Chapter I General Provisions Article 1 In order to promote the whole society to save energy (hereinafter referred to as energy conservation), improve energy utilization efficiency, protect and improve the environment, and realize green, low-carbon and sustainable development, these Regulations are formulated in accordance with the provisions of the Energy Conservation Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to energy-saving management, energy utilization and development and utilization of energy-saving technologies within the administrative area of this province. Article 3 Energy conservation work shall follow the principles of government guidance, market drive, scientific and technological guidance and public participation; Adhere to the mutual promotion of energy conservation and economic and social development. Article 4 The people's governments at or above the county level shall strengthen their leadership over energy conservation, incorporate energy conservation into the national economic and social development plans and annual plans, and organize the formulation and implementation of medium-and long-term special plans and annual energy conservation plans. Article 5 The development and reform department of the people's government at or above the county level is the competent department of energy conservation within its administrative area, and is fully responsible for the supervision and management of energy conservation.

Relevant departments of the people's governments at or above the county level, such as industry and information technology, housing and urban and rural construction, transportation, agriculture, statistics, etc. The institutions that manage the affairs of the organs shall be responsible for the supervision and management of energy conservation within the scope of their respective duties, and accept the guidance of the competent department of energy conservation at the same level.

The energy conservation supervision institutions under the departments of the people's governments at or above the county level in charge of energy conservation work are specifically responsible for energy conservation supervision. Article 6 This province implements dual control of total energy consumption and energy consumption per unit area GDP, establishes energy-saving target responsibility system and assessment system, and takes the target completion as the content of the annual assessment of the people's governments of cities and counties (cities, districts) with districts and their responsible persons.

The people's governments at or above the county level shall report to the people's government at the next higher level on the performance of energy-saving targets and responsibilities every year, and report the annual energy-saving work to the people's congress at the corresponding level or its standing committee as required. Article 7 The people's governments at or above the county level and their relevant departments shall effectively control the total energy consumption, optimize the energy consumption structure, reduce the proportion of coal consumption, encourage and support the development and utilization of new energy and renewable energy such as wind energy, solar energy and biomass energy, and increase the proportion of clean energy consumption. Article 8 People's governments at or above the county level and their relevant departments shall strengthen publicity and education on energy conservation, incorporate energy conservation knowledge and skills into the national education and training system, enhance public awareness of energy conservation, and advocate an energy-saving and environmental-friendly lifestyle.

News media should strengthen the publicity of energy-saving laws, regulations, rules, policies and energy-saving knowledge, and give play to the role of public opinion guidance and supervision. Article 9 All units and individuals shall fulfill their energy-saving obligations according to law and have the right to report acts of wasting energy. Chapter II Management and Supervision Article 10 People's governments at or above the county level shall establish a coordination mechanism, improve the energy-saving work system, make overall arrangements for energy-saving work, and study and solve major problems in energy-saving work. Eleventh energy conservation departments and relevant departments of the people's governments at or above the county level shall strengthen the supervision and management of energy conservation work, and investigate and deal with illegal acts of energy use according to law.

Energy conservation supervision institutions shall supervise and inspect the implementation of energy conservation laws, regulations, rules and mandatory energy conservation standards by energy production, operation and use units and other relevant units. The supervised unit shall cooperate and shall not refuse to supervise.

Energy conservation supervision funds are included in the fiscal budget at the same level, and energy conservation supervision institutions shall not charge fees to the supervised units. Twelfth energy-using units should strictly implement the mandatory national standards and industry standards related to energy conservation. Need to formulate local energy-saving standards, by the provincial standardization department in conjunction with the relevant departments to organize the formulation according to law, and timely revision.

Encourage enterprises to formulate enterprise energy-saving standards that are stricter than national standards, industry standards or local standards. Article 13 The statistical department of the people's government at or above the county level shall improve the energy statistical work system, improve the energy statistical system, strengthen the statistical analysis of energy consumption and utilization, provide relevant statistical data to the competent department of energy conservation in a timely manner according to the needs of the work, and jointly with the competent department of energy conservation, regularly publish energy consumption bulletins to the society. Fourteenth this province implements the energy-saving review system for fixed assets investment projects.

Fixed assets investment projects shall prepare energy-saving reports, and conduct energy-saving reviews on fixed assets investment projects in accordance with relevant state regulations, and the energy-saving review opinions shall be issued by the energy-saving departments of the people's governments at or above the county level.

Fixed assets investment projects without energy-saving review or unqualified review, the construction unit shall not start construction, and the completed projects shall not be put into production and use; Belonging to government investment projects, the authorities responsible for examination and approval according to law shall not approve the construction. Fifteenth people's governments at or above the county level shall strictly control the total coal consumption, formulate a plan to reduce the total coal consumption, and complete the annual total coal consumption reduction target.

Fixed assets investment projects with new coal consumption should be replaced (reduced) by coal consumption, and a coal consumption replacement (reduced) scheme should be prepared before the project approval, approval and filing, and reported to the competent energy conservation department for review. Article 16 The energy conservation departments and relevant departments of the people's governments at or above the county level shall establish and improve the energy conservation service system, encourage and support institutions of higher learning, scientific research institutions, social organizations and qualified enterprises and institutions to carry out energy conservation consultation, design, evaluation, testing, certification, energy audit, achievement transformation, technology transfer service, energy conservation technology training, and provide energy conservation information, energy conservation demonstration and other public welfare energy conservation services according to law.
