Guidelines for Labor Inspection Reports and Complaints
1. Complaints should be submitted by the complainant to the competent human resources and social security departments. The complaint document shall specify the following matters:
1. The complainant’s name, gender, age, occupation, workplace, residence and contact information, and the name, residence, legal representative or principal of the employer being complained against. The name and position of the person in charge, as well as the violation of labor and social security laws, regulations and rules;
2. The fact that the legitimate rights and interests of labor and social security have been infringed and the complaint requests should be signed or stamped by the complainant.
2. Complainant’s certification materials
A copy of the complainant’s ID card (the original should be provided for verification); a copy of the employer’s business license or registration information. To recommend a representative for a collective complaint, you must also submit a power of attorney signed by the recommender.
3. Relevant evidence materials
Submit necessary evidence materials to prove that the infringement of the complainant’s legitimate rights and interests was caused by the employer’s violation of labor security laws and regulations, such as proving that the relationship and evidentiary materials related to the complaint request.
