How to judge whether the expropriation evaluation report is legal: (1) According to the first paragraph of Article 20 of the Regulations on Expropriation and Compensation of Houses on State-owned Land, "the real estate price evaluation agency shall be selected by the expropriated person through consultation; If negotiation fails, it shall be determined by majority decision and random selection, and the specific measures shall be formulated by provinces, autonomous regions and municipalities directly under the Central Government. " Evaluation companies that do not produce according to this clause are illegal. The payee cannot directly specify the appraisal company. (2) The appraisal company shall carry out the appraisal work within the approved qualification level, and the appraisal report formed when the appraisal company exceeds the qualification level and the qualification certificate has expired or failed is invalid. A certified appraiser shall hold a valid registration certificate and relevant certificates. Otherwise, it has no right to issue an evaluation report. (3) Article 12 of the Measures for Assessing the Expropriation of Houses on State-owned Land stipulates that the real estate price assessment agency shall arrange a registered real estate appraiser to conduct on-the-spot investigation on the expropriated houses, investigate the conditions of the expropriated houses, take photos and other image materials reflecting the internal and external conditions of the expropriated houses, and make on-the-spot investigation records. If there is no actual investigation, it is a procedural violation, and the evaluation report formed should not be used as the basis for housing pricing. (four) the "evaluation method" stipulates that after the official report is issued, it shall be served on the expropriated person. Our country adopts the principle of service, that is, the document will take legal effect only after it is served on the parties, and it will not take effect if it is not served. (V) Article 31 of the Measures for the Administration of Real Estate Appraisal Institutions stipulates that the real estate appraisal report shall be issued by the real estate appraisal institution, stamped with the official seal of the real estate appraisal institution and signed by at least two full-time registered real estate appraisers. Moreover, it is necessary for the appraiser to sign and confirm, and the seal cannot replace the personal signature.
