1. Article 120 of the General Principles of Civil Law stipulates that the ways of civil liability for infringing on the interests of privacy should include stopping the infringement, eliminating the influence, making an apology and compensating for the losses. Anyone who infringes upon the privacy of others and causes property losses shall be fully compensated according to the principle of full compensation.
Anyone who infringes upon the privacy of others and causes mental damage to others, resulting in serious consequences, the victim has the right to request compensation for mental comfort. The amount of compensation for spiritual comfort shall be determined according to the degree of subjective fault of the infringer, the specific circumstances, consequences and influences of the infringement, the profit of the infringer, the economic affordability of the infringer and the average living standard of the place where the sued court is located.
2. Article 253- 1 of the Criminal Law stipulates that the staff of state organs or financial, telecommunications, transportation, education, medical and other units, in violation of state regulations, sell or illegally provide citizens' personal information obtained by their own units in the course of performing their duties or providing services to others. If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also or only be fined.
3. Article 42 of the Law on Public Security Administration Punishment stipulates that anyone who peeks, takes candid photos, eavesdrops or spreads others' privacy shall be detained for less than 5 days or fined for less than 500 yuan; If the circumstances are serious, they shall be detained for more than 5 days 10 days, and may also be fined up to 500 yuan.
