Article 1 In order to strengthen the public security management of seal engraving and prevent the use of seal engraving for illegal and criminal activities, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Measures shall apply to the administration of public security in the engraving of various seals within the administrative area of this province. Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 The term "official seal" as mentioned in these Measures refers to the normative name seals of legal persons or unincorporated organizations and their internal organs, dispatched offices, deliberation and coordination institutions and non-permanent institutions (hereinafter referred to as units or institutions), as well as special seals for contracts, finance, taxation, invoices and authentication. Use a standard name. Article 4 Whoever engages in the business of engraving official seals shall, after obtaining the business license issued by the market supervision and management department, apply to the public security organ of the local county (city, district) people's government for a special trade license. Engaged in the business of private seal engraving, it shall, within 10 working days from the date of obtaining the business license issued by the market supervision and management department, file with the public security organ of the local county (city, district) people's government. Article 5 To apply for a special trade license for engraving official seals, the following safety conditions shall be met:

(1) Having an independent official seal engraving room and a warehouse or safe for storing official seals of finished products;

(two) installation, equipped with collection, upload and other facilities and equipment that meet the requirements of the seal security management information system;

(3) Other conditions stipulated by laws and regulations. Article 6 An application for a special trade license for engraving official seals shall be submitted to the public security organ. The public security organ of the county (city, district) people's government shall, after receiving the application, examine and verify it, and make a decision on whether to issue a special trade license within 10 working days. Article 7 Units or institutions that need to engrave official seals shall go to the official seal engraving business unit for engraving with the approval documents, registration certificates and power of attorney for engraving official seals. Official seal engraving business units shall keep relevant materials for 2 years.

Units or institutions shall be responsible for the authenticity of the materials provided, and shall not resort to deceit. Article 8 Business units must abide by the following provisions when engraving official seals:

(1) When delivering the official seal, submit the basic information such as the name of the unit or institution that carved the official seal, seal, official seal engraving agent, etc. to the seal public security management information system for the record. But it needs to be kept confidential, except for paper filing.

(2) The official seal of the company is only used by the staff of the unit in the business workshop and may not be transferred or processed externally; According to the style, quantity, specifications and quality standards stipulated by the state; The finished products shall be kept strictly, and the samples shall not be kept or copied by themselves.

(3) Units or institutions that cannot provide relevant materials or provide incomplete materials shall not engrave official seals. Ninth normative names of units and institutions are only allowed to engrave a chapter; Multiple special seals for contract, finance and authentication can be engraved, but each one must be distinguished by Arabic numerals. The unit can carve another steel name seal. Article 10 If it is necessary to re-engrave the official seal due to the change of the name of the unit or institution or the damage of the official seal, it shall be re-engraved in accordance with the provisions of Article 7 of these Measures; After the new official seal is engraved, the original official seal is invalid and sealed or destroyed by the unit or institution where it belongs. If the official seal is robbed, stolen or lost for other reasons, it shall immediately report it to the public security organ truthfully, and declare the original official seal invalid in the newspaper publicly distributed above the city where it is located; If it is necessary to re-engrave, it shall be re-engraved in accordance with the provisions of Article 7 of these Measures on the basis of invalidation. The re-engraved official seal should be obviously different from the original official seal. Article 11 Where a unit or institution needs to engrave the official seal (including signature seal) of the legal representative, responsible person, financial personnel and other relevant personnel, it shall go to the institution to engrave the official seal with its resident identity card and power of attorney. Units or institutions shall strengthen the standardized management of the seals of relevant personnel specified in the preceding paragraph, and the relevant personnel shall be confiscated when they are transferred from their posts. Article 12 Where a business unit that engraves an official seal changes its name, business address and person in charge, it shall register the change with the market supervision and management department according to law, and go through the formalities for changing the special trade license to the public security organ that originally issued the seal; For other reasons, if it is closed down, it shall go through the cancellation procedures of the special trade license with the public security organ that originally issued the license. Where a business unit with a private seal changes its store name, business address and person in charge, it shall report it to the local county (city, district) public security organ for the record within 10 working days from the date of handling the change registration with the market supervision and management department. Shall not alter, resell, lease, lend or illegally transfer the official seal to engrave the special trade license in other forms. Thirteenth public security organs shall perform the following duties of public security management:

(1) Issuing special trade licenses for the engraving of official seals;

(two) take random checks, inspections and other ways. To supervise and inspect whether the business unit engraving the official seal complies with the provisions of Articles 8 and 12 of these Measures;

(3) Establishing the daily management system of the seal public security management information system, ensuring the normal operation of the information system, and providing relevant information inquiry services for the public;

(four) to guide and supervise the seal engraving business units to establish and implement the seal engraving safety and public security management system;

(five) in accordance with the law to deal with violations of public security management of seal engraving. Fourteenth in violation of the provisions of these measures, one of the following acts shall be handled by the public security organs of the people's governments at or above the county level in accordance with the following provisions:

(a) those who engage in official seal engraving business without obtaining a special trade license according to law shall be punished in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment.

(II) After the business unit of official seal engraving is approved to start business, if it changes the relevant facilities and equipment without authorization or refuses to implement the safety and public security management system, it shall be ordered to make corrections and be fined 1000 yuan to 5,000 yuan; If the circumstances are serious, the special trade license shall be revoked in accordance with the relevant provisions of the People's Republic of China (PRC) Public Security Administration Punishment Law.

(three) the business unit that engraves the official seal violates the provisions of Article 8 of these measures, and shall be ordered to make corrections and impose a fine of 65,438 yuan to 5,000 yuan; If the circumstances are serious, the special trade license shall be revoked in accordance with the relevant provisions of the People's Republic of China (PRC) Public Security Administration Punishment Law.

(4) If the business unit that engraves the official seal violates the provisions in the first paragraph of Article 12 of these Measures, it shall be given a warning or fined more than 200 yuan 1000 yuan, and ordered to go through the relevant formalities.

(5) If the seal engraving business unit violates the provisions of Article 4 and Article 12, paragraph 2 of these measures, it shall be given a warning or fined between 65,438 yuan and 0000 yuan in 200 yuan, and ordered to go through the relevant formalities.

(VI) Units and institutions that need to engrave official seals provide false materials and take other fraudulent means to engrave official seals, and impose a fine of 3,000 yuan to 5,000 yuan, and impose a fine of 65,438 yuan to 2,000 yuan on the person in charge or the person directly responsible.
