Article 2 The term "real estate" as mentioned in these Regulations refers to the land used and managed by the army according to law, as well as the above-ground and underground buildings, structures, ancillary facilities and equipment and other attachments used for barracks protection.
Article 3 The ownership of military real estate belongs to the Central Military Commission (CMC), and its land use right and ownership of buildings, structures and other attachments shall be exercised by representatives of the General Logistics Department. ?
Military real estate management business is managed by the barracks management departments of logistics (joint logistics) organs at all levels. ?
Military real estate is used and managed by relevant units and business departments according to their purposes.
Article 4 The basic principles of military real estate management are: ensuring combat readiness and life, following laws and regulations, relying on science and technology, rational planning and unified deployment, adhering to standardized management standards, implementing socialized reform of security, and taking the road of low investment and high efficiency.
Article 5 It is the obligation of all units and personnel of the whole army to protect and rationally use military real estate according to law. It is forbidden for any unit or individual to discard, damage or dispose of military real estate without authorization.
Sixth heads at all levels should strengthen the leadership of the military real estate management, support and supervise the barracks management department to perform their duties. ?
Personnel engaged in military real estate management should receive professional training, be familiar with business, be honest and trustworthy, and fulfill their duties. ?
Chapter II Responsibility
Article 7 The General Logistics Department shall perform the following duties in real estate management:
(a) to implement the principles, policies, laws and regulations of the state and the Central Military Commission on real estate management, and to formulate regulations on real estate management of the whole army; ?
(two) responsible for the deployment, disposal, utilization and management of military real estate; ?
(three) in conjunction with the relevant departments of the state for examination and approval of military construction land plan; ?
(four) to examine and approve the camp planning of units above the corps level; ?
(five) to decide on major issues such as the general survey, registration and liquidation of real estate in the whole army; ?
(six) to guide and supervise the real estate management of the whole army; ?
(seven) other duties assigned by the Central Military Commission (CMC).
Article 8 The barracks management departments of logistics (joint logistics) organs at all levels shall perform the following duties:
(a) to implement the national and military guidelines, policies, laws and regulations on real estate management, formulate rules and regulations on real estate management, and organize the implementation and supervise the implementation; ?
(two) to undertake the review and preparation of land use plans for military construction projects; ?
(3) Organizing the preparation of camp planning; ?
(4) Organizing the management, maintenance and use of military land, camps, barracks, facilities and equipment; ?
(five) to organize the implementation of the protection and management of water, electricity, gas and heating in the camp; ?
(six) to undertake the deployment and disposal of military real estate; ?
(seven) responsible for military real estate statistics; ?
(eight) the management of military real estate property archives; ?
(nine) the organization of real estate management personnel business technical training; ?
(ten) to organize scientific and technological research, technological innovation and popularization and application of scientific and technological achievements in military real estate management; ?
(eleven) other real estate management responsibilities assigned by the superior.
Ninth military real estate use management units shall perform the following duties:
(a) to implement the laws, regulations and rules and regulations of the state and the military real estate management; ?
(two) the implementation of the camp planning approved by the superior; ?
(three) the organization of the camp real estate standardization management activities; ?
(four) to complete the real estate management tasks assigned by the superior; ?
(five) to organize the activities of saving water, electricity and coal (oil and gas); ?
(6) Organizing specialized courses and group management and group repair activities; ?
(seven) other real estate management responsibilities assigned by the superior.
Article 10 Units undertaking scientific and technological research, personnel training and technical supervision and monitoring of military real estate management shall, in accordance with the division of responsibilities, carry out research on basic theories and applied technologies of real estate management, train qualified professionals, perform supervision and monitoring duties, provide technical consulting services and popularize scientific and technological achievements. ?
Chapter III Management of Military Land Use
Article 11 The military land mentioned in these Regulations refers to the following state-owned land that the army has the right to use:
(a) the land used in the camps of troops, organs, universities, scientific research institutes, hospitals, sanatoriums, rear warehouses, retired cadres and other units; ?
(2) Army fortifications, coastal defense, air defense, positions of the Second Artillery Corps, communications, army civil air defense projects, and land reserved for national defense projects such as old airports, old ports and old caves; ?
(3) proving ground (base), training ground, shooting range and other places for scientific experiments and military training; ?
(4) Land for special facilities such as special military railway lines, highway branches and water, oil, gas and power transmission pipelines; ?
(5) Land for military agricultural and sideline production; ?
(6) land for military factories; ?
(7) Other land managed and used by the army according to law.
Twelfth military construction land planning management system. ?
When applying for the allocation of state-owned land for military construction projects, it is necessary to prepare a land use plan according to the establishment, tasks, deployment fixed-point documents and land quota of the land-using units, report it to the General Logistics Department step by step, incorporate it into the annual construction land plan of the whole army, and go through the land allocation procedures in accordance with relevant regulations. Without approval, no unit may transfer the land.
Thirteenth military land use control system. ?
The land used for military construction projects shall be subject to the overall land use planning prepared by the people's government; Where the special military land is inconsistent with the overall land use planning, it shall be handled through consultation with the relevant departments of the people's government. ?
Camp construction must use land according to the camp planning. ?
National defense projects, special facilities, scientific experiments and military training sites shall not be used for other purposes without authorization. Fourteenth military land transfer to implement the licensing system. ?
Troops that have been approved to transfer military land must apply for military land transfer licenses in accordance with relevant regulations and go through land transfer procedures with local people's governments at or above the county level. ?
Chapter IV Camp Management
Article 15 The term "camp" as mentioned in these Regulations refers to an area with a fixed location and clear boundaries, where houses are built for the life of troops and are organized and managed by troops.
Sixteenth camp planning and management. ?
Camp planning is the basis of camp construction and transformation. Its contents include: the division of camp land, the plane layout and quantity of various buildings, structures, ancillary facilities and green spaces in the camp. ?
Based on the existing foundation, camp planning focuses on long-term development, and the implementation of the barracks quota occupation system is conducive to improving the environmental quality, occupation quality and supporting facilities quality of the camp. ?
There are more than two camps that use management units, and camp planning should be jointly prepared. ?
Camp planning is compiled every ten years. Once the camp planning is approved, it must be strictly implemented, and no unit or individual may change it without authorization.
Seventeenth camp management. ?
Conditional camps should be divided into military administrative areas and family living areas. ?
Conditional family living areas can be divided into apartment areas and housing areas.
Eighteenth conditions of the camp, should implement the management of public security. Property management is gradually implemented in the sales area.
Nineteenth temporary buildings and structures shall not be built without authorization in the camp; No unauthorized occupation of roads, playgrounds, high-voltage power supply corridors or underground pipelines; No sand digging, quarrying, earth borrowing and blasting are allowed without authorization. ?
Family houses and other buildings and structures unrelated to military management shall not be built in the military administrative zone. ?
No non-military houses or facilities shall be built in the apartment area.
Twentieth camp use management units should take effective measures to protect and improve the ecological environment of the camp, to prevent pollution and greening of the camp.
Article 21 The principle of "putting prevention first, combining prevention with fire fighting" should be implemented in camp fire fighting, and a joint fire fighting system should be established in communities and camps, and the fire fighting system should be improved, and a fire fighting team should be established, equipped with fire fighting equipment and fire fighting facilities maintained. ?
The military affairs department, the security department and the barracks management department are jointly responsible for the fire control management in the camp.
Twenty-second vacant camps should be treated differently and classified management should be implemented to prevent desolation, destruction and loss; No alteration, expansion or new construction shall be carried out without authorization. ?
The empty battalion must give priority to ensuring the internal adjustment and use of the army; In accordance with the relevant provisions, it is also possible to adopt reserve custody, land demolition, paid transfer, rent-free custody, valuation transfer or other means permitted by national and military policies, laws and regulations. ?
Chapter V Barracks Management
Article 23 Barracks as mentioned in these Regulations refer to houses owned by the army and used and managed by military units. ?
The army implements a quota system for barracks occupation. The limit of barracks living area shall be approved according to the unit personnel, equipment establishment and barracks construction area standard.
Twenty-fourth military housing should be guaranteed by combining apartment housing with self-owned housing. ?
Servicemen can rent apartments and move out after leaving their jobs or buying their own houses.
Twenty-fifth barracks management departments should regularly organize barracks quality rating. ?
Barracks are divided into intact houses, basically intact houses, generally damaged houses, seriously damaged houses and dangerous houses. ?
In areas with seismic fortification requirements, the quality grade of barracks should be determined according to the seismic capacity.
Twenty-sixth barracks maintenance should be carried out in accordance with the quality grade of barracks and the following provisions:
(a) to transform the dangerous room that must be used, and the transformation project is planned and managed by the General Logistics Department; ?
(2) Overhauling the severely damaged houses that must be used, and the overhaul project is planned and managed by the logistics (joint logistics) organ of the military unit; ?
(three) the repair of damaged houses in use shall be planned and managed by the air force, group army of the military region and the logistics organs, joint logistics, directly affiliated departments, maintenance and division bases of equivalent units; ?
(four) the barracks management unit is responsible for organizing minor repairs to the houses damaged locally.
Article 27 In-use barracks and fixed facilities in areas with a basic earthquake intensity of 7 degrees or above that have not been subjected to seismic fortification or whose design intensity is lower than the requirements of national codes shall be reinforced. ?
The seismic strengthening project is planned and managed by the General Logistics Department.
Twenty-eighth barracks maintenance adopts the combination of social professional teams and military units to organize their own maintenance. Conditional units should face the society and carry out bidding.
Twenty-ninth barracks should be used in accordance with the design function, without the consent of the barracks management department, any unit or individual.
People are not allowed to change their use, increase the load of barracks or change the structure and components of barracks without authorization. ?
Chapter VI Facilities and Equipment Management
Thirtieth buildings and structures used for water supply and drainage, power supply, heating, gas supply, environmental protection, greening, fire fighting and other purposes in the camp, as well as roads, bridges and culverts, pipelines, slope protection and fences in the camp belong to barracks facilities; Water pumps, generator sets, transformers, power distribution cabinets, boilers and manned cargo elevators belong to barracks equipment. ?
Facilities and equipment shall be constructed in accordance with the camp planning, and installed, used and maintained in accordance with relevant technical standards and operating procedures.
Thirty-first facilities and equipment to implement regular inspection, monitoring and daily inspection and maintenance system, timely update and transformation. ?
Operators and maintenance personnel of facilities and equipment shall receive technical training and hold relevant certificates. ?
Prohibit the use of equipment that must be scrapped after identification.
Thirty-second the supply of water, electricity and heating shall be managed quantitatively, and meters shall be installed according to households, and the metering fees shall be charged.
Thirty-third conditional units, the use, maintenance and management of their facilities and equipment, as well as the supply of water, electricity and heating can be socialized in different ways.
Thirty-fourth barracks equipment procurement is mainly based on bidding, supplemented by other ways such as inquiry procurement and directional procurement. ?
The purchased barracks equipment and equipment must have the product production license issued by the national and local industry authorities; Encourage the use of advanced equipment and water saving and energy saving equipment.
Thirty-fifth public camps should be equipped according to the standard, and the responsibility should be assigned to people and the valuation should be managed. ?
Chapter VII Property Right Management and Property Right Registration
Thirty-sixth military real estate management units must, in accordance with the relevant provisions, go through the real estate registration formalities at the local people's government at or above the county level where the real estate is located, and obtain the land use right and the house ownership certificate.
Article 37 Military real estate shall be arranged in an overall way and rationally allocated according to the needs of combat, combat readiness, training, life and production. ?
Military real estate is distributed among military units free of charge.
Article 38 The real estate needed for the adjustment and deployment of the army and newly formed units in peacetime shall be allocated from the spare real estate as far as possible; If new barracks are really needed, they must be strictly controlled.
Thirty-ninth military real estate allocation should be subject to grading examination and approval. ?
Real estate deployment involving units at or above the regimental level, missile battalions and national defense engineering facilities shall be handled by the General Logistics Department according to the orders and replies of the Central Military Commission or the General Staff. The general logistics department shall examine and approve the allocation of real estate that does not involve or cross military units, is completely located in or has a barracks area of over 5,000 square meters, or has a land area of over 1 hectare. The allocation of other military real estate shall be examined and approved by the military and reported to the General Logistics Department for the record.
Article 40 The transfer scope of military real estate allocation includes: land, barracks, fixed facilities and equipment, other ground attachments and their files. ?
Where public camping equipment and movable equipment are deployed within a military unit, the scope of transfer shall be determined by the logistics (joint logistics) organ of the military unit; The deployment of troops across military regions is decided by the General Logistics Department. ?
Both parties to the real estate handover must carefully check the handover list and physical objects, and perform the handover procedures in accordance with the prescribed time limit and procedures. If there are any differences over the handover, both parties shall directly coordinate with their superiors to solve them; If the coordination fails, both parties shall ask the superior for instructions.
Forty-first seriously damaged houses and dangerous houses that have exceeded the service life of barracks and have no value for transformation and utilization, as well as dangerous houses that affect the planning and layout of barracks, should be demolished. ?
The management unit's overall demolition of barracks or sporadic demolition of barracks with an area of more than 3,000 square meters (inclusive) shall be approved by the General Logistics Department; Sporadic demolition of barracks below 3000 square meters shall be examined and approved by the logistics (joint logistics) organ of the military unit and reported to the General Logistics Department for the record.
Forty-second idle real estate entrusted to the local people's government for free escrow shall be examined and approved by military units and reported to the General Logistics Department for the record.
Article 43 The army's spare real estate may be leased to local governments upon approval, and the lease management measures shall be formulated by the General Logistics Department.
Forty-fourth paid transfer of military real estate (including co-construction, reconstruction and exchange, the same below) shall be approved by the General Logistics Department. ?
The paid transfer of military real estate must be evaluated by a legally qualified evaluation agency, and the transfer price shall not be lower than the lowest price determined by the local people's government. ?
When national construction projects and local people's governments really need to occupy military real estate in the implementation of urban construction and development planning, they should compensate according to the value of the occupied real estate in accordance with relevant regulations.
Article 45 The proceeds from the lease, paid transfer and other uses of military real estate shall be mainly used for the construction of military infrastructure and barracks.
Forty-sixth army idle real estate appraisal transfer, approved by the General Logistics Department, the receiving unit must be at the county level.

Forty-seventh without the approval of the Central Military Commission (CMC), military units shall not cooperate with overseas organizations or individuals to use the military real estate under their management.
Article 48 If the right to use military land and the ownership of houses are approved to be transferred outside the military, the military real estate use management unit must go through the registration formalities of change at the local people's government at or above the county level where the real estate is located.
Forty-ninth military real estate management departments and use management units should establish and improve the real estate property registration files. ?
Military real estate property archives shall be managed at different levels and kept permanently. ?
Chapter VIII Reward and Punishment
Fiftieth units and individuals that meet one of the following conditions shall be rewarded in accordance with the relevant provisions of the Disciplinary Regulations of the People's Liberation Army of China:
(a) has made outstanding achievements in the standardized management of real estate in the camp; ?
(two) outstanding deeds in protecting military real estate; ?
(3) Having made outstanding achievements in camp fire safety management and safety and energy saving of facilities and equipment; ?
(four) the scientific and technological research of real estate management has made great achievements or put forward major countermeasures and suggestions in real estate management or made innovations in management techniques and methods, and achieved remarkable results; ?
(5) Having made outstanding achievements in other aspects of military real estate management.
Fifty-first in any of the following circumstances, in accordance with the relevant provisions of the "China People's Liberation Army Discipline Order", the person in charge and the person directly responsible shall be punished; If the case constitutes a crime, criminal responsibility shall be investigated according to law; Notification and approval unit:?

(five) other acts that hinder the management of military real estate. ?
Chapter IX Supplementary Provisions
Fifty-second services and military regions may formulate relevant regulations in accordance with these regulations.
Article 53 The real estate management of the Chinese People's Armed Police Force shall be implemented with reference to these Regulations.
Article 54 The General Logistics Department shall be responsible for the interpretation of these Regulations.
Article 55 These Regulations shall come into force as of the date of promulgation. ?
