When I first entered the court, I was still a teenager who had just stepped out of school. When you work as a judge, you hold the power of judicial jurisdiction. On the one hand, you resolve disputes and resolve disputes; on the other hand, you defend fairness and justice. Facing the complicated world, one should constantly look back and forth between the law and the facts of the case, and abstract the constituent elements that comply with the legal provisions from the complex facts of the case, so as to make correct judicial decisions and maximize the value of law. . The clerk is the first stop on the road to being a judge. Since I have no previous work experience, although I am full of enthusiasm, when faced with the tedious and repetitive work of a clerk every day, I can’t help but feel a little disappointed at first. and resistance. However, what makes me even more depressed is that I am not doing well in the seemingly simple job of being a clerk. The daily work of filing, delivering, court records, scanning electronic files, closing cases, binding files, etc. takes up a lot of my time. I still remember that when I first came to work, I was often criticized by the judge because I was not proficient in typing and was not able to write smoothly in court records. But I didn't take it seriously, and I kept going my own way and didn't pay attention to the real problem. Until one time, the president of the court told me very sternly that I couldn't even practice typing well. Because I was severely criticized by the president of the court, I made up my mind to solve this problem, so I went home and installed a special calligraphy software on my computer to practice repeatedly. After mastering the basic skills, I consciously applied the practice during normal court sessions, and the results were achieved. It's still very noticeable. Up to now, I can basically type accurately without looking at the keyboard. Filing a case is also an important job of the clerk. When filing a case, the first thing is to grasp the reasons for the case, and the reasons for the case must be accurate. I remember one time when the cause of the case was mistaken due to negligence when filing a case, the president of the court was very angry. Because of this, I was even deprived of the right to file a case for a period of time. Generally speaking, when I first started working, I was extremely anxious because I lacked work experience, especially in legal work, where I couldn’t make mistakes in every aspect. After experiencing the confusion and pain of entering the court for the first half of the year, I gradually entered the role of court staff and became aware of my own work. , my heart is no longer anxious, but determined.
The court is a place where all kinds of conflicts and disputes gather. How to resolve conflicts and settle disputes has become a question that every court staff thinks about and it is also the daily work of court staff. For example, the president of the court often said to me, "When the case is in your hand, you should imagine that there is a thread in your hand, and you are holding the thread yourself instead of letting the thread lead you." ?Although the language is simple, it makes sense. Only by holding the case in your own hands can you accurately grasp the process of the case and grasp the nodes of the case, so that you can be calm and well-informed. One court session was a divorce case. The chief judge insisted on mediation and patiently worked with both parties, and finally the case was settled through mediation. On the way back, I asked the judge why such a simple divorce case must insist on mediation. If mediation fails, wouldn’t it be simple and fast to make a direct judgment? The judge said meaningfully: "There is a knife next to the word judgment!" After listening, I understand this sentence. For divorce cases, the identities of the parties are relatively special. If the case is closed with a simple judgment, it will not be conducive to repairing the relationship between the parties and may even aggravate the emotional rift. Through mediation work, the emotions of the parties can be soothed in a timely manner, conflicts between the parties can be resolved through detailed communication, and it is also conducive to repairing emotional relationships. When hearing a case, the court should not simply discuss legal issues, but should also pay attention to the social effects of the trial.
Through my own continuous learning, learning from books, learning from people around me, and learning from veteran judges, I can personally feel the improvement of my abilities, and also realize the value and sense of belonging of working in the court. During this period, I experienced many unforgettable major cases and events, thanks to many good teachers, good classmates, good leaders, and good colleagues who sincerely helped me. Like many legal classics, no matter how familiar the content was, it gradually melted and disappeared. However, the harvested spirit and encouragement are becoming more and more like the names of these books, which are sunnier, louder, and more shining. This contains the "Chinese-style" legal popularization, which brings inspiration and thinking to China's judiciary and even China's rule of law.
Taking to the streets to popularize the law is a judicial task, as well as judicial memory and judicial scenery. After graduating from university, I was assigned to work in the High Court. It was very honorable and unforgettable. This constituted my original intention as seen today, and corresponded to the principle that "the first thought is the original intention". I have worked in the High Court for 25 years. Although there was a "limitation of time" interruption of more than three years in working in the middle and grassroots courts, I am still the group of people who owe the most to the High Court. My feelings and knowledge about the High Court largely come from taking to the streets to promote the law. I remember that in March every year, during the "Learning from Lei Feng Month", all major political and legal agencies would take to the streets to carry out legal propaganda. The main form was that each unit would spread out on both sides of Jiefang Street, hang banners and distribute promotional materials. Sometimes Use a tape recorder to play your own tapes. That scene was very spectacular when I think about it now. There are banners on both sides of the narrow street, and the tape recorder plays various news broadcasts. There are many public prosecutors, prosecutors, and judicial officers, and red, yellow, and blue promotional pages are stuffed in front of everyone. There are also other lists of work safety, adult enrollment, etc. Just take it. Once you finish taking it, the mission may end early. It is said that many pancake vendors came out to collect various promotional flyers at that time, and then distributed them collectively when they returned to sell pancakes. Of course, the most important thing is that there were more people coming to consult on legal issues at that time, especially the people's recognition of the High Court's propaganda points. Therefore, every time the High Court specially selects cadres with good professional skills to go to the streets to answer people's legal questions on the spot. This is also a recognition of the cadres' judicial capabilities. At that time, under normal circumstances, there were not many people coming to consult about cases at first, and the number only increased year by year. In general, in retrospect, at that time, the people's desire for legal knowledge was very strong. Some asked for advice when they encountered problems, and some came to understand them only after thinking about the problems. The cadres of the court, wearing cotton coats and large hats, holding various legal documents, tried their best to answer the questions, and the people also came with questions and responded with leaflets. It was a judicial demand that was very simple and strong, but the judicial A simpler time with very limited supplies. Under such conditions, the people's trust in the judicial organs is quite high, and their demand for legal knowledge is not very urgent. A large number of publicity pictures and data have become "strong evidence" of the effectiveness of the work of judicial organs at all levels. In the following twenty years, the number of cases in the court began to increase year by year. The number of political and legal units taking to the streets to publicize the law is no longer as high as before, and the scale has gradually begun to decline. More of them have their own promotions, and special promotions are carried out on various theme days, but the name begins to slowly change from legal promotion to legal promotion. Later, "National Constitution Day" publicity on the streets was infused with legal elements. Paper leaflets and promotional display boards were gradually replaced by electronic screens and promotional videos. Sports-style legal propaganda was gradually updated by various carriers that promoted the spirit of the rule of law. Around 2000, the full text of the ruling on the intentional homicide case of defendant Wang Binyu heard by the High Court was published in the Legal Daily, sparking heated discussions throughout the city; the first trial of the April 20 police assault case was broadcast live on **TV, and the streets were deserted. It became an unforgettable moment of the rule of law in that era and a useful exploration of judicial openness. In response, the number of litigation cases in courts at all levels has begun to explode. Enforcement difficulties have made their debut. The filing hall has been transformed and upgraded into a litigation service center. Litigation service personnel have doubled and intelligent equipment has been widely used. Under such circumstances, now every year at the two sessions of the autonomous region, deputies propose asking the courts to increase judicial publicity and increase the use of cases to interpret the law, which has become the most common opinion and suggestion. The law of judicial supply has begun to guide judges to reflect on the functions and levels of justice.
In November 2013, the Supreme Court held a judicial openness promotion meeting in Shenzhen and clearly proposed the establishment of "three major platforms" for judicial openness in people's courts. The first one was to promote the online disclosure of judgment documents. But in the blink of an eye, there was a hidden worry in my heart that I might be sent to work in the court. Because there was a relative shortage of judges in the court at that time, many colleagues in the courtroom asked to return to the court. I thought that after I obtained the legal professional qualification certificate, I would be appointed as an assistant judge soon. If there were personnel exchanges, I would definitely be sent to the court by the party committee of the hospital. To be honest, I don’t want to go to court for the time being. One reason is that the child was only a few days old at the time, and it was difficult for the wife to take care of the child by herself while she was still in labor. Judge Lao Zhang and I are in the same office. The old Zhang family is from Qinghai, a Tu nationality, a veteran, and once served as the president of Dashuigou Court (later moved to Chonggang Town and renamed Chonggang Court, and later moved to Shahu and renamed Shahu Court). Yao Fu, the president of the court and others, likes the quietness of the court and has never been willing to return to work in the court. He is a very hard-working man and is a good farmer. No matter which court he is in, the vegetable plot in the small yard is full of vitality. When I arrived at court on the first day, there happened to be a water supply contract dispute case to be dealt with. He said to me, "I have a bad temper and love to get angry. You can mediate this case and settle it on me." After saying that, he went out to work. Although cases were handled in the court in the past, it was only when the judge was present that he assisted the judge in handling the cases. Now I have to shoulder the heavy responsibility of handling the case alone. I was very nervous at the time. Fortunately, the case was not difficult and the mediation was completed in half an hour. I showed him the mediation agreement, and Lao Zhang said: After all, he studied law, so that’s good. Will you give me a shot in the future? I was so nervous and excited at the time. But in May of that year, the lovely Judge Zhang said he was going to see a doctor at his daughter’s office in Beijing. As a result, he fell seriously ill on the train on the way there and died in Beijing. After all, he never returned to the court he loved. In the vegetable patch. I didn't learn any more experience from him, but I always regarded him as my master in my heart.
The work of the court is not as formal as that of the court organs. The filing of cases, delivery to court and execution are all arranged by oneself according to needs, which is relatively free. We usually deliver the goods on Monday, hold court sessions on Tuesday and Wednesday, and execute the case on Thursday and Friday. I remember one time there were more than a dozen theaters arranged in one day. It was like an opera. You would sing and I would go on stage. It was not until around 8 o'clock in the evening that the last case was finally mediated. No matter the client, the lawyer or even himself, everyone admires our professionalism in our work. Everyone worked hard and happily, and sometimes they would not go home until late. After dinner, everyone would sit around the court table, eating melon seeds, watching TV, and making household chores. Occasionally, when they were happy, they would serve a few side dishes and drink a few bottles. beer.
The most difficult thing about the court at that time was the winter. There was no heating, so coal stoves were used for heating. Because the house was built relatively early and the windows were poorly sealed, the stove in the middle of the floor in the office was burning brightly during the day, but my feet were numb from the cold. During the night shift, I was so cold that I huddled up under the quilt and wanted to cover everything I could. When I wake up in the morning, the water in the basin will freeze.
To say that the hardships in life are not the most difficult, the most pitiful thing is that for a period of time, I did not have my own office space. In 2005, the first year after I was appointed as the president of the ** Court, it was said that one court and two offices (i.e. the court and the police station and the judicial office) would be built in one building and the court would be demolished. As a result, the court was demolished and the building that was built was given to the police station. At that time, the manpower in the court was also very tight, so we had to move back to form a circuit court. The people have objections to moving courts to handle cases in courtyards. For several consecutive years, representatives at the National People's Congress have proposed that courts should be located closest to the parties to facilitate litigation by the masses. The Supreme Court also proposed the principle of convenience in setting up courts. So in 2008, we were sent down again. But where is the office? At first, we rented the office space from the ** Village Committee. However, less than a year later, we received a notice on the weekend that the superior organization department believed that the village committee violated the regulations by renting out the office space and asked us to Must be moved. I had to take everyone to move the office equipment to an acquaintance's house. At that time, I felt like a lost dog, and my mood was extremely bad. Later, I rented a facade room in front of the old market to work. It faced the north and the environment was even worse. In winter, the cold wind and dust poured into the house, making it so cold that no one could work. In summer, the garbage dump opposite stunk. Not to mention the fumes, swarms of flies swarmed into the house like clouds as soon as you opened the door. Even so, our trial and enforcement work has not relaxed at all. Among the five grassroots courts (the head gate court was later added), the ** court has the most trial and enforcement cases, and the five people in the court still exert a high degree of professionalism. The spirit of unity and cooperation has inherited the fine style of the old court. For two consecutive years, the ** court has won the first prize.
With the increased investment in grassroots infrastructure by higher authorities, the new courtroom with a construction area of ??585 square meters was finally put into use in October 2010. This is the first court among the five grassroots courts of the ** Court to be built according to standards. The filing area, trial area, office area, rest area, etc. are fully functional, and all telecommunications and broadband are connected. On the day when the ribbon was cut for the new court, I cried with joy like a wanderer returning home from a foreign land. The new court has a new atmosphere. In the new working environment, all the court staff are more motivated to work. In addition to continuing to lead among the five grassroots courts in our trial execution work, we also focus on the construction of court culture, creating a cultural corridor in the new court and opening the first grassroots court website in the region.
