Article 1 These Detailed Rules are formulated in accordance with the Regulations on the Administration of Medical Institutions (hereinafter referred to as the Regulations).
Article 2 The term "medical institutions" as mentioned in the Regulations and these Detailed Rules refers to institutions that have obtained the Practice License of Medical Institutions through registration in accordance with the Regulations and these Detailed Rules.
Article 3 Types of medical institutions:
(1) General hospitals, traditional Chinese medicine hospitals, integrated traditional Chinese and western medicine hospitals, ethnic medicine hospitals, specialized hospitals and rehabilitation hospitals;
(2) Maternal and Child Health Hospital and Maternal and Child Health Family Planning Service Center;
(3) Community health service centers and community health service stations;
(4) Central hospitals, township (town) hospitals and street hospitals;
(5) sanatorium;
(six) comprehensive outpatient department, specialist outpatient department, traditional Chinese medicine outpatient department, integrated traditional Chinese and western medicine outpatient department, and ethnic medicine outpatient department;
(seven) clinics, Chinese medicine clinics, ethnic medicine clinics, health clinics, infirmary, health centers, health stations;
(8) village clinics (institutes);
(9) Emergency centers and stations;
(10) Clinical Laboratory Center;
(11) Specialized disease prevention hospitals, specialized disease prevention institutes and specialized disease prevention stations;
(12) sanatoriums and nursing stations;
(thirteen) medical laboratory, pathological diagnosis center, medical imaging diagnosis center, hemodialysis center, hospice care center;
(14) Other medical institutions.
Fourth health and epidemic prevention, frontier health and quarantine, medical research, teaching and other institutions. Beauty service institutions that carry out diagnosis and treatment activities and beauty service institutions that carry out medical beauty business beyond their business scope must apply for the establishment of corresponding medical institutions in accordance with the Regulations and these Detailed Rules.
Fifth medical institutions outside the establishment of the China People's Liberation Army and the Chinese People's Armed Police Force shall be managed by the local health and family planning administrative departments in accordance with the Regulations and these Detailed Rules.
The Logistics Health Department of China People's Liberation Army is responsible for providing the local health and family planning administrative departments with the names and addresses of medical institutions outside the military establishment.
Sixth medical institutions engaged in medical activities according to law, protected by law.
Seventh health and family planning administrative departments shall independently exercise supervision and management functions and powers according to law, and shall not be interfered by any unit or individual.
Chapter II Setting Approval
Article 8 All provinces, autonomous regions and municipalities directly under the Central Government shall rationally allocate and utilize medical resources according to the planning for the establishment of local medical institutions.
The planning for the establishment of medical institutions shall be formulated by the local health and family planning administrative departments at or above the county level according to the Guiding Principles for the Establishment of Medical Institutions, audited by the health and family planning administrative departments at the next higher level, reported to the people's government at the same level for approval, and promulgated and implemented within their respective administrative areas.
The guiding principles for the establishment and planning of medical institutions shall be formulated separately.
Article 9 The local health and family planning administrative departments at or above the county level shall, in accordance with the authority and procedures stipulated in the Guiding Principles for the Establishment Planning of Medical Institutions, organize the implementation of the establishment planning of medical institutions in their respective administrative areas, regularly evaluate the implementation, and report the evaluation results to the health and family planning administrative department at the next higher level and the people's government at the same level on an annual basis.
Tenth medical institutions regardless of category, form of ownership, affiliation, service object, its setting must comply with the local "medical institutions planning".
Article 11 The division of examination and approval authority for general hospitals, Chinese medicine hospitals, hospitals with integrated traditional Chinese and western medicine, ethnic medicine hospitals, specialized hospitals, sanatoriums, rehabilitation hospitals, maternal and child health care centers, emergency centers, laboratory departments and specialized disease prevention and control institutions with more than 100 beds shall be stipulated by the health and family planning administrative departments of provinces, autonomous regions and municipalities directly under the Central Government; The establishment of other medical institutions shall be examined and approved by the county-level health and family planning administrative department.
The examination and approval authority for the establishment of medical laboratories, pathological diagnosis centers, medical imaging diagnosis centers, hemodialysis centers and hospice care centers shall be stipulated separately.
Twelfth any of the following circumstances, shall not apply for the establishment of medical institutions:
(a) units that cannot bear civil liability independently;
(2) An individual who is serving a sentence or does not have full capacity for civil conduct;
(3) Medical personnel who have suffered a medical accident of class II or above for less than five years;
(4) Medical personnel whose practice certificate has been revoked due to violation of relevant laws, regulations and rules;
(5) The legal representative or principal responsible person of the medical institution whose Practice License for Medical Institution has been revoked;
(6) Other circumstances stipulated by the administrative departments of health and family planning of the governments of provinces, autonomous regions and municipalities directly under the Central Government.
Under any of the circumstances listed in Items (2), (3), (4) and (5) of the preceding paragraph, the legal representative or principal responsible person of a medical institution shall not be appointed.
Thirteenth individuals who set up clinics in cities must meet the following conditions:
(1) Having passed the examination of professional skills of doctors and obtained the practicing certificate of doctors;
(2) Having been engaged in clinical work in the same profession for more than five years after obtaining a doctor's practice certificate or a doctor's title;
(3) Other conditions stipulated by the administrative departments of health and family planning of provinces, autonomous regions and municipalities directly under the Central Government.
Technical standards for medical practitioners shall be formulated separately.
The conditions for individuals to set up clinics in towns and villages shall be stipulated by the health and family planning administrative departments of provinces, autonomous regions and municipalities directly under the Central Government.
Fourteenth local people's governments at all levels set up medical institutions, and the person in charge designated or appointed by the government applies for the establishment of medical institutions; A legal person or other organization applying for the establishment of a medical institution shall submit an application by its representative; The establishment of medical institutions by individuals shall be applied by the setters; Where two or more persons establish a medical institution in partnership, the partners shall jointly apply.
Fifteenth in accordance with the "Regulations" provisions of article tenth of the establishment feasibility study report includes the following contents:
(a) the name and basic information of the applicant, as well as the applicant's name, age, professional resume and ID number;
(2) Population, economic and social development in this region;
(3) The health status of local people, the prevalence of diseases and the prevalence of related diseases;

(5) The name, location, functions, tasks and service radius of the medical institution to be established;

(8) Instruments and equipment of the medical institution to be established;
(nine) the relationship and influence between the proposed medical institution and other medical institutions in the service radius area;
(ten) the sewage, sewage and feces treatment plan of the medical institution to be established;
(eleven) the communication, power supply, sewer and fire control facilities of the medical institution to be established;
(twelve) the source of funds, investment methods, total investment and registered capital (capital);
(thirteen) the investment budget of the proposed medical institution;
(fourteen) the cost-benefit prediction and analysis of the proposed medical institution within five years.
