Legal analysis: the agent ad litem invited by the victim has the right to read the papers. Usually, we all know that the defense lawyer of the defendant in criminal cases can apply to the procuratorate for marking the papers during the examination and prosecution stage, that is, consulting, extracting and copying the files. As a victim, he can ask the agent ad litem to read the document during the examination and prosecution stage. But there is a premise that the victim's agent ad litem should be allowed to read the papers by the procuratorate. The defendant's defense lawyer doesn't need it. But in practice, the procuratorate generally agrees with the lawyer invited by the victim.

Legal basis: Rules of Criminal Procedure of People's Procuratorate

Article 55 The people's procuratorate shall, within three days from the date of receiving the case file materials transferred for prosecution, inform the victim, his legal representative or close relatives, the parties involved in an incidental civil action and his legal representative that he has the right to entrust an agent ad litem. If the victim and his legal representative or close relatives fail to entrust an agent ad litem due to financial difficulties, they shall be informed that they can apply for legal aid. If the oral notification is made face to face, it shall be recorded in the record and signed by the informed person; If it is notified by telephone, it shall be recorded; If written notice is given, the service receipt shall be entered into the volume. If the number of victims is large or uncertain and cannot be informed one by one through the above methods, they can be informed by announcement. If it is impossible to inform, it shall be recorded. If the victim has a legal representative, he shall inform his legal representative; If there is no legal representative, it shall notify its close relatives. If there are two or more legal representatives or close relatives, one of them may be notified. The notification shall be made in the order listed in Item 3 and Item 6 of Article 108 of the Criminal Procedure Law. If the parties and their legal representatives or close relatives entrust agents ad litem, it shall be implemented with reference to Article 33 of the Criminal Procedure Law and other legal provisions.

Article 56 Where an agent ad litem is permitted by the People's Procuratorate to consult, extract or copy the case file, it shall be handled with reference to the provisions of Article 49 of these Rules. If a lawyer acts as an agent ad litem and needs to apply to the people's procuratorate for collecting and obtaining evidence, it shall be handled with reference to the provisions of Article 52 of these Rules.
