According to Article 10 of the Regulations of the People's Republic of China on Resident Identity Cards, those who have been sentenced to criminal detention or fixed-term imprisonment or above, those who have been reeducated through labor and those who have been detained have not yet applied for resident identity cards, and they will not be issued resident identity cards during the period of serving their sentences, reeducation through labor and detention. If a resident identity card has been obtained, the executing organ shall confiscate the resident identity card in accordance with the regulations. After the reeducation through labor is released or lifted, I shall apply for a resident identity card or return the original resident identity card to me.
A criminal refers to a person who has been sentenced to more than fixed-term imprisonment by a people's court for a criminal offence, and then entered a detention center or reformed through labor in a prison or a reform-through-labour institution.
