The term "drug rehabilitation medical institutions" as mentioned in these Measures refers to specialized drug rehabilitation hospitals and other medical institutions with drug rehabilitation treatment departments that meet the requirements of the Interim Measures for the Administration of Drug Rehabilitation Medical Services.

Article 4 When a public security organ discovers drug addicts in law enforcement activities, it shall identify them. If it is difficult to identify due to technical reasons, a qualified drug rehabilitation medical institution may be entrusted for identification.

Fifth medical institutions for drug rehabilitation shall be designated by the provincial health administrative department in conjunction with the public security organs at the same level.

Article 6 The public security organ shall identify drug addiction by two or more people's policemen, and put forward the identification opinions within 24 hours after making the conclusion of human biological sample detection, which shall be signed by the identification personnel, reviewed by the person in charge of the unit and stamped with the seal of the unit.

Relevant evidential materials shall be taken as an integral part of this opinion.

Seventh drug addicts meet the following conditions at the same time, the public security organ shall determine their drug addiction:

(1) It is proved by the detection of human biological samples that it contains pharmaceutical ingredients;

(2) There is evidence to prove that drugs have been taken;

(3) Having withdrawal symptoms or having a history of drug abuse, including having been investigated and dealt with by the public security organ for drug abuse or having voluntarily given up drugs.

The specific situation of withdrawal symptoms is determined with reference to the Guiding Principles for the Diagnosis and Treatment of Opioid Drug Dependence and the Guiding Principles for the Diagnosis and Treatment of Amphetamine Drug Dependence formulated by the Ministry of Health.

Eighth drug addicts in any of the following circumstances, the public security organs that their drug addiction is serious:

(1) Being ordered to accept community detoxification, compulsory isolation detoxification (including compulsory detoxification or reeducation through labor before the implementation of the Anti-Drug Law), community rehabilitation or participating in drug maintenance treatment, and taking or injecting drugs again;

(two) there is evidence to prove that injecting drugs or taking more than two drugs for many times;

(3) There is evidence that drug abuse is accompanied by affray, self-mutilation or violence against the personal and property safety of others.

Ninth public security organs in the process of drug addiction identification of human biological samples, in accordance with the relevant provisions of the "Drug Inspection Regulations" formulated by the Ministry of public security.

Article 10 The people's police who undertake drug rehabilitation appraisal by public security organs shall meet the following conditions:

(a) with a second-class police rank or above and more than two years of relevant law enforcement work experience;

(two) by the provincial public security organs and health administrative departments to organize training and assessment.

Twelfth drug rehabilitation medical institutions and their medical staff who undertake drug rehabilitation appraisal shall conduct drug rehabilitation appraisal in accordance with the relevant provisions of the Interim Measures for the Administration of Drug Rehabilitation Medical Services.

Thirteenth drug rehabilitation medical institutions to identify drug addiction, should be borne by two drug addiction identification doctors.

Article 14 A doctor who undertakes the identification of drug addiction shall meet the following conditions:

(a) in accordance with the relevant provisions of the Interim Measures for the Administration of Drug Addiction Medical Services;

(two) engaged in drug treatment for not less than three years;

(3) Having the qualifications for professional and technical positions at or above the intermediate level.

Fifteenth drug rehabilitation medical institutions to collect medical history and physical examination of drug addicts, should entrust the public security organs to send relevant personnel to assist.

Sixteenth drug rehabilitation medical institutions think it is necessary to carry out biological sample testing for drug addicts, and the public security organs entrusted by them shall assist in providing the test samples collected on the spot.

If the drug rehabilitation medical institution considers it necessary to re-collect other human biological samples, the entrusted public security organ shall provide assistance.

Article 17 The detection reagents used by drug rehabilitation medical institutions shall be products approved by the US Food and Drug Administration, and avoid cross-reaction with commonly used drugs.

Article 18 Medical institutions for drug rehabilitation and their medical staff shall, in accordance with the norms, practices and relevant provisions of diagnosis and treatment, identify drug addicts with the results of medical history, mental symptom examination, physical examination and human biological sample detection.

Nineteenth drug rehabilitation medical institutions shall issue a drug rehabilitation appraisal report within three working days from the date of accepting the entrustment, which shall be signed by the appraisers and stamped with the official seal of the drug rehabilitation medical institution. Measures for the determination of work-related injuries 1. According to Article 18 of the Regulations on Work-related Injury Insurance, the following materials shall be submitted to apply for work-related injury identification:

(a) the application form for work-related injury identification;

(two) the existence of labor relations with the employer (including factual labor relations);

(3) Medical diagnosis certificate or occupational disease diagnosis certificate (or occupational disease diagnosis certificate).

The application form for ascertainment of a work-related injury shall include basic information such as the time, place and cause of the accident and the degree of injury of the employees.

If the materials provided by the applicant for work-related injury identification are incomplete, the social insurance administrative department shall inform the applicant in writing of all the materials that need to be supplemented at one time. The administrative department of social insurance shall accept the corrected materials after the applicant has been informed in writing.

2. To apply for work-related injury identification, you need to go to the labor department where the work-related injury unit is located.

According to Article 17 of the Regulations on Work-related Injury Insurance, the employer shall apply for work-related injury identification for employees within 30 days from the date of accident injury.
