicle driver's license, you should take the exam subject 1. To apply for a motor vehicle driver's license for large buses, tractors, medium-sized buses and large trucks, subjects 3 should also be tested. Applications from foreign embassies and consulates in China personnel and representatives of international organizations in China shall be implemented in accordance with the principle of diplomatic reciprocity.
Thirtieth subjects of the examination of the eligibility criteria are:
(a) subject a perfect score 100, 90 points qualified;

Section 2 Examination Requirements
Thirty-first vehicle management office shall accept the application for qualified motor vehicle driving license and arrange the examination according to the appointment date. The examination order is in accordance with subject 1, subject 2 and subject 3. Only by passing the exam of the previous subject can you take the exam of the latter subject. Only by passing the road driving skill test of subject 3 can you take the common sense test of safe and civilized driving.
The vehicle management office shall provide the applicants with self-service appointment examinations by Internet, telephone, etc., and publish the examination appointment plan, the number of appointments and the number of participants in the examination on the vehicle management office and the Internet.
Thirty-second for the first time to apply for a motor vehicle driver's license or to apply for an increase in the number of quasi-driving models, the vehicle management office shall issue a certificate of driving skills within one day after passing the examination.
The driving skill certificate is valid for three years, and the applicant shall complete the examination of subject 2 and subject 3 within the validity period. If the examination is not completed within the validity period, the scores of subjects that have passed the examination are invalid.
Article 33 To apply for a motor vehicle driver's license for the first time or increase the number of quasi-drivers, the applicant shall meet the following requirements when making an appointment for examination subject 2:
(a) enter oneself for an examination of small cars, small automatic cars, low-speed trucks, three-wheeled cars, small automatic passenger cars for the disabled, wheeled bicycles, trolleybuses and trams, and make an appointment for the examination within ten days after obtaining the driving skills admission ticket;
(two) to apply for large buses, tractors, city buses, medium-sized buses and large trucks, and make an appointment for the test 20 days after obtaining the driving skills admission ticket.
Article 34 To apply for a motor vehicle driver's license for the first time or increase the number of quasi-drivers, the applicant shall meet the following requirements when making an appointment for examination subject 3:
(1) Those who apply for low-speed trucks, tricycles, wheeled bicycles, trolleybuses and trams are allowed to drive and make an appointment for the test 20 days after obtaining the driving skills admission ticket;
(two) to apply for small cars, small automatic cars, small automatic passenger cars for the disabled, and make an appointment for the test within 30 days after obtaining the driving skills admission ticket;
(3) Those who apply for the quasi-driving model of large buses, tractors, city buses, medium-sized buses and large trucks shall make an appointment for the test 40 days after obtaining the driving skills certificate.
Thirty-fifth people who apply for a motor vehicle driver's license with the military, armed police force or overseas motor vehicle driver's license shall complete the subject one examination within three years from the date of acceptance by the vehicle management office.
